Summerville at South Windsor Dear Ms. Sirkin-Zanker: As requested,Fuss& O Neill has reviewed the traffic impacts associated with providing a 90 unit assisted living facility within the State Traffic Commission(STC) approved Town Shopping Center in South Windsor, Connecticut. Our review has concluded that the traffic generated by the proposed assisted living facility will have no measurable impact on the adjacent roadway system due to the low volumes of generated traffic associated with this land use. The existing Town Shopping Center was approved by the STC (STC Certificate No. 802) as a multi-use site. The approved uses for the site included 52,000 SF of office use, 65,000 SF of retail use,and a 5,000 drive-in bank. The estimated trip generated as approved by the STC is as follows: 7Peak PM Dailv our Peak Hour ` Enter 179 254 3,392 -92 Exit 100 322 3,) Total 279 576 6,784 Currently, the Town Shopping Center consists of 16,000 SF of office use, 65,000 SF of retail use and a 12,000 bank facility. It is our understanding, that the proposed 90 unit assisted living facility may utilize some of the un-built approved Town Shopping Center square footage. Under this scenario, the proposed assisted living facility will generate traffic significantly lower than any existing approved square footage for the center. However, our analysis has considered a scenario in which the proposed 90 unit assisted living facility will be in addition to the approved square footage for the Town Shopping C'PntPr 1Atf J —/ Ms. Ellen Sirkin-Zanker September 2, 1997 Page 2 Our analysis required the determination of the expected trip generation for a 90 unit assisted living facility. To estimate the proposed trip generation, it was necessary to investigate the Institute of Transportation Engineers (ITE) "Trip Generation" manual which maintains data for similar facilities. Also, Fuss & O'Neill maintains a database for this land use as a result of traffic impact studies conducted for similar facilities. These two data sources has allowed Fuss & O'Neill to estimate the expected trip generation for the proposed facility as follows: AM PM Week Peak Hour Peak Hour Day Enter 23 11 142 Exit 8 21 142 Total 31 32 284 Our understanding of the proposed assisted living facility and previous experience with similar facilities, indicates that the majority of the peak hour trip generation is associated with employees working at the facility. The majority of the residents at the facility will not be generating vehicle trips during the peak hour and only minimally over a daily time period. In review of the above data, and our review of the existing STC history for the Town Shopping Center, it is our opinion that the proposed assisted living facility will have no measurable impact on the adjacent roadway traffic. Additionally, the existing access driveways for the Town Shopping Centers have sufficient reserve capacity to provide safe and efficient traffic operations with the addition of the assisted living facility at the Town Shopping Center. Folger Zoning/Wetlands Enforcement Officer Town of South Windsor Re: Review o Summervill Assisted Living Facility, Ellington Road, plans dated 8/29/97. I have reviewed the site plans for the proposed Summerville Assisted Living facility with the following comments: 1. "Wet Meadow" seed mix should show specific species compliment and percentage. 2. Do the estimates for wetland disturbance include the wetland areas extending from the detention basin to the south? 3. Profiles of the detention basin, present and proposed, should be shown. 4. The soil stockpile is proposed to be placed in the location of the parking lot. The construction narrative should explain in greater detail the sequencing of the building, parking lot and storm system. 5. The wetland boundaries need to be located in the field. 6. The proposed disturbance to the existing detention basin is planned to occur while stormwater from Town Center is continuing to discharge into the basin. In order to insure acceptable water quality during construction the proposal will require a detailed phasing plan that incorporates grading changes by section with erosion controls erected to create a series of progressive filters leading to the outlet. cc. The revision date on our plans is September 16, 1997. In order to address all of the staff comments and the concerns of the Architectural and Design Review Committee,we have shifted the building footprint about five(5)feet to west. This allowed us to avoid the parking conflict with the CL&P easement along the eastern border of the property. We have responded in writing to all of the comments received form Mr. Jerry Iazzetta and Mr. Jeffrey Folger. In addition, we have incorporated these revisions onto our drawings. Our new drawings are dated August 29, 1997 and revised on September 16, 1997. There are a few comments from the "In House Development Review Group" meeting on September 10, 1997 that require minor clarification. Most of these suggestions were addressed in response to other staff comments. The exceptions are as follows: • Finish Course of Pavement of Town Center: Mr. Richard Kelley will complete the final paving from the Ellington Road curb cut to the entrance to the new "Summerville at South Windsor" facility. This paving will be accomplished when the parking lot paving is being done for the new facility. • Relocation of Dumpsters: The trash compactor(dumpster)near the service drive entrance will be relocated further to the South beyond the propane tanks as long as the proper electrical service can be provided at that location. Fuss&O'Neill Inc. Consulting Engineers Ms. Marcia Banach September 16, 1997 Page 2 • WPCA Approval: We understand that a separate WPCA approval is required assuming that a Planning and Zoning approval is granted. • Traffic Controls and Pedestrian Circulation: Stop signs, crosswalks, sidewalks, etc. have been shown on the plans. We hope this project meets the communities needs and addresses the appropriate technical and aesthetic issues to satisfy the Planning and Zoning requirements of your Town. We look forward to presenting this project at the Public Hearing and to receive the public and Commission's input. On behalf of the entire "Summerville at South Windsor"team,we want to thank you and all the South Windsor technical staff for your input and timely reviews. Sincerely, n James D. Parry, P. . The approved uses for the site included 52,000 SF of office use, 65,000 SF of retail use, and a 5,000 drive-in bank. The estimated trip generated as approved by the STC is as follows: AM PM Daily Peak Hour Peak Hour Enter 179 254 3,392 Exit 100 322 3,392 Total 279 576 6,784 Currently, the Town Shopping Center consists of 16,000 SF of office use, 65,000 SF of retail use and a 12,000 bank facility. It is our understanding, that the proposed 90 unit assisted living facility may utilize some of the un-built approved Town Shopping Center square footage. Under this scenario, the proposed assisted living facility will generate traffic significantly lower than any existing approved square footage for the center. However, our analysis has considered a scenario in which the proposed 90 unit assisted living facility will be in addition to the approved square footage for the Town Shopping Center_ Fuss&O'Neill Inc. Consulting Engineer. Ms. In review of the above data, and our review of the existing.STC history for the Town Shopping Center, it is our opinion that the proposed assisted living facility will have no measurable impact on the adjacent roadway traffic. Additionally, the existing access driveways for the Town Shopping Centers have sufficient reserve capacity to provide safe and efficient traffic operations with the addition of the assisted living facility at the Town Shopping Center. Should you have any questions concerning our analysis of the traffic impacts associated with the proposed development, please feel free to contact us. Sincerely, illinm A_ Wet_ P.E. Jme D. Banach,AICP, Director of Planning Date: 11/17/97 Re: Interpretation of"Filing in the Town Clerk's Office"as it applies to Planning & Zoning Commission-sponsored zone changes Per our telephone conversation this morning, I need your assistance regarding the interpretation of CGS Section 8-3(d): "Zoning regulations or boundaries or changes therein shall become effective at such time as is fixed by the zoning commission, provided a copy of such regulation, boundary or change shall be filed in the office of the town...clerk...." As I indicated to you, I have been apprised of a challenge by Attorney Alter that will be made to the Planning and Zoning Commission's rezoning of about 400 acres of Buckland Road in 1995. The nature of the challenge is that the zone change never took effect because the Commission did not follow the procedure that the Commission spells out in its regulations for an applicant pursuing a zone change (see attached Section 17.2.3 of the zoning regulations. The significance of this challenge is that Attorney Alter contends that Summerville's proposed zoning amendment must be submitted to CRCOG, since it affects a property within 500 feet of a town line. However, PZC rezoned the subject property when it did the comprehensive Buckland Gateway zone in 1995, therefore there is no remaining property within 500 feet of a town line affected by Summerville's proposed zoning amendment. When the PZC rezones land under its own initiative, rather than by petition from an applicant, we file it in the Town Clerk's office in two locations: ❖ On the official zoning map that is posted prominently above the map files, and ❖ Ina folder in a file drawer that is labeled "Planning &Zoning Commission." I would note for your information that, as a result of Attorney Alter's challenge, we have discovered a drawback with our posting of the zoning map on a bulletin board in the Town Clerk's office. After speaking with Attorney Alter, I checked and discovered that the current zoning map was missing from the board. As Michele and I are certain that the map was previously there, it is clear that the map was too easily removable. Therefore, it is possible that at the time Attorney Alter did his research, the map had been removed from the wall. With the aid of the Town Clerk-elect, we now have the zoning map under plexiglass on top of the map rack. If you agree that our posting of a zoning map with the new boundaries satisfies the requirements of CGS 8-3, then there is a zoning map showing the current zoning of Buckland Road on file in the Town Clerk's office at least as of Friday, November 14. The application for Summerville is being officially received Tuesday, November 18. Therefore, it would seem that, even if we were deficient because our zoning map had been removed (by unknown parties) from the Town Clerk's office, we corrected the problem prior to the acceptance of the subject application, thereby rendering the challenge moot. What do you think? Thanks so much for your help! PROPOSED AMENDMENT, SPECIAL EXCEPTION AND SITE PLAN 1) an amendment to Section 5.1.6 of the zoning regulations to allow assisted living facilities as a special exception use in RC Lzones; and for approval of a Special Exception/site plan of development under • b E new amendment —Shop 11:E11:311E Th as denied by the Commission on October 14, 1997. AA is r v i;?l rh 2) The amendment propoges that assisted living facilities be permitted as a special exception use, with definitions and criteria for the facilities, in much the same manner as the Senior Residence Development regulations. 3) If the zoning amendment is approved, the Planning Department would like to renumber the entire amendment from 5.1.6 to 5.1.2.9.4. The reason for this is that section 5.1.2.9 includes all of the special exception uses in the RC zone. Section 5.1.6 would be at the end of the RC regulations, and outside of the special exception section. 4 Theecial E e tion a 1' ation r r 1 f r - S xc p pp eques p ova o 3 tort', 60,00 u. foot, buildi on,3 cres included wi in the "roe boundafies of q' g P T wn,Shop ing Center. his site has pre ou ommissi n piroval for it enior idence De opment. 5) The facility would share the Town Shopping Center access driveway with its existing traffic signal, thus not requiring a new curb cut onto Ellington Road. Landscaping will delineate the perimeter of the gravel base. The Fire Marshal has approved this plan with the above-stated conditions. 7) Public water and sewer are provided. Water Pollution Control Authority approval is required. October 8 with a $5,000 bond as well off-site mitigation in the form of$15,000 to be applied to Nevers Road ponds; and a conservation easement on the property south of the proposed building. 9) , mem oye . There is a large amount of overflow parking available within the confines of the existing Town Shopping Center. The days and times that the Assisted Living Facility would most likely require overflow parking should coincide with the days that the majority of businesses in Town Shopping Center are not open. 10) The Architecture and Design Review Committee reviewed this site plan on September 4, for the previous application. At that time, ADRC indicated that the building and site were nicely designed. They suggested that the height of plantings between the back of the shopping center and this site be increased as much as possible, and that the aesthetics of the detention basin be considered when designing the wetlands plantings. 11) There is an electrical easement between this site and the back of the retail building that prohibits placement of any structures, trees or shrubs. Within the easement are located both electrical service and water linesr s e Went, and unfortunately the easement area will have to remain bare of landscaping. 12) An entrance sign is proposed inside the Town Shopping Center complex. Since the Town Shopping Center has already exceeded the maximum free- standing signage allowed by obtaining variances, the proposed freestanding sign would also need a variance. 13) The final pavement has never been placed on the Town Shopping Center site. This results in concerns such as reduced stormwater runoff reaching catch basins, which are placed at the finished pavement level; damage to catch basin tops, manholes, etc, by snow plows, increased icing during winter, and other concerns. Staff recommend that, at a minimum, finished pavement be placed on the entrance drive from Ellington Road to the assisted living facility to minimize the drainage and icing concerns for the new residents. 14) Staff has noted that vehicles tend to park in the existing service alley behind the main shopping building. This becomes more of a concern since this alley would become a service alley for the assisted living facility, including modifications, the key map will need to show existing driveways on surrounding properties. 16) Engineering Dept. had a list of housekeeping items that has been addressed by the applicant. Engineering will review the revisions prior to the work session on this application. y eA- i -017 TO: Marcia A. Banach, Director of Planning FROM: Jerry C. Will ""Gravel Access Road" be plowed during the winter for emergency vehicle access? 2. The existing 36-inch pipe into the existing detention basin is shown to be covered over. Please have applicant explain. 3. It is recommended that the finish course of pavement be placed on the existing shopping center driveway from Ellington Road to the proposed entrance road. 4. Guliano, Esquire [)EC $ 1997 Phelon, Fitzgerald and Wood South Windsor 773 Main Street Manchester, Connecticut 06040 Reference: Pending application for change in zoning regulations regarding assisted living facilities in the RC Zone Dear Attorney Guliano: As you may be aware, Attorney Glenn Coe appeared at the first session of the Public Hearing in the above-referenced matter on behalf of John Chakalos. At the public hearing Mr. Coe raised an issue of threshold importance to the consideration of the application. It is my understanding that this matter was referred to you for consideration. I have been asked by Mr. Coe and Mr. Chakalos, for whom I have acted in zoning matters, to provide you with the factual and legal basis of the position taken at the first session of the public hearing. The pending application is directed at all RC Zone parcels of land in South Windsor. Connecticut General Statutes Section 8-3b requires that any proposed change in a regulation which will affect the use in a zone within 500 feet of an adjoining municipality, by a town within the operation of a regional planning agency, must be referred to the planning agency by written notice for a thirty-five day period for comment. This requirement is mandatory and any action taken without compliance with the statute is ineffectual and without proper jurisdiction. (See 2 Conn. App. 595, Conn. Sup. 246 for support of this position.) Prior to April 15, 1995, an RC Zone existed along the boundary between Manchester and South Windsor. This RC Zone is clearly within the 500 foot limitation of C.G.S. 8-3b. The South Windsor Planning and Zoning Commission took action to make a zone change from the RC Zone to the Gateway Zone for this parcel to be effective on April 15, 1995. However, a review of the land records of the Town of South Windsor reveals that no map Barry D. Guliano, Esquire December 4, 1997 Page 2 Windsor Zoning Regulations require the filing of a "plot plan" within 90 days of the approval. "Any map not so filed or recorded within 90 days...shall become null and void." (Section 16.2.3.g). The effective date of the approved zone change shall be the date of the filing of the map. As a result of the failure to comply with the regulation, the zone of the parcel remains RC Zone and therefore compliance with C.G.S. 8-3b is required. Connecticut General Statutes Section 8-3 also requires the filing of a map of the zone change boundaries. The 1995 Town of South Windsor Zoning Map still reflects the zone of the parcel as RC Zone. Until November 18, 1997, the 1997 Zoning Map was either not on file in the Town Clerk's office or had been lost or stolen. This recent filing does not resolve the failure to comply with either the local ordinance or state statute in 1995. At the time of the pending application's filing, an RC Zone still legally existed within 500 feet of a town boundary and therefore compliance with C.G.S. 8-3b was required. The pending application cannot be acted upon until both the local regulations and state statute are complied with. Thank you for your attention in this matter. Staff have reviewed the site plan for conformance with the proposed PZC amendment. There are two sections with which we are unable to determine conformance and will need the applicant to address: ♦ Section 4.20.p Outdoor Recreation, if adopted as presented, will require at least one acre of outdoor recreation area(s), fenced and creatively designed to provide stimulation such as bird feeders, benches, gardens; and ♦ Section 4.20.q Screening, will require screening around all sides of an assisted living facility in a commercial zone except for street frontage. The screening must meet the standards in our buffer Section 10.4.a.1 & 2, which are: (1) the field of view shall be obscured visually within five years' time to such an extent that activity on the abutting lot is not immediately apparent; and (2) the field of view must be substantially obscured visually by the maturity of the planting. 3. The previous public hearing was held open in order to obtain input from the Town Attorney regarding the need for Summerville's proposed zoning amendment to be reviewed by CRCOG. The PZC-proposed amendment has been reviewed by CRCOG, as noted in the preceding public hearing for the assisted living amendment. Folger ',''.oEPT R Zoning/Wetland Officer Town of South Windsor ° v Re: Review of Roncalli Senior Care Facility-Plans dated 3/88. I have reviewed the submitted plans with the following comments. 1. The proposed detention basin should incorporate wetland plantings on the bottom to act as a biofilter. The route that storm flows of 2-year intensity and less take through the basin should maximize travel time from inlet to outlet. A detailed planting plan should be submitted. 2. Efforts should be made to reduce the level of disturbance in the area of the proposed detention basin. 3. The eastern slope to the detention basin should have a reverse slope bench incorporated in the grading to reduce the velocity of stormwater runoff. (See section 7-17 CT E&S Guidelines). 4. The 40' and 80' regulated areas need to be shown on the plans and any proposed disturbance in these areas need to be calculated and reported on the permit. 5. Proposed stormwater outfalls at reach 6+00 and 11+00 should incorporate level spreaders parallel to the slope and biofilters to attenuate runoff. - 6. The applicant should consider utilizing infiltrators to accommodate the extensive roof drainage(3.95 acres)planned. This water is relatively free of potential pollutants and it would be beneficial to the maintenance of hydrology to the wetlands adjacent to the project if this water could be incorporated into the ground. 7. The plans show outlet protection and proposed stormwater structures on the grading plan but not on the E&S plan. These items should be shown on the E&S plan as well. 8. The construction narrative shows the installation of the, crossing is proposed between July and November. I would not recommend starting construction of the crossing anytime after August 15''. From August 15'on the likelihood of wet weather is increased. 9. The amount of land to be disturbed at one time for phase one is approximately 10 to 12 acres. Given the proximity of wetland to the site, presence of slopes, and nature of the soil I would not recommend more than five(5) acres be exposed at any one time. Additionally the northern most rock wall entrance appears to have been constructed in part on the neighboring property. CORRECTIVE ACTION REQUIRED: Accumulated sediment from the road must be swept. Existing erosion controls must be repaired. Erosion controls must be erected along the driveway shoulders and center island. An anti-tracking pad must be installed adjacent to the soil stockpile to prevent trucks exiting the site from tracking soil onto the town roads.
