I would like to raise my concerns,
In regards to the above application by,Mr, Quirici,
For the past two years the drainage 16"the back yard of
our property at 87 Dawn Drive has increasingly been getting unacceptable.
The high flower beds created, and the*6dra soil broat in
has heavily contributed to this process.
JMJ built the area and graded.the lotito,drains toward the back wood
In a SE to NW direction, that Is no-:fenger happening in our back yard.
I have no problem with the applicatioh before you , however it must comply
with proper grading for my lot to drain. and It also must correct the
problem already created, by blocking the free flow of the runoff.
If the corrections are done, and preventt re steps are taken,
we have no objections to this application.
We have seen the beauty that Mr Qpirlci can create, and we trust
He will do the wright thing.
Sincerely
Vincenzaa Breton

QUIRICI MHO- PUBLIC HEARING 6/23/98
1. This is an application for a 5 year major home occupation permit to operate a
perennial design and garden installation at 95 Dawn Drive, A-20 zone. The
applicant is proposing to run the business from within the existing house and has
indicated that he will have a small quantity of storage of landscaping materials
associated with garden installations. Because this material/tools will not be
within the house, this type of home occupation falls into the category of a major
home occupation.
2. The reasons for requiring PZC approval are to ensure that:
♦ the home occupation is clearly secondary to the use of the building for
dwelling purposes
♦ the home occupation is compatible with other permitted residential uses in the
residential district
♦ the residential character of the dwelling and the neighborhood are preserved,
and;
♦ all residents have freedom from excessive noise, excessive traffic,nuisances,
fire hazards offensive odors and pollutants, and other possible effects of
commercial uses being conducted in residential areas.
3. Performance criteria that must be met include:
♦ Maximum of 25% of the floor area can be used for the occupation;
♦ occupation cannot be visible from outside the dwelling unit;
♦ dwelling must contain the character of a single family dwelling;
♦ no entrance or exit may be added solely for the occupation;
♦ no more than one non-resident employee allowed;
♦ the occupation can not create a volume of passenger or commercial traffic that
is inconsistent with the normal level of traffic on the street;
♦ all parking needs must be met on-site;
♦ and the Commission may require screening of additional parking from the
street and from adjacent residential properties.
4. The applicant appears to meet the physical criteria for the major home occupation.
There are no anticipated parking needs. It has been brought to our attention that
the applicant has a hoop house that may encroach onto the abutting Town open
space. Staff would like assurance that the applicant is not encroaching in any way
onto the open space. Also, if it is the applicant's intention to use the hoop house
and garden beds to raise flowers to use as part of the perennial garden business,
this is permitted with a major home occupation. We want to caution both the
applicant and the Commission regarding the potential of this type of business to
expand to a level that exceeds the intent of home occupations. There is no outdoor
storage of any type allowed for the home occupation: no piles of topsoil nor any
other materials; and no outdoor storage of bags of fertilizer or other materials.
5. If this application is approved, the applicant will complete a home occupation
form,which contains acknowledgment that the applicant will abide by criteria
contained in the zoning regulations. The applicant would also be required to
return to this Commission upon expiration of the 5-year permit period.
