r Wallace Zone Change PH 12-14-99
s
Request for zone change from Rural Residential to Restricted Office for two
lots located at 1496 and 1504 Sullivan Avenue. The total area for which a zone
change is requested is about one acre. The minimum lot area for Restricted
' j Office is 2 acres; however, the Commission has granted zone changes on
' existing lots that are undersized.
2. Permitted uses in RO zone include business, professional, financial, corporate
offices, day care and senior residence development. Permitted uses in RR zone
include agriculture, residential, recreation, religious, education, hospitals &
convalescent homes, municipal, golf courses, housing for the elderly, and day
care.
3. Section 16 includes criteria for zone change:
♦ How the zone change compares with the Comprehensive Plan of
!fir Development; V-5-
r t ♦ How the land shall be secured from flooding and other dangers;
g g
♦ How the land upstream and downstream in the same watershed shall be
secured from flooding and other dangers;
♦ How the land shall be served by water, sewerage, transportation, and other
public utilities; and
♦ How the proposed zone change will affect any wetlands in the area.
4. The Town Plan depicts this area are residential. As the Commission is aware, a
major update of the Town Plan will be initiated soon. If this zone change is
approved, the Commission must state on the record that they have found the
ate" zone change to be consistent with the plan of development.
5. A zone change is the appropriate time to discuss traffic impacts. Sullivan
Avenue is a high-volume artery and is expected to handle large traffic
volumes. The major difficulty and safety hazard with a four-lane roadway that
its has access to adjoining property is the left turn into and out of a site. Left
turns can result in both traffic slowdown and accidents. Left turns into a site
iy , can often be managed with an exclusive left-turn lane; but traffic exiting a site
N, via a left-turn must safely negotiate 3 or 4 lanes of traffic. Recognizing these
traffic factors, the applicants have initiated a dialogue with Town staff and the
Town Manager regarding the possibility of a shared driveway for the two sites
for the short term and an access drive behind Town Hall onto Route 74 as a
long-term solution. Both the shared driveway and the access drive behind the
lots are typical access management techniques. If this zone change is granted,
access management techniques will need to be reviewed at the site plan stage.
6. These two lots also have the potential to utilize shared parking facilities,
which should be encouraged to optimize the layout of the small sites.
Public sewer is available to both sites; the doctor's office is connected. Pffbti
. The vacant
property at 1496 Sullivan Ave. is served by a well.
8. There are no regulated wetlands on either lot.
9. If the zone change is granted, buffers will be required when the sites are
developed or a new use is established.
If this application is approved, the Planning Dept. has no requested modifications.

MEMORANDUM
TO: Michele Lipe
Assistant Director of Planning
FROM: Barry D. Guliano
Town Attorney
DATE: July 18, 2001
RE: Mutual Driveway and Parking Easement Agreement Regarding
Manchester Memorial Hospital and Wallace-Tustin Realty
Properties
I have reviewed the above-referenced Mutual Driveway and Parking Easement
Agreement and it is acceptable with the following conditions:
1. The deed is from an entity entitled "1496 Sullivan Ave., LLC to
Manchester Memorial Hospital." The application lists the owner of the
property as Wallace-Tustin Realty, and we have no specific evidence that
title was ever transferred from Wallace-Tustin to the LLC. We should
require evidence of a recorded Warranty Deed or Quit Claim Deed from
the owner of the property as listed in the application to the entity known
as 1496 Sullivan Ave., LLC before there is compliance with this
condition. (Since dictating this memo, I have received copies of the
relevant deeds, copies of which are attached hereto.)
2. There is no date on the Agreement, but both signatures have been
acknowledged with dated acknowledgements. While I would usually
prefer to have a date on the Agreement, the fact that there are dated
acknowledgements is sufficient.
3. I was not provided with the map which was referenced in the Easement
Agreement, but I have been advised that the following items appear:
a. An area designated as "COMMON DRIVEWAY" is sufficiently noted
on the map in the appropriate area.
s
Michele Lipe
July 18, 2001
Page 2
b. An area designated as "COMMON PARKING AREA" is sufficiently
noted on the map in the appropriate area.
C. The map includes a date of revision as follows: "5-25-01 Driveway
Agreement."
As long as these items appear on the map, the Agreement is acceptable
in this regard.
4. At Page 3 of the Agreement, the names of the four signing witnesses
should be typed or printed beneath the line of each signature. I have
been advised by Atty. Bill Breslau that this has been done on the
original, but this should be verified.
5. At Page 4, the second acknowledgement was taken by an attorney whose
name has not been typed or printed below the signature line. This
should be done prior to the recording of the Agreement. I have advised
Atty. Breslau of this and he indicated that he would do so, but this also
should be verified.
Other than the items listed above, which I have been advised have been taken
care of, the Agreement is acceptable and sufficient. If you have any further
questions, please do not hesitate to contact me.
