While creative design approaches are encouraged, quality in levels of detail, material selections, and functional adequacy will be expected. Following are general guidelines: 1. Architectural and site design criteria and guidelines will be as described in Section IX - Architectural and Design Review. 2. Relationships to land uses in abutting zones and adjacent developments within the zone (compatibility) are important considerations that will be critically reviewed by the Commission. Concerns in this regard will include view sheds, buffers (vegetative and architectural), building scale/massing/configuration/height, light spill, emissions (noise), use intensity/frequency, light/air obstruction, and signage. 3. Building height shall be compatible with highway elevation, unless applicant demonstrates to the Commission that building height is irrelevant in a specific area. Taller buildings are recommended where I-291 is above grade, so that the traveling public is not looking down upon a building's roof. When this is unavoidable, the roof must be designed to be attractive from the highway; flat roofs are not acceptable when below the I-291 grade and visible from the highway at any time of year. Taller buildings are also expected to provide increased building setback from the street upon which they front. l-fia-instanee shall Wit i g ens Maximum buildin height Tht is 5 stories or 60 feet. A waiver to the maximum building heig t may be granted if the Commission determines that such a waiver promotes the Purpose and General Concepts of the 1 291 'Zone (Sections 5.9 ( and 5 9 2)and further provided that the following criteria are met a. The waiver is necessary for a development of substantial size (site at least 100 acres - and building gmGs floor area at least 1,000 0. 00 square feet) b. The oronosal is fora unique use that is of regional sianifcance and would not be duplicated within the Town 4. The Corridor Development zone includes extensive areas of regulated wetlands and utility easements/rights-of-way. These areas will be incorporated into site planning to provide(as appropriate)multi-use trails that traverse the corridor. 5. No outdoor storage is allowed. All business, servicing, or processing (except for off- street parking/loading) shall be conducted within completely enclosed buildings. 6. Outdoor storage and display of products for sale are prohibited, with the exception of garden/nursery centers accessory to a permitted use. 7. Loading docks shall generally not be visible from Route 30 or I-291. All loading docks shall be designed as an integral part of the building and not detract from the appearance of the building and site. Although it would have been informative to receive the Ply Z Commission's determination on the proposed amendment, It is only, as you know, a waiver option that Is being sought, not an as-of-right change. We have also, in the development of the project design, Identified other zoning Issues which we may seek amending, Hence,we have decided to make a more complete design presentation to the P&Z Commission addressing all potential zoning Issues. When this work comas near completion we will make 8 new application. Thank you for your cooperation and assistance. Please call if you have any questions. Respectfully, .- - Stephen E. WOLF ATTORNEY AT LAW 4 SHADBUSH LANE SOUTH WINDSOR,CT 06074 (860)644.3457 October 14, 1998 Town Counsel Town Hall South Windsor, CT 06074 Planning& Zoning Commission Town Hall South Windsor, CT 06074 Dear Ladies and Gentlemen: This evening, I was at a meeting of local businessmen, and we were given a presentation by one of the people who are trying to develop a proposed indoor winter sports facility in South Windsor. He described the project in glowing terms, and told the assemblage how kids would be able to ski for $1.60 per hour, and that the International Olympic Committee was going to approve the facility. He talked about the involvement of international sports figures, though I still don't know what they will be doing there, and he mentioned that there would be space for 3000 cars. That is the point at which I asked a question. I asked him if the planners of the project had made any provisions for those three thousand cars to get into and out of the facility. He said, that they didn't really expect three thousand cars at any one time. He thought there would be two hundred fifty for a program now, which would leave when they were finished. Then, three hundred would come after them for another program in a few hours, sometimes less and sometimes a little more, but not likely three thousand at any one time. Unfortunately, that answer just begs another question, or series of questions. First, what kind of developers spend millions of dollars, and scar the landscape with a parking garage for cars that they don't expect to come? If they are that foolish with their resources, what are they going to do with the town's resources: our rural setting, the quietude for which most of us came here, and the general lack of urban problems, including crime and traffic? Second, assuming that they are actually building a 3000 car garage because the facility will attract 3000 carloads of people at various times, what will all of that traffic, with no additional infrastructure to handle it, do to our town. How can the route 30 corridor handle that additional volume. I know, as a resident who lives just off of route 30, that traffic already makes it difficult to get out of my subdivision at times. What will happen when the additional traffic arrives. Third, why would a developer insult the intelligence of his audience, risking their ill will, by telling them something as implausible as that he was going to spend millions to build something that no one would use. Doesn't that tactic invite the conclusion that we are not hearing the whole story? The conclusions that I reach are that there is nothing in this project for the Town of South Windsor. Further, I conclude that this project, like several others that have either been built or proposed over the past decade serve no purpose but to enrich a few at the expense of the residential members of the community. Specifically, I assume that the Town Counsel plans to give the developers of the project a tax break. That strategy has brought the area towns a shopping mall, several strip malls, warehouses, industrial parks, and vacant buildings where local businesses used to be. We now buy from big businesses that distribute our dollars not in South Windsor, but to their shareholders and to mutual fund owners. This strategy of enticing big business into town by giving away tax dollars will not boost our local economy. It will merely drive small business into penury. We will get only the empty promise of lower taxes; a promise that has been made for years, but has yet to be kept. Further, it never will be kept. You can ask the residents of Manchester to whom the same promise was made. Their taxes still go up each year, but in addition, the quality of life in their town continues to decline. As to the roads, there is a road "improvement" project of some kind going on at all times somewhere in South Windsor. So obviously, our local government is not averse to turning what once was pasture into pavement. It is only a matter of time until the influx of traffic caused by this new project makes it necessary to widen route 30 to a four lane, divided highway. Sooner or later, the traffic will cause accidents, injuries, or even deaths, and there will then be no choice. Of course, we will have to pay for the project. So much for tax savings. Rather than indulging myself with a litany of objections, let me just say that during the entire presentation, I heard plenty of statements about how much enjoyment the project would bring to the paying customers, but I never heard a word about what the project would do for the Town of South Windsor. I assume that, since they are trying to sell us on the project, if there were some benefit, it would have been stated at the beginning of the presentation, but no such thing occurred. I heard touting of the people who were behind the project, as if somehow, the fact that an NHL star, a professional skier or the IOC makes a buck off of us is some kind of badge of honor. I heard promises about use of a pool and cheap skiing, but I didn't see anything in writing, or hear any promises as to for how long those things would last. Nothing was said about any advantage that would inure to the benefit of the residents of this town that would compensate for the decline in the quality of our lives. Worst of all, I came away with the impression that we were being taken advantage of not by some well meaning, misguided souls trying to do the right thing, but by people who wish to make a profit above all, and find the quality of living in our little town to be expendable in their pursuit of lucre. Stop pursuing tax dollars at the expense of the life style that we all came here to enjoy. It is a policy that has failed, and has been almost solely responsible for changing a rural community into a suburban one. The next step is urban, and most of us came here to avoid that. A sage government would abandon a failed policy, not keep trying it one more time. Please stop now rather than when it is too late for all of us. Sincerely, Michael E.
