RE: Foran Subdivision
We have reviewed the drawings dated 7/18/98 received 9/2/98 for the proposed
Foran Subdivision and have the following comments:
Topographic Plan
1. Proposed driveway culvert: size and type pipe, inverts are required.
Also, flared ends and rip rap pads should be at both ends.
2. Inverts required for footing drain outlet pipe and sanitary sewer lateral.
3. Driveway should be graded to shed the stormwater off to the side
rather than down the driveway.
4. A pull off will be required at the street line as driveway is at 10% or
more.
5. It is my understanding that the sanitary lateral is a force main. If so it
should be so labeled. If not cleanouts are required at a spacing of not
more than 100 feet.
6. Details of trenches for footing drain and sanitary lateral, flared ends, rip
rap pads, are required.
7. The driveway apron within the town ROW shall be bituminous concrete.
8. Disposition of roof leaders not addressed.
9. WPCA approval is required.

FORAN INTERIOR LOT --PH 10/27/98
1. Request for approval of a Special Exception for an interior lot and subdivision for property
located on the westerly side of Avery Street, northerly of Talcott Ridge Road, RR zone. The
proposed interior lot is approx. 2.5 ac., leaving a 2.6 acre conforming lot with an existing
house.
2. The requirement for an interior lot in this zone is 80,000 sf minimum lot size and 262.5 feet
minimum lot width. The proposed interior lot is in excess of 600 feet in width. It appears
that all zoningrequirements have been m q et.
3. Access to the interior lot is proposed off of Talcott Ridge Road(the new road in Chase
Orchards Subdivision). The applicant has secured an easement to access the new lot. He is
proposing to cross property which will be deeded to the Chase Orchards homeowners
association. The proposed driveway will have a turn-around driveway as required.
4. The new lot will be serviced by public sewer and public water. WPCA approval is required.
Fred Shaw, Sup't of WPCA has stated that the connection will require payment of Vernon
sewer assessment and the plans should be reviewed the Town of Vernon. The gravity sewer
will require clean outs at 100 foot intervals. If a pump system is utilized, provisions should
be made for auxiliary power connections.
5. There are no regulated wetlands on the new lot and they are not proposing to disturb more
than 20,000 sf. There is no 100-year floodplain.
6. The criteria for approval of interior lots include:
a. the subject area's boundary configurations, topography, soils or other natural resource
characteristics;
b. proximity to neighboring properties and dwelling units;
c. restriction of existing views;
d. proposed buffering/screening;
e. potential drainage, traffic & environmental impacts
f. driveway locations, slopes & sight lines
g. utility service capabilities
h. property value impacts; and
i. future land use alternatives.
6. The existing property is a wooded lot. There is no proposed tree line shown on the new lot.
We would recommend that as many trees as possible be saved in the field with the
construction of the new house.
If this application is approved, the Planning Dept. has no additional modifications to request:

Mr. Matthew Galligan, Town ManagerTown of South Windsor1540 Sullivan Ave.South Windsor, CT 06074Dear Mr. Galligan:
I am in receipt of your letter dated 6-22-99 concerning the street lighting at Chase Orchards. I do
not agree with your position regarding this matter, however, I do not wish to engage in a battle
with CITY HALL. I would however like to offer your these thoughts.
You have stated you provide snow plowing and trash removal as a courtesy. As part of the taxes
residents pay, those taxes include snow removal and trash removal and all other town provided
services, including but not limited to, education, police and fire services. I offer the following
scenario for your consideration: What would happen if the town decided not to provide the
courtesy of snow removal and because of its refusal a fire truck or ambulance were unable to
reach a home on which the town has issued a certificate of occupancy and which the developer
has provided to the town all bonds required for the subdivision and as a result of the emergency
vehicle not being able to reach that residence a tragedy occurred. I would venture to say the town
would have very little justification for such a position and if I were the town attorney, I would not
want to defend such a position in court. I am not trying to be combative in this matter, however I
feel strongly as a developer and resident of South Windsor that your position is wrong but not
inconsistent with historic attitudes which somehow applies that developers should be responsible
for everything and anything.
In closing please be aware, I have been building homes for 28 years throughout the state. I have
completed many, many subdivisions and this is the first time any-town has refused to provide
street lighting or other customary services for homeowners from whom they are collecting full
property taxes in a new but not acceptrd subdivision. Please do not misunderstand my position in
the matter. I am not asking you to maintain the street lighting or any other improvement of the
subdivision until such time as it has been accepted by the town, I do believe the town is
responsible to provide customary services including street lighting to its residents. As stated
above, I differ with your position, as part of our subdivision approval we were required to install
the street lighting. We feel it is not our responsibility to illuminate that lighting and to do so
would be a courtesy we do not wish to extend. Accordingly we have instructed Northeast Utilities
to shut off the street lighting until such time as the town has accepted the road.
Very truly yours,
Jo . D n,Pr - --
