Dear Mr. Brassaw:
Re: Appl #96-13P, Temporary and Conditional Permit
At the April 15, 1996 meeting of the South Windsor Planning & Zoning Commission, your request
for a two year temporary and conditional permit to allow an indoor recreational center on property
located at 1265 John Fitch Boulevard, I zone has been granted subject to the following terms and
conditions:
1. Permit is for a two (2) year maximum period.
2. Approval is for a "Whirl Ball"pp y sports arena, which will be supervised by a referee for
competition, with rules and regulations to be followed for such sport.
3. No other arcade games will be allowed.
4. Hours of operation to be permitted will be from 10:00 a.m. to 12:00 p.m.
Any new building, or alternations/additions to existing buildings, require a building permit prior to
start of construction.
This action is effective April 9, 1996. The permit will expire in two (2) years, April 9, 1998 and
will have to be renewed at that time if the use is to be continued.
Very truly yours,

WHIRLYBALL ZONING AMENDMENT-2/24/98
1. The applicant is requesting a zoning amendment to Section 6.1.2 of the
Industrial zoning regulations to allow a "referee controlled game in electric
Bumper Car's at an indoors adult amusement facility".
2. This requests is being made to provide for a permanent solution to the two
temporary and conditional permits which have been granted for the operation
of"Whirlyball" a bumper car sports arena in an industrial building at 1265
John Fitch Boulevard. ZBA first granted approval to this request in October
1991 and again in March 1994. Their current permit expires in April of 1998.
3. Staff has concern with such a specific amendment to allow this recreational use
as a permitted use in the Industrial zone, coupled with no restrictive criteria.
While we are not aware of any problems or complaints regarding Whirlyball,
we would like to see more thought regarding the overall appropriateness of
industrial zones for recreational uses, and under what circumstances those uses
would be acceptable. This is best accomplished via a Special Exception
amendment, with specific criteria associated with the uses. Such criteria could
address things such as hours of operation; outdoor activities, outdoor storage,
lighting.
4. There is another possible route to follow regarding Whirlyball's approval. The
Commission-proposed Temporary and Conditional permit amendment going to
public hearing on March 10, has the following wording proposed for T & C in
industrial/commercial zones: "Allow a use not normally allowed in the subject
zone (and not allowed in another zone) as a trial use. If at the end of the permit
period the Commission determines that the trial use is an appropriate
permanent use in the subject zone, then the applicant may request a zoning
amendment to include the use in the permitted uses (either as-of-right or by
Special Exception) for the zone.
5. This applicant may be a good candidate for action under the revised Temporary
& Conditional Permits regulations when they are finalized. If the Commission
agrees this is the way to proceed, the Commission could suggest that the
applicant apply for a short extension to the existing T & C permit, and possibly
waive the fee, and then apply for a new amendment after the Commission's T
& C permit regulations are revised. The applicant needs to be aware that any
amendment has to be carefully drafted to take into account both the applicant's
interests and the Town's best interests; and that this may require professional
assistance.
