According to our information, there are known extant populations of Federal and State Endangered Alasmidonta heterodon(dwarf wedge mussel)in the vicinity of this project. I have sent your letter to Julie Victoria(DEP-Wildlife)for further review. Natural Diversity Data Base information includes all information regarding critical biological resources available to Its at the time of the request. This information is a compilation of data collected over the years by the Natural Resources Center's Geological and Natural History Survey and cooperating units of DEP, private conservation groups and the scientific community.- This information is not necessarily the result of comprehensive or site-specific field investigations. Consultations with the Data Base should not be substitutes for on-site surveys required for environmental assessments. Current research projects and new contributors continue to identify additional populations of species and locations of habitats of concern,as well as,enhance existing data. Such new information is incorporated into the Data Base as it becomes available. Please contact me if you have further questions at 424-3592. Thank you for consulting the Natural Diversity Data Base. Also be advised that this is a preliminary review and not a final determination. A more detailed review may be conducted as part of any subsequent environmental permit applications submitted to DEP for the proposed site. Sincerely, Dawn M. Their records indicate that dwarf wedge mussels (Alasmidonta heterodon),which are federally and state endangered have a localized population in the Podunk River within the vicinity of this project. These freshwater invertebrates are very susceptible to degradation in water quality. Activities that degrade the water quality, particularly the dissolved oxygen and dissolved salts, will affect these species. ' F I have contacted the U. S. Fish and Wildlife Service (USFWS) Regional Field Office about this project and the possible detrimental affects to dwarf wedge mussels. USFWS endangered species biologist Susi vonOttingen's specific questions were: 1)what herbicides/algeacides will be used? 2)what will be the dilution factor by the time the chemical reaches the Podunk River? Please be advised that formal consultation with the USFWS may be required to avoid adverse effects to dwarf wedge mussels. Formal consultation with the USFWS, as described under Section 7 of the Endangered Species Act, is a process by which the Service determines whether the adverse effect is likely to jeopardize the continued existence of a species or cause "take". The Wildlife Division has not made an on-site inspection of the project area. The Division requests details of the proposed project and a timetable of the work to be done. Consultation with the Wildlife Division should not be substituted for on-site surveys required for environmental assessments. For over twenty-five(25)years,Route 5 Motor Cars Inc. has been engaged in the sale of used passenger automobiles(primarily wholesale with some retail)at its present location at 713 John Fitch Boulevard, South Windsor,Connecticut. For various reasons,my client needs to relocate its business. My client has entered into a contract to purchase 1429 John Fitch Boulevard. 1429 John Fitch Boulevard is located in the Industrial zone. The South Windsor Zoning regulations, allow, in the industrial zone: "Storage of operable passenger motor vehicles(operable being defined as qualifying for State of Connecticut motor vehicle registration), provided, however, that no sales or servicing of such vehicles is conducted on the premises." In order to operate its business at the 1429 John Fitch Boulevard location, however,my client needs the ability to sell and service vehicles on the premises. 1429 John Fitch Boulevard meets the criteria set forth in Section 6.1.3 of the zoning regulations as an appropriate site for the wholesale and retail sale of passenger automobiles. The Peachbrooke community was developed with a School Bus Shelter as part of the common property located near the entrance to the development. The school bus stops on Sullivan Ave. approximately one hundred feet from the location of the shelter making it essentially useless to the resident's children. At the recent Annual Meeting residents in the vicinity of the shelter have requested the removal of the shelter. The reasons they presented in support of the removal were the lack of use and the obstruction of their view when backing out of their driveways. The Peachbrooke Board of Directors has two questions that must be answered before any action can be taken to resolve the issue. First, is it a requirement for a Planned Urban Development to have a school bus shelter? Secondly, if it is required, can it be moved to a more convenient location within the development? Your response to these questions would be appreciated and allow us to provide a resolution to the issue. Sri ' ce e , Sohn L. The bus shelter is required under the zoning regulations governing Peachbrooke's type of development (Designed Residence). However, the location is specified as "a location convenient to the residents and readily serviceable by the passenger transportation operator." Thus, the shelter can be relocated to a more convenient location. If the Board does decide to move the bus shelter, please sketch out the proposed location on a copy of the site plan for our review and approval prior to moving the structure. If your proposed location would encroach into the right-of-way for Sullivan Avenue, State Dept. of Transportation approval would also be needed. Lip February, 2000 wpdoeskandi elsoci ety 39 Alexander Place South Windsor, CT 06 July 19, 2000 Phone: (860) 644-6827 U Planning&Zoning Commission South Windsor, CT 06074 To All Members and Alternates: We have recently applied for a building permit to add an approximately eight-hundred square foot addition to our house. The entire application has been approved with the single exception of the front door — hereafter referred to as "the door." Apparently, the approval of the Planning and Zoning Commission is required for the door, and at last night's meeting it was rejected. This topic should be on the agenda again for the meeting scheduled for Tuesday, July 25, 2000. As we understand the issue, the problem all revolves around the word "office" on the addition plans. The design is such that the room labeled office is the room that has the door. First, let us make clear that the room labeled office is not an office in the sense of a business office. It is a room in a house that will have in it, those things that are normally associated with a home office. Many homes have them. Sometimes this room is called a"den," other times it is called a,"study." Unfortunately, we used the word"office." In retrospect, a more appropriate name would be den or study. If this is your problem with this issue, please advise us as to the name you prefer, and we will resubmit the plans with that name on them. The door was placed where it is, because it was the most reasonable place to put it. You might notice that the addition has two front doors and two sliders. The house is in a quite neighborhood, and we wanted to be able to enjoy the outdoors. A suggestion was made to move the door to the side of the house. Other than using it as a fire escape,it has little vala`e there. We don't typically go out to that side of the house—or the other, for that matter. Aesthetically,it was our determination that the house looks better with the door, than without. The room the door opens into (the so-called office) also has in it, a staircase that leads up to the bedrooms. This is hardly the kind of thing that would be found in a business office. What would also be in the room, is a desk, bookcase, filing cabinet, phone, computer, probably a radio, perhaps a television, perhaps a table, and probably a fax machine. Right now, all of those things exist in the house. As a point of reference, both of the new bedrooms will also probably at some point have a phone, radio, television, and, money-permitting, a computer. With the exception of the fax machine,we will bet that most of you have all of these things in your house. And it is likely that most of them are all in either one or two rooms. As for use of the door, please consider the following: Anyone who comes to the house is more likely- than-not,to use the current front door. It is the closest door to the driveway, and is the one that visitors would naturally go to. Since the children's bedrooms will be on the same side of the house as the new Planning&Zoning Commission July 19,2000 Page 1 of 2 door(one is directly above the door), and the staircase leads directly from the bedrooms to the room the door is in, it would be"the door of choice" for the children to run into and out of the house. Perhaps the problem is aggravated by the fact that we have a"minor home occupation" at our house. Depending upon how it is calculated, the minor occupation uses about ten to twenty square feet of permanent space. It is likely that most of this space would be consolidated into the new room. And although the occupation space will likely be expanded, it is unlikely to use even one-half of the new room. The room itself does not exist solely for any business purpose. It would most likely be the room where the children work on their school projects. If it has a table, it will get them out of the kitchen. Yes—it needs a table! The"minor home occupation" is not charged and does not pay any rent or other consideration for use ofthe space. As previously stated, the space used is quite small. The occupation itself is very telephone intensive. Business is primarily conducted over the telephone, and the preferred spot to do this in the summer months would be in the back yard, or on the deck overlooking the back yard. Most of the business of the home occupation would be conducted somewhere other than in the room with the door. As for the law--it has been pointed out that the door might conflict with section 4.8.2 subpart H. This states "No entrance or exit in the dwelling or on the premises may be added solely for the conduct of the home occupation." As stated previously, the door exists for both aesthetic and practical reasons. The door is intended to be used by the children and us. I absolutely guarantee that it will be used by us. It is very unreasonable to assume that it is being added solely for the conduct of the home occupation. The number of persons that go through any door on the premises for the purpose of the home occupation, is conservatively(and honestly)estimated to be well under one per week. A month could easily pass where no one enters. It has also been argued, that the room with the door could be converted into a business office and the door could then be used exclusively for the business. Certainly it is not our intention to do that now or in the future. Furthermore, we submit that anyone with a door could at some future time decide to use that door primarily or exclusively for a business purpose. Using such irrational logic, front doors would not be allowed anywhere. Doors could be dangerous—maybe they should be outlawed. Soon maybe only outlaws will have doors. Certainly no one should be allowed to have more than one door. Seriously, you are welcome to come over to visit or call to discuss this further. One or both of us will be at the meeting to discuss this on Tuesday, July 25. Thank-you for taking the time to read and consider this.
