Kamco Florist Site Plan
1. Request for site plan approval for conversion of an existing residence at 1676
Ellington Road, RC zone, to commercial use for a florist shop. The commercial
use actually commenced in about August 1996 without site plan approval; and
zoning enforcement action was initiated at that time. Approval of the site plan
would terminate the enforcement action.
2. Two variances were granted in November 1996, to allow a residence with the
commercial use; and to allow a larger sign.
3. Parking required is 7 spaces. Staff has a concern regarding the proposed parking
for this site. The existing driveway that connects with the building is about 11
feet wide, and is joined near the base with the parking area for the adjoining
site, creating one wide curb cut. If there is more than a single vehicle using this
driveway, vehicles must park behind each other. Also, there is no formal turn-
around area; this site currently appears to be dependent upon the adjoining site
for parking maneuvering. Staff have observed that customers visiting the florist
tend to park in the parking lot next door; is this arrangement formalized? If the
site next door eliminates the ability for Kamco Florist customers to use their
parking lot, customers parking in the Kamco Florist driveway would have to
back out onto Ellington Road.
Also, the plan indicates that the gravel driveway to the west is available for
customer parking; and shows a reserve area at the north end of this gravel drive.
There is no walkway between that driveway and the shop; and it seems
unrealistic that customers will park so far away from the shop, especially with
no walkway. However, it seems unreasonable to require construction of a
walkway if this parking is never used. If this plan is approved, the Commission
may want to have the plan show a future walkway in conjunction with the
reserve parking.
4. How will trash disposal be handled? There is no dumpster shown. Commercial
trash cannot be mixed with residential trash. -
5. The building is served by both a well and a septic system, exact locations not
provided. The Town Sanitarian has indicated that normally a conversion from
residential to commercial use requires the applicant to meet the Public Health
Code, which requires a separating distance between the well and septic system
of 75 feet. This is a public health and safety requirement, so that customers and
y
employees aren't drinking water that might be contaminated by leachate from a
septic system. Staff are unable to determine whether the separating distances
are met.
It is unclear where the water source is. There is a document in the Town
Sanitarian's files indicating that there is a drilled well south of the residence
that is also used by the commercial building next door. The report in the Town
Sanitarian's file also indicates that that existing drilled well doesn't meet the
Up Public Health Code separating distance from the septic system. The applicant's
11 engineer was unable to locate that well; and the water service connection to the
dwelling is located on the west wall of the dwelling. The bottom line is that,
without accurate location information for both the well and the septic system, it
is unknown whether the requirements of the Public Health Code are met, or
I
the water supply is potable. Finally, if this applicant plans to build a
I
in the back yard, it cannot be built on top of the septic system.
In the event that the existing water and/or sewer service do not meet
regulations, public water and sewer are available in Ellington Road. However,
we do note that, with the applicant already occupying the site, our usual ability
to secure compliance through building permits and certificates of occupancy are
far less effective.
6. There is not enough information on the plan regarding the future greenhouse
(such as grading) for construction. If the applicant is requesting approval for the
greenhouse at this time, the greenhouse plan will have to be completed, with
grading & drainage sealed by a professional engineer. If the greenhouse is not
being approved at this time, it should be removed from the plan; and the
applicant should be aware that a modified site plan application will need to be
approved by the Planning and Zoning Commission, and no building permit
would be issued without that approval.
7. We would also note that commercial renovations were done without either
building permits or certificates of occupancy; this included the addition of a
handicap ramp. Some of these renovations may not meet code.
8. If this plan is approved, the Planning Department requests that the previously-
noted items be addressed.

Re: Jeffrey Coho/Kamco Florist
Per your request, below is the sequence of events regarding Jeffrey Coho/Kamco
Florist at 1676 Ellington Road.
July 1996: It was brought to staffs attention that Jeffrey Coho was planning on moving
into and operating his florist business at 1676 Ellington Road, Restricted
Commercial zone. The subject site includes a legally-nonconforming single
family residence, no business use previously. (Residential use is not allowed in
the RC zone, but the existing residence was grandfathered.) Staff informed Mr.
Coho that site plan approval from the Planning & Zoning Commission would be
necessary prior to occupancy of the building. Staff also informed Mr. Coho that
residential use is not allowed in the Restricted Commercial zone under current
zoning regulations, thus a variance would be required for residence.
All site conversions from residential to commercial require site plan approval, in order
for Planning & Zoning to determine whether the site meets zoning requirements. The
statutory authority for this requirement is clear in CGS 8-3(g); and South Windsor's
Zoning Regulations clearly state this requirement in Section 8, Site Development
Plan.
July 9, 1996: Mr. Coho appeared at a Planning & Zoning Commission meeting to
request a waiver from the site plan requirement. After discussion, the
Commission agreed that it would not be appropriate to grant such a waiver.
August 5, 6, 1996: Staff was again informed that Mr. Coho had moved into and
began operating his business at 1676 Ellington Road. Mr. Coho had not
acquired Planning and Zoning site plan approval, nor had he applied for any
building permits for the renovation work he was undertaking. Written citations by
•Page 1
both the Chief Building Official and the Zoning Enforcement Officer were sent to
Mr. Coho, both of which included a deadline for compliance.
August 21, 1996: A formal Cease and Desist order was issued by the Zoning
Enforcement Officer. A deadline of September 21 was set for compliance.
October 1996: ZEO referred this case to the Town Attorney for action.
November 1996: Mr. Coho applied for three variances: (1) to have his business and
residence in the dwelling; (2)to waive the site plan requirement, and (3)to erect
a larger sign than permitted. ZBA granted two of the three variances, but denied
the request to waive site plan approval. The granting of the other two variances
was made contingent upon receiving PZC site plan approval.
Subsequent to these activities, Mr. Coho appeared at a PZC meeting during the
Public Participation portion of the agenda, and once again requested that PZC waive
the site plan requirement. The PZC refused to do so. Mr.Coho reacted with anger
and went from the PZC meeting to the concurrent Town Council meeting, at which he
suggested that the PZC should be abolished.
There was no further activity until the more recent series of events surrounding Mr.
Coho's refinancing of the site, and the resultant $3,000 escrow account to ensure
that the site plan approval is obtained. The site plan is now pending with PZC; there
are outstanding site plan issues that will need to be addressed both prior to and after
PZC action. The application is scheduled to be heard on December 9; however, it is
possible that the outstanding items may result in inaction until these items are
addressed. (Please note that PZC has only one December meeting, due to the
holidays.)

Dear Marcia:
I am responding to the FAX you sent me yesterday, that was prepared by
Jerry Iazzetta.
I am questioning the need for P.E. certification, since we are planning
no design changes. to the site. The plan that was submitted is essentially
an existing conditions plan, which is certified by a land surveyor.
The depiction of the "future greenhouse" is for conceptual purposes only,
and therefore proposed grading around it, when we do not know the shape
or configuation, seems like a wasted exercise. When KAMCO FLORISTS apply
for a building permit to construct a greenhouse, that is the time to show
how the backyard will be graded to accomodate the greenhouse.
As far as item 3, the house/shop is serviced by a septic system out the
rear of the house, and the location is not specifically known. My client
has informed me that the water supply is from a well within the House/Shop
basement.
The roof gutters are conected to drain tiles that exit westerly towards
the Land Conservation Trust property. He seriously questions the need to
show a seven space parking area, and offers the following narrative on his
day to day operation.
The hours of operation are 9:00am-6:00pm, wholesale flower deliveries are
every other day by a van, with a duration time of 10-15 minutes. The shop
owner works essentially alone, and averages about two customers a day. A
future greenhouse would be for private use by KAMCO, and not open to the
public. Drainage naturally flows to the north and west, and there has been
no history of water problems. The edge of pavement for Ellington Road is
23 feet south of the highway, and his customers naturally park in the paved
driveway, or adjacent to it. With 1-2 customers per day, this is more than
adequate. Informal parking adjacent to the detached garage is available,
though not utilized to an extent during business hours.
Jeff Coho prefers to keep things the way they are, nce i is the most
functional.

In preparing the staff report for Tuesday's Planning & Zoning Commission meeting, I see that the
following items are missing from the site plan (in some instances, the checklist says they're there, but I
don'see them...).
♦ Key Map: Key map is generally illegible;and needs the layout of buildings and parking, plus
direction of drainage and sanitary sewerage indicated;and driveway cuts on surrounding property.
♦ Site plan is missing the parking formula and parking spaces in accordance with zoning regulations;
pavement widths are missing,as well as existing sanitary sewerage and water service. (While
addressed in your memo, they are required to be shown on the plan.)
Any questions,call me.

The attached document is in the Town Sanitarian's files. It indicates that there is a shared well for this
site & the site next door; and that this shared well is located approximately 60 feet from the septic
system serving the residence that Jeff Coho owns (therefore does not meet the Public Health Code).
The report dates from 1976, and conflicts with the information provided to you by Mr. Coho. We do
need accurate well and septic system location information in order to determine whether the conversion
from residential to commercial meets the Public Health Code separating distance requirements.

Mr. Mel Edwards,
To: David C. Wiggin, Director Sanitary Inspector
Environmental Health Service Division South Windsor, Conn.
From: Alan J. Buzzetti, Senior Sanitarian j
Environmental Health Service Division
On August 182 the writer conducted an investigation and collected water
samples of the drinking water supply at the Sunshine Nursery School, 1678 Ellingtor
Road; South Windsor, Conn. The investigation was conducted at the request of
Ms. Ruby Thompson of the Maternal and Child Health Division of this department.
The writer was accompanied by Mr. David Webster owner of the well and commercial
building where the nursery school is located.
OBSERVATIONS:
A. Location
The water supply for the nursery school is a drilled well approximately
165 feet deep by 6 inches in diameter. The water supply serves all the businesses
in the corviercial center and the Webster residence next door.
The well is located 10 feet south of the Webster residence.
B. Protection
The well is sealed below grade. A pipe which formerly served for outside
watering and irrigation is terminated above grade and is capped.
The w.11 is located approximately 60 feet south of the septic system
serving the Webster residence and is a great distance southwest from the septic
system serving the commercial complex.
No sewage overflow was noted in the area of either system at the time of
inspection.
C. Sampling
A sample for bacteriological and chemical analysis was collected at the
Webster Flower Shop and submitted for analysis to the State Health Department
Laboratory (sample Number 24543).
CONCLUSIONS AND RECO.T4E!VDATION3
1.) The result of the analysis on water sample number 24543 indicated the water
was safe for drinking at the time of sampling.
2.) The well appeared to be located within the 75 foot minimum separation
distance from the Webster residence septic system which would be required
under present Public Health Code regulations.

It has been determined that the existing separating distance of the well
and septic system at the above stated location is a legal non-conforming
use and therefore may continue to exist unless it is determined
contamination of the well exists from the existing septic system.
It will be required by this Department that results of a chemical and

RE: Commercial Waste Disposal
Dear Mr. Coho:
Pursuant to our recent discussion concerning the subject of commingling commercial waste with
residential waste, please take notice that such a practice is not permitted.
The Town appropriates public funds to support a program for the curbside collection of
residential generated wastes. There is no public subsidy of private enterprise for refuse or
recycling collection services.
The property at 1676 Ellington Road is within a RC zone, and a variance has been obtained
allowing the owner to use the property for both residential and commercial purposes.
Wastes and recyclables generated by the residential use of the property may be placed at the curb
for collection by the Town. Wastes and recyclables generated by the commercial use of the
property must be handled by means of a separate process of containers and haulers. The disposal
of commercial wastes and recyclables involve a cost of doing business; it is not a public matter
to resolve, but requires a business decision.
If you have any questions in regard to this issue, please feel free to contact me at 644-2511,
extension 247.
Very truly yours,

MEMORANDUM
TO: Marcia A. Banach, Director of Planking
FROM: Jerry C. Iazzetta, Town Engineer
DATE: February 5, 1998
RE: KAMCO FLORIST SITE PLAN
We have reviewed the revised drawing dated January 1998 for the proposed Kamco
Florist Site Plan and have the following comments:
1. P.E. Certification required.
2. The "parking spaces" shown along the East Side of property do not appear to allow
proper parking. The vehicles parked in the Handicap space and the two (2) other
spaces will have difficulty turning around. This arrangement is not acceptable from
a safety standpoint.
3. Location of well and septic should be found and shown on drawing. (Notes indicate
Axapproximate location of septic", etc.)
4. Are the '"parking spaces" along the East Side of the property to be paved or
graveled, or etc.?

Dear Attorney Leary:
Please be advised that I received your fax concerning the release of escrow funds in the
amount of$2,240 to Mr.Coho.
I wish to inform you that I would not want any funds released until such time as Mr. Coho has
final approval from the Town of South Windsor. Staff has indicated that there are questions on
the submitted site plan, and the Planning & Zoning Commission has other concerns as well.
Therefore, I feel that if the funds were released and additional work had to be done, Mr. Coho
may not complete his application.
Mr. Coho will be appearing before the Planning & Zoning Commission on Tuesday, February
10, 1998, and if all goes well, I will call you Wednesday morning and advise you accordingly.
I thank you for your cooperation in this matter. If you have any additional questions, please do
not hesitate to contact my office.
Very truly yours,

Dear Mr. Coho:
Re: Appl #97-95P, Kamco Florist
We regret to advise you that the Planning & Zoning Commission voted on February 17,
1998 to deny the above-referenced application. The Commission had numerous
questions regarding the proposed greenhouse appearance and grading, as well as how
the greenhouse would be used (e.g., will there be retail sales directly from the
greenhouse?). The Commission also wants to explore with you (or your representative)
your proposed schedule for bringing the site into compliance with an approved site plan.
As there was no representative at the February 17 meeting, the Commission was unable
to secure an extension of time in which to act on this application (which had a final
action date of February 21 under the previously-granted extension) in order to get
answers to their questions. The Commission did waive the fee for reapplication.
Very truly yours,
