WHIRLYBALL ZONING AMENDMENT- 12/8/98 1. The applicant is requesting a zoning amendment to Section 6.1.2 of the Industrial zoning regulations to allow by special exception indoor recreational activities for organized groups. This amendment would require that these activities will be targeted toward adults and that they will be supervised by a referee, and may include electric rides. This regulation excludes those uses in Section 5.2.2.2, which is a reference to the permitted uses allowed (or excluded uses) in the General Commercial zone, such as theaters and bowling alleys. Those types of uses could not be proposed in an Industrial zone under this regulation. 2. The general special exception criteria in the industrial zone which would be considered when any application is proposed includes: • the goals and the objectives of the Town Plan of Development are met; • adverse traffic impacts are not created; • negative impacts on property values are not created; • the land is physically suited for the proposed use; • adverse environmental impacts are not created; • there is a balance between neighborhood acceptance and community needs; • present and proposed utilities, streets drainage systems, and other improvements have adequate capacity to accommodate the proposed use; • historic factors are adequately protected; • the overall appearance of the propose development is compatible with surrounding development and the Commission's goal for the neighborhood/corridor. 3. This request is being made to provide for a permanent solution to the two temporary and conditional permits which have been granted for the operation of "Whirlyball" a bumper car sports arena in an industrial building at 1265 John Fitch Boulevard. ZBA first granted approval to this request in October 1991 and again in March 1994, and PZC in granted approval in April 1996 and April 1998. Their current permit expires in April of 1999. 4. If the Commission adopts this regulations staff would recommend the following changes: • the recreational uses proposed should not be restricted to organized groups (the majority being adult business groups); • the proposed uses should not be required to be supervised by a referee; (this would allow a gym facility for example to be proposed) Pz IB pf7&a)- - L s • maximum hours of the individual applications for proposed uses should be determined based on the type of use proposed, location etc., rather than a blanket prohibition on operating hours within the amendment A#r (i/f.7 10/29/98 PROPOSED ZONING AMU= INDUSTR.ZAL ZONE Add: Special Exception Uses: ✓ 6Cd/ " Section 6.1.3.9 Indoor recreational activities -amine P s.
