CONN. 06074 soR•co`' AREA CODE 203/644-2511 October 10, 1995 David & Anne Fournier 188 Great Hill Road East Hartford, CT 06108 Dear Mr. & Mrs. Fournier: Re: Appl #2298-95 - In-law apartment, 98 Heather Wood Drive This is to notify you that on October 5, 1995 your application to the South Windsor Zoning Board of Appeals requesting a two year temporary and conditional permit to allow an in-law apartment on property located at 98 Heather Wood Drive (RROS zone) has been granted subject to the following terms and conditions: 1. Permit is for a two (2) year maximum period. 2. When addition is no longer used as an apartment, the kitchen is to be removed and the living area must be converted into other single family living space. 3. This is a family situation and this approval does not make this property income producing. If the family situation should change, the home will have to be restored to a one-family condition. Any new building, or alternations/additions to existing buildings, require a building permit prior to start of construction. This action is effective October 5, 1995. The permit will expire in two (2) years, October 5, 1997 and will have to be renewed at that time if the use is to be continued. Very truly yours, ,ZING BOARD OF APPEALS Robert W. Warren, Chairman RWW/pmm cc: Chief Building Officials Zoning/Wetlands Enforcement Officer FOURNIER IN-LAW APARTMENTS T & C RENEWAL PH 3/10/98 1. Request for renewal of a two year Temporary & conditional permit for an in- law apartment at Heatherwood Drive, RR open space zone. The original ZBA approval was granted on October 5, 1995 and the permit expired October 5, 1997. At that time, the ZBA imposed the two standard approval conditions: • When addition is no longer used as an apartment, the kitchen is to be removed and the living area must be converted into other single family living space • This is a family situation and this approval does not make the property income producing. If the family situation should change, the home will have to be restored to a one-family condition. 2. The PZC adopted a new in-law apartment regulation on 1/28/98 including a definition of an in-law apartment as well as specific criteria for the unit. This is the first application to be submitted under that new regulation. 3. These criteria include: ♦ The in-law apartment cannot be any larger than 900 sq ft or 40% of the gfa (whichever is smaller); ♦ the entire structure must maintain the appearance of a single family dwelling; ♦ off street parking for three vehicles must be accommodated; ♦ adequate water and sewage disposal must be provided; and ♦ the owner of the dwelling units must occupy either the in-law apartment or the main dwelling unit The Commission may waive one or more of the provisions above (except the requirement that an owner live in the apartment or house) after determining: ♦ There will be minimum adverse impact on existing uses in the area; ♦ Surrounding property values will be conserved and the character of the neighborhood will not be unduly disrupted; ♦ Due consideration to preservation of historic factors has been demonstrated. 3. The existing in-law apartment is 880 sq ft; total square footage of the house is 2898 sq ft- therefore meets the first requirement. There is a parking area that can accommodate three cars and the property has existing city water and town sewer servicing the house. 4. The applicant lives in the house as required. 5. The Commission may want to discuss how they feel this existing apartment meets the intent of remaining a single-family house in appearance. A waiver may be necessary to this specific provision. (Distribute picture of the in-law apartment). If this application is approved, the Commission may grant approval for up to five years. The applicant will be asked via letter to reaffirm ownership of the property every two years. At the end of the permit period, if the family situation has not changed, the applicant may request renewal by staff. r P ;:i 'S ,'t"i e'rr.Y,$ri3,' ni` ',5`>r7t1 rri•.t FP.r ,` 3 g r i r:' r [ t 1:, .,r , r F ': ',,r.-x-„J]dv.,u.t:h,irJ.,,-:x+a, ,.1 n• '( ,.., C, u J :1 !I'. }I i r .r..t.:,(_„ r,r E u t Y :,.., y .P.rw(",c ..rrvr j,.F,S<f _5,t•rr r,a,:,.- ir. .l)rr...!r:7Fa,,jr,_ ,d,.ln._ f.. ,:,r: ,_:n-l::r-f.'`' }ur" f - ;... it :.L r...}RR;:' v ',Ix,: 5X.N..hErl. :. •, t-r-e:c.,r d.,.
