Request for approval under Section 4.1.9 to keep up to two horses on property at 96 Lawrence Road. General criteria for keeping horses for personal use include due consideration to the conservation of property values; the general character of the neighborhood, and the general welfare of the Town. In addition, there are specific criteria that apply, including: ♦ A minimum of two acres is required for the first horse and an additional acre for each additional horse. This property includes more than 4 acres. ♦ Housing/stabling of horses is restricted to the rear yard of the premises. The accessory buildings used to shelter or feed the horses must be located at least 125 feet from the street, 40 feet from any side or rear property line, and 100 feet from any dwelling located on an adjacent property. There is an existing barn on this property that does not meet the 40' setback requirement, but does meet the 100 feet from any dwelling requirement. The regulations have a provision for a waiver to these requirements in cases where lot configuration and location do not permit strict conformance with the regulations. The applicant has requested this waiver. ♦ A fenced area of at least one acre for each horse must be provided. In lieu of fencing, a riding ring may be substituted. ♦ Manure shall not be allowed to accumulate to cause any health hazard, and shall be subject to inspection by the Health Officer. Fly control measures shall be required; and ♦ There shall be no outside storage of feed or bedding material. 2. The applicant has submitted a letter indicating his intent to comply with all provisions of the regulations. 3. If this application is approved, the Planning Dept. would like to see the proposed fenced area depicted on the map. 4-0 p TO South Windsor Planning and Zoning Commission FROM: Elizabeth Cole and Frank Zimnicki DATE: May 24, 1999 Re: Application for approval to keep horses On June 15, 1999, we will purchase the house at 96 Lawrence Rd. in South Windsor. and an adjoining parcel of land which measures 3.7 acres. We would like to apply for approval to keep 2 horses on that property, and to use the existing barn. We have reviewed the South Windsor Zoning regulation no. 4.1.9, the regulation which addresses the keeping of horses and ponies, and on examination of these it appears that we meet all requirements of these regulations with the possible exception of one measurement listed in paragraph d. of the regulations. I am referring to requirement that "The accessory buildings...shall be located at a minimum distance of.—forty feet from any side or rear property line...". There is on this property an existing barn which has been used in the past for the housing of horses. The wall of the barn closest to a property line does not meet the forty foot criteria. I am nevertheless asking for permission to use the existing structure because a. the part of the barn where the horses would be kept, the stalls, are on the side of the barn away from the property line and well in excess of forty feet from the property line. The access doors to these stalls are also more than forty feet from the property line. The part of the barn which falls within the forty foot area was used in the past to house a farm tractor, and as we have no plans to own a farm tractor, that part of the barn will be used for storage. b. It is an existing structure which has been used as a horse barn in the past. I would like to point out that our neighbors to the south now keep pot bellied pigs and other farm animals and the neighbors next to them keep llamas, thus we see the keeping of a maximum of two horses as consistent with the nature of the immediate neighborhood. Specifically with regard to paragraph "g", we shall not allow manure to accumulate and fly control measures will be taken. We intend to have the manure removed from the property on a regular basis. We hereby commit ourselves to complying with all regulations outlined ill 4.1.9. We have a profound interest in maintaining the character of the neighborhood and in retaining cordial relations with our neighbors and the town.
