The applicants request three variances. The first request is for a variance to Section 4.1.2

the professional reside on the premises and that there be no more than one non resident employee.
Applicants request a variance to allow professional offices at 819 Clark Street wit out the
requirement that there be a resident on the premises and also, to eliminate the restriction as

A copy of the town zone map showing the restricted commerical zone across Clark Street from this

access to the property will be off of Clark Street almost opposite 819 Clark Street. The road _
net for the entire restricted commercial zone between Clark Street, Ellington Road, Buckland Road
and Deming Street provides that all of the road ways within that commercial shopping center area
will connect and that there will be one entrance on Clark, across the street from 819 Clark Street
one main entrance on Ellington Road and one main entrance on Buckland Road Therefore, as the
property across the street developes, Clark Street will become a major commercial road in this
area for traffic entering and leaving the shopping center complex across the street. The owners

RE: Application #1881-89
Gentlemen:
At the May 11, 1989, the Zoning Board of Appeals denied your request
for variances to: Section 4 . 1 . 2 to allow professional offices;
Section 5 . 2 to allow a 20 ' front yard (50' required) and 40%
impervious coverage ( 15% allowed; and Section 8.3 to allow a 20'
buffer (50' required) , on property located at 819 Clark Street, RR
zone.
No hardship was demonstrated. It was the consensus of the Commission
at this time that the Planning & Zoning Commission should be deciding
where commercial/office space should be permitted in this area. The
Commission felt it premature to change this area.
Very truly yours,
Lee'

CONTINUATION OF STATEMENT OF
HAROLD R. CUMMINGS AND ROBERT M. FINCH -IN SUPPORT OF
REQUEST FOR VARIANCES, 819 CLARK STREET, SOUTH WINDSOR
have had their house on the market for sale as a residence for over a year.
Given the proposed intense development of the commercial property across the
street, they have been unsuccessful in finding-a buyer for their property for
residential purposes. In addition, the proposed development of the commercial
center across the street will result in a widening of Clark Street in the area
of 819 Clark Street so as to support the additional traffic on the road at that
point. The owners and applicants claim hardship in that the growing commercial
nature of the neighborhood and increased traffic on Clark Street have and will
prevent reasonable residential use of the property, especially, in light of the
close proximity of the house to the road. The house was constructed over a
hundred years ago and is presently twenty feet from the established westerly-- ._
- street=-line. of'Clark Street.
The applicants further request a variance as to Section 5.2 of the regulations
to allow a twenty-foot front yard as opposed to a fifty-foot front -yard as
required in a rural residential zone, for the premises at 819 Clark Street.
A copy of a portion of the Metropolitan District Geodetic and Topographical
Survey Map No. 468 showing the 819 Clark Street property is attached to this
application. As the topographical survey map indicates, there are no wetlands
on 819 Clark Street and the property has a generally level terrain. In addition,
a copy of the assessors map for the property is attached which indicates that the
property has a total square footage of 69,300 square feet comprising approximately
1.5 acres.
The applicants further request a variance as to Section 8.3 of the regulations
which require a fifty-foot buffer strip since this property is located in a
residential zone. The applicants request a variance to allow for a twenty-
foot buffer strip for this property. Given the location of the property and the
existing house on the property, in comparison to the existing and proposed uses
on the abutting properties, a twenty-foot buffer strip would allow for appropriate
plantings and screening. The applicants propose to maintain the essential
residential character and appearance of the property.
In the event that the Zoning Board of Appeals grants the three requested variances,
the applicants would expect that any such approvals would be conditioned upon
applicants obtaining a site plan approval from the Planning and Zoning Commission
of South Windsor which would ensure that any renovations or additions to the
property would be in accordance with the zoning regulations of the Town of South
Windsor.

April 24, 1989
Planning and Zoning Commission
Town of South Windsor
Town Hall
South Windsor, Ct. 06074
Dear Members:
I am writing this letter in support of Mr. and Mrs. Robert Finch's request for
a zoning variance on their 819 Clark Street property.
The property across the street is rapidly advancing toward development as a
part of the "Town Center" business district. With the high level of business
activity currently being carried on at the Waldron place next door and the
fact that 819 Clark Street is virtually isolated from any other private
residence certainly will continue to deminish it's value as a private home.
Within a year, having a full blown retail business district directly across
the street can only cause the private residence value of this property to
dwindle even more.
In closing I fervently hope that you will allow this variance to help put an
end to the now growing anxiety of this long treasured South Windsor family.
Very Tru1 Yours:
Leonard J. ote
