Request for approval of a two-year temporary and conditional permit for a low profile financial services office at 819 Main Street, A-40 zone. 2. This property has a variance that was granted in 1974 to sell note paper, cards, books, and stationery and miscellaneous items, both retail and by mail. The applicant requested an interpretation from the Zoning Board of Appeals to determine whether the existing variance could apply to the proposed use. The ZBA elected not to reinterpret the variance to determine whether the proposed use would be included in the "miscellaneous items" category. This site was also the location of a grocery store in the past. There have been temporary and conditional permits for a variety of uses such as retail, office, and training office for nurses aides, sale of christening gowns previously granted by the ZBA and then by the PZC. 3. The applicant's letter indicates that the facility would not receive "drop-in" traffic; rather it would be used as a sales office and individuals would leave to make service calls. He anticipates that four cars would be there and has provided a picture showing area for four off-street p rking spaces (in front of the existing building). nl 4. The wording of the T & C permit regulation is that, "Temporary and conditional permits may be granted by the Commission for a use which is not specified elsewhere in these regulations for a period not to exceed two years. Such approval may be given after a Public Hearing if, in the judgment of the Commission, the public convenience and welfare will be substantially served, and the appropriate use of neighboring property will not be substantially or permanently injured, and traffic and other hazards will not result from such use." 4. If this application is approved, the planning department has no modifications to request. There are no engineering comments on the plan. Public Hearing, Tuesday, July 13, 1999 South Windsor Planning and Zoning Commission Sue Larsen, Chairperson TESTIMONY AGAINST APPLICATIO 99-42P J.E. Shepard Co Two-year - Temporary and Conditional Permit Office, `low profile financial services" at 819 & 821 Main Street, South Windsor A-40 Zone RESIDENTIAL Assessor's Map #45 Tax Parcel #57 Lot #54 pursuant to Town of South Windsor Zoning Regulations Revised through January 21, 1999 §3.17 Temporary and Conditional Permits My name is Charles S. Rotenberg. I reside at 809 Main Street, South Windsor. I am the owner of the property immediately adjacent to the south of the subject property. As my property is the only residential property immediately adjacent to the subject property, I and my 17-year old son are the people most immediately affected by the proposed use. For the record, I lost my wife, Sandra Lee Barry Rotenberg, four months ago today, after a five year battle with cancer. am a professionally certified planner entitled to use the designation "A.I.C.P." (American Institute of Certified Planners) after my name. I hold a Master of City Planning (M.C.P.) degree from Yale University (1967). Among other matters, during my thirty years of professional experience in this field, I have held lead responsibilities for monitoring construction activity and housing production and administration of two historic districts, as well as involvement in zoning ordinance development and administration. I served the State of Connecticut for twenty years. As the agency name and functions changed from the Department of Community Affairs (DCA), to the Department of Housing (DOH), to the Department of Economic and Community Development, my role and responsibilities changed. For example, with the cooperation of the U.S. Bureau of the Census, I initiated the use of housing units authorized by building permits as an economic indicator at the state level. I chaired the Tri-State Regional Planning Commission's Technical Advisory Committee of Housing and Community Development and often carried the portfolio of the late Governor Ella Grasso. I also regularly provided expert counsel to the Legislative Task on Building Accessibility of the General Assembly. For the reasons stated below, I am opposed to the granting of a Two-year - Temporary and Conditional Permit at the subject location. 1. Pursuant to the subject Zoning Regulations, there is no basis to claim that the public convenience would be substantially served. The proposed use of the substandard lot 0.42 acres, or approximately 18,300 square feet, would be in addition to two existing Sue Larsen, Chairperson South Windsor Planning and Zoning Commission TESTIMONY AGAINST APPLICATION 99-42P: J.E. Shepard Co dwelling units. The applicant does not claim that the public convenience would be substantially served. To the contrary, the applicant does claim that, "Because of this location there will be very little prospect of "drop-in" traffic and rather will be a location from which a salesman will leave to make service calls." However, typically, there would most likely to be "drop-in" traffic especially during tax season. Such a facility would be better located in a shopping mall. 2. The appropriate use of the neighboring property would be substantially and permanently injured as long as the proposed use were to continue. The applicant states "I can foresee four cars being parked in front." It appears, that four off-street parking spaces could be made in front of 819 Main Street. Most likely, on-street parking spaces would be likely to be needed front of the adjoining residence at 821 Main Street, in front of our house, at 809 Main Street, and in front of the Bissell Station Post Office, at 831 Main Street, competing for space. 3. Traffic and other hazards would most certainly result from such use as described above. 4. It is true that the applicant has had a number of different uses in the building. There has been at least a question of authorization. The zone does not allow such uses by right, but such uses have been tolerated on a temporary and conditional basis. Some uses have contributed to the neighborhood, such as Winston Abbott's Inspiration House publishing house, Sue Shepard's Giving Tree gift shop, and Designs by Annie Green hand made clothing. However, at least one use - a computer services bureau - was a detriment to the residential neighborhood. Multiple computer monitors glared through the showcase window all night. Clearly, the computer services bureau, a concern for the neighbors, detracted from both the residential quality of the neighborhood and the historic character of the National Register Historic District. 5. The property should be required to conform to the provisions of §4.8 through §4.85, inclusive, of the Town of South Windsor Zoning Regulations, pertaining to Home Occupation, in which the occupation or business activity is clearly subordinate to the residential use of the dwelling units. Not more than one person other than residents residing on the premises should be employed on the premises. Sincerely yours, Charles S. Rotenberg, AICP 809 Main Street P.O.
