Request for renewal of a two year temporary & conditional permit for an in- law apartment at 9 Tuttle Circle, RR open space zone. The original approval was granted by ZBA in August of 1995. 2. ZBA has imposed approval conditions: • When the space is no longer utilized as an in-law apartment, it must be converted back to single family living space. • This is a family situation and approval does not make this property income producing. If the family situation should change, the home will have to be restored to a one family condition. 3. The wording of the T & C permit zoning regulation is that, "Temporary and conditional permits may be granted by the Commission for a use which is not specified elsewhere in these regulations for a period not to exceed two years. Such approval may be given after a Public Hearing if, in the judgment of the Commission, the public convenience and welfare will be substantially served, and the appropriate use of neighboring property will not be substantially or permanently injured, and traffic and other hazards will not result from such use." 4. The RR zone does allow for an accessory apartment, which is similar to the in- law apartment except that the accessory apartment does not need to be used by a relative and is limited to 700 square feet in size. This in-law apartment is approximately 800 square feet. The ZBA minutes reflect that this house has an outside entrance as well as an entrance from the inside of the house. 5. If this application is approved, the Planning Dept. has no modifications to request. prepared - atted !n- 5}1N rdt"t i 011e. parasible toe•Aisalnt to E rat:d lssto a- aim . ---._...; oao --_., .• rst acourste- ,Z, VI QeCAIL ---34-4 1 t Li __ " 349." pae+Y ..,Aer_A _8-. 'ram, "--=- u G r ,3,e Lp 16 i ,318 a '' -- t !
