Please cease all use of the gravel roadway immediately. If use of the gravel road continues, the Inland Wetlands Agency/Conservation Commission and Planning and Zoning Commission will institute violation procedures. Thank you for your immediate attention to this issue. Sincerely, Marcia A.Banach,AICP Director of Planning Elizabeth A.Warren, Chair Inland Wetlands Agency/Conservation Commission MB/sf East Hartford Sand & Gravel PH 12/14/99 i 1. Request to continue excavation of sand and gravel in the remaining phases at property located behind K-F Brick. The site has frontage on Strong Road and is about 63 acres; however, sand and gravel excavation is currently occurring on about 9 acres on the western part of the site. Approval to excavate in all phases was previously granted by this Commission in 1987 and 1992; however, the permit expired in November 1994. The previous permits included seven phases of gravel excavation; the applicant indicated in the past that he would excavate about 20,000 cubic yards of material per year, and anticipated about a 10-year timeframe for excavation of phases 4-7. (It has been about 4 Y2 years since applicant began excavating Phase 4.) 2. Staff are concerned that the nature of the operation appears to be changing since the previous permits were issued. Various building materials are stockpiled on site, including various types of stone and other earth materials; and there appears to be a brick-crushing operation occurring, with piles of uncrushed and crushed bric rs. This area is shown on the current plans. There o indication in any of the past permit applications that materials not generated from the sand and gravel excavation would be marketed; and 1986 aerial photos don't show any such stockpiles. Alse,-fdon't--Temli-see n"n,- operation_of-this nature during site visits--for the--149-2-perm it renewal. This operation appears to go beyond the excavations permitted under the Sand and Gravel removal section of the zoning regulations. The Commission may want the applicant to apply for a Special Exception approval for storage and sales of building materials. 3. Access to the site will continue to be from Route 51, via Brickyard Road, as it has been in the past. 4. The owner has been ing gravel road for purposes of accessing the business g g p g from his home on ong Road. A letter was recently issued (11/24/99) to Mr. Sylvestri from th WA/CC and Planning Department indicating that the roadway (which was constructed without any approvals or permits) must not be utilized. Zoning does not allow access from a residential area into a commercial area. ere has also been some report of commercial vehicles being washed at the esidential site. All commercial activity must take place in the approved areas. , 5. There are regulated wetlands on thA . IWA/CC approval expired in October 1998. The application has been at hearing several nights and is still pending in L front of that Commission and will be heard again tomorrow night. Some of the concerns raised include: ♦ Unapproved wetland disturbances on the site and encroachment into Phase 5 without any approvals ♦ stabilization of the excavated areas prior to permanent restoration; reclamation of phases 1-3 has not been completed per plan, and ♦ submission of a long-term restoration plan that would include planting to increase the wildlife habitat value The Army Corp and DEP are also reviewing the wetlands disturbances on the site. Approvals will be required from these agencies. The IWA/CC will be hearing this application again on 1/2000. 6. We are currently holding two passbook bonds on this project, for a total amount of$25,000, to ensure erosion and sediment control as well as stabilization after each phase is excavated. 7. As excavation of the site progresses eastward, clearing of the trees on the site has been proceeding into phase 5. 8. Proposed excavation will result in maximum cuts of 12-14 feet, slopes at 1:3, and some cuts up to 4-5 feet into the groundwater table. 9. Section 14 of the zoning regulations provides guidelines for the Commission for the approval of sand and gravel operations, including the effect of such removal on surrounding property and the future usefulness of the premises when the operation is completed. Also, according to the provisions of Section 14, such permits shall be issued for a period not exceeding two years. The regulations also allow PZC to grant unspecified extensions of time or modifications to the scope of work originally approved. We would like the applicant's request for permit renewals to be much timelier in the future if this permit is renewed. If approved, the Planning Department has no other requested approval modifications. 12/22/99 15:03 FAX 860 808 0834 ROGIN_NASSAU IM002 RECEIVED RoGnv, NAsSAU, CApLAN, LASSMAN &IftTL&, LLC 1999 ATTORNEYS AT LAIN DEC 22 CITYPLACE I, 22NO FLOOR ROBERT L.HIRTLE CLARA ANN PORGELLO I p 185 ASYLUM STREET At1ii' MARx J.
