Attachment to
So. Windsor Zoning Board of Appeals Application
by Herman Sparks.
Placement of the proposed garage relates to safety, esthetics, and a
desire to disturb my neighbors as little a possible. The property
islopes front to rear and from the east side to the west side. A i
driveway which drops approximately 4 1/2 - 5 ft from the street is
now on the west side of the property.
The east side of the property is the site of the proposed garage and
is relatively level from the street to the proposed garage site.
Building at this location would avoid the destruction of mature shade
trees. The trees provide privacy and shade to both myself and my
abutting neighbor . It would also mitigate the impact on the
neighbors on that side by keeping the garage entrance oriented to the
street and a new driveway as far from their home as is practical . As
part of the project, the old driveway would be removed allowing
landscaping in that area which would include trees and shrubs .
An alternative would be to place the garage next to the deck on the
east side of the house . Building at this location would require the
destruction of mature shade trees. This would orient the garage door
directly at my neighbors house, which is their bedroom side. This
orientation would be necessary to avoid constructing a driveway
directly over a sewer line but it would also require placing the
driveway almost to the property line. This would also have a
negative impact .on my neighbor.
A second alternative would be to repair the existing driveway on the
west side of the house and construct a garage at the end of it. This
would entail considerable excavation into a terrace behind the house
along with the removal of mature shade trees in that location.
Because the house is only 22 ' 9" from the west property line, this
approach would likely require a zoning variance as well . The
neighbor on this side is approximately 12 ' from the property line.
The current driveway is limited to a single lane with no turnaround
because it is bounded by a stonewall on one side and my neighbor 's
fence on the other . This requires backing out onto the street or
backing into the driveway, both of which are hazardous because of the
volume and speed of traffic. The pitch of the current driveway
creates additional hazards when combined with winter weather .
If approved, construction of a garage at the proposed site would
preserve mature shade trees, minimize the impact to my abutting
neighbors on either side, and provide for safer access to and from
the street.

Dear Mr. Sparks :
re: Application #1474-89
At the July 6 , 1989 , the Zoning Board of Appeals denied your request
for a 8' variance to section 5 . 2 to be allowed to construct a garage
12' from the side property line (20, required) at property located at
97 Beelzebub Road, RR zone.
No hardship was demonstrated. It was the consensus of the Commission
that there is sufficient room on the property without encroaching
upon the sidelines .
Ver truly yours,
Richard H. Eriksson '
