Mr. Frank Castro, Chairman - Planning & Zoning Commission
South Windsor Town Hall
South Windsor , Connecticut 06074
Dear Mr. Castro:
Although we are unable to attend the September 22 commission meeting ,
we would like to comment on the proposal by Newkirk Associates of
Virginia to change the zoning regulations in the Buckland Road Gateway
Development Zone. Please read our comments into the public record of
this meeting.
We are very concerned with the proposal to reduce lot area and width
and its impact on future development in the Gateway Zone. Allowing
these reductions would complicate access management , increase curb cuts,
and make coordination of the development process more difficult. In
addition , the increase in curb cuts into a four lane road , where traffic
generally exceeds the 40 mile per hour limit, would make driving more
hazardous.
It is also conceivable that these reductions would result in a highly
fragmented , unsightly mix of structures in the Gateway Zone. Route 83
in Vernon comes to mind.
It is our belief that the commission acted with great wisdom several
years ago when it created the current zoning regulations. Its concern
with reaping the benefits of substantial development was appropriate
and in keeping with the character of South Windsor.
Thank you.
Sincerely,
Dorinne and Edward Taback

Newkirk Zoning Amendment PH 9-22-98 A3

If adopted, the amendments would be applicable to any development proposed
within the Gateway zone.
2. The impacts of the various amendments would be as follows.
Outlots amendment (sec. 5.8.6.a.): The original application requested a
reduction in minimum lot size from 3 acres to one acre; and a reduction in
minimum frontage from 200 feet to 100 feet. Planning Department staff had
a major concern with that proposal, for two reasons: (1) the larger lot size
was deliberately adopted by the Commission to attract larger development
projects; and (2) the decrease in required frontage is in direct contradiction
to access management objectives of minimizing the number of small lots and
individual driveways. In response to that concern, the applicant revised the
proposal to eliminate the requested lot size and frontage reductions; and
substituted an outlots amendment.

_(;f,,jPAUnder the current regulations, there is no provision for
independently-owned outlots; any stand-alone restaurants or other buildings
would need to be part of the larger development unless they subdivide out
three-acre lots for these stand-alone buildings. The proposed outlots
amendment would allow independently-owned outlots that, with the
proposed restrictions, would still be designed as an integral part of a larger
shopping center. The no-frontage and non-access restrictions are
recommended in order to eliminate the possibility of numerous small lots
with their own driveways directly onto Buckland Road, thereby eliminating
the concern that such outlots would interfere with the importance of
managing access onto Buckland Road. This amendment as written would
provide applicants with the flexibility to accomplish their objectives while
being sensitive to our access management objectives for Buckland Road.

Thus, a b , ' ding could be shorterand taller iif it

• Garden shops (sec. 5.8.5.c.3): The existing regulation requires that all
business must be conducted within completely enclosed buildings. There are
existing retail operations that include garden centers with walls but no roof
(for example, Home Depot at Buckland Hills). From the outside, it is
difficult to tell that the building is not completely enclosed. The proposed
amendment would allow such garden shop enclosures with walls but no
roof.
• Signage (sec. 5.8.5.c.7): The current regulation allows one building sign per
building; or one building sign for each tenant in a multiple-tenant building,_
both not to exceed 1 square foot per lineal foot of building frontage.dart
Building frontage is the wall of the building that faces the street. The
proposed amendment would modify this allowance by allowing one square
foot of building signage per lineal foot of the longest building wall, whether
it faces the street or not. Also, there is no provision for additional building
signage for buildings with frontage on more than one street or that have
visibility from more than one side. The proposed amendment would
maintain the same total amount of signage but would allow the applicant to
allocate signage among various sides of a building or among various tenants
as the applicant prefers.

• General Plan of Development (sec. 8.1.2.): The approval process for the
Buckland Gateway Zone is the standard site plan approval, which requires
that all engineering and design work be completed for a site plan application.
For smaller, less complex sites, this process is expeditious and serves
applicants well. Developers of larger, more complex projects, however, have
expressed a desire for a two-step approval process that would let the
applicant receive General Plan approval for a site before completing final
site design and engineering. This is the process that we currently use in the
Designed Commercial zone as well as in Designed Residence and Multi-
family zones. Under the two-step process, plans are prepared with sufficient
detail for the Commission to determine whether the proposed development
is desirable. If the Commission approves the General Plan, then the applicant
has project approval and can proceed with the site plan application with
peace of mind that the site plan will be approved if it complies with the
approved General Plan. If the General Plan is denied, then the applicant
hasn't spent an exorbitant amount of money on a failed plan. Applicants
would be able to choose whether to use the one-step site plan or the two-step
general plan/site plan process for approval for any project.
The two-step general plan/site plan process is a process that has worked well
in South Windsor for many years. Its inclusion into the Site Plan section of
the zoning regulations as an option would allow for its use by any applicant
who so desires. This amendment would serve both applicants and the
Commission well by providing flexibility to applicants in the choice of
approval process. Applicants for projects in other business zones such as the
1-291 zone would also be able to take advantage of the two-step process. For
r '
these reasons, the Planning Dept. would very much like to see an
amendment for the optional two-step process added to the Site Plan section
of our regulations.
3. Planning Department technical concerns have been addressed by the applicant
for the proposed amendments. Therefore, if the Commission chooses to adopt
these amendments, the Planning Dept. has no requested modifications.
