We presently reside in Manchester and work in Hartford and due to the distance involved in traveling to Wallingford the number of times necessary to care for a home and parents make this an undesirable option. Three (3) years ago Robert was diagnosed with prostate cancer and due to this condition may soon demand surgery and radiation treatments . A process that would leave him in a seriously weakened and limited position. As their only child, it is our desire to care for them during these difficult times . We had looked at other properties with this arrangement in mind, but found none as suitable as this property. The living quarters are all on one level, the bathroom has a handicapped accessible shower. Other options in living arrangements required the use of stairs by Robert and Arline or some other inconviences . This property is ideally suited for our needs in both privacy and proximity. It is our understanding that the present owners were granted a permit for the very same reason. At such time as Robert and Arline no longer reside there, the rooms would be absorbed into our living space with them being used as a family room, a study, and guest rooms . Thank you for your cooperation in this matter. Acw_ --- Robert N. Austin Kimbery C. We had looked at other properties with this arrangement in mind, but found none as suitable as this property. At such time as Arline no longer reside there, the rooms would be absorbed into our living space with them being used as a family room, a study, and guest rooms. Please find enclosed a picture of the exterior of the house and a hand drawn layout of the in-law apartment. Thank you for your time and consideration Robert N. Austin AUSTIN IN-LAW APARTMENTS T & C RENEWAL PH 4/8/97 1. Request for renewal of a Temporary & conditional permit for an in-law apartment at 64 Morgan Farms Drive, A-20 zone. The original ZBA approval was granted on May 11, 1995. ZBA imposed two standard approval conditions: • Only a living room, kitchen and bedroom permitted, and • When the space is no longer utilized as an in-law apartment, it must be converted back to single family living space. 2. The wording of the T & C permit regulation is that, "Temporary and conditional permits may be granted by the Commission for a use which is not specified elsewhere in these regulations for a period not to exceed two years. Such approval may be given after a Public Hearing if, in the judgment of the Commission, the public convenience and welfare will be substantially served, and the appropriate use of neighboring property will not be substantially or permanently injured, and traffic and other hazards will not result from such use." 3. The A-20 zone does allow for an accessory apartment, which is similar to the in- law apartment except that the accessory apartment does not need to be used by a relative. According to the information submitted, the existing apartment at this address is somewhat larger than the accessory apartment regulation allows- 900 sf. They also would have difficulty meeting some of the building codes that would be required for a second unit. 4. If this application is approved, the Planning Dept. has no modifications to request.
