RE: Application #1909-89 , David & Shelley Pollack
Dear Tom:
- In response to .your request for a review of the above referenced
application, the Planning and Engineering departments offer the
following:
We have no objection to a driveway crossing a power line easement,
subject. to the. applicants, ability to obtain approvals from the fire
Marshall (due to the length of the driveway) , the Building Department
and the Engineering Department (which review all applications for
single family houses prior to issuance of a building permit)
It is unclear from the application where the applicant intends to
access the 7-acre rear lot. If the access is intended to occur over
the 50-foot town-owned street stub on Dart Hill Road, then permission
to construct a driveway on Town property must be sought from the Town
council . ,

Dear Mr . Chairman:
Please note that Shelly Pollack is officially requesting that
her application for a variance to the lot frontage requirements be
moved over to the March meeting.
This request is based on the fact that the sign giving notice of
the hearing was posted on the wrong parcel of property and not
removed to the correct location until a few days before the February
2, 1989 hearing.

Dear Ms. Banach:
I have been informed by the Zoning Board of Appeals that the
Town of South Windsor is claiming ownership to a 50 foot wide strip
of property fronting Dart Hill Road, which is located between 89 and
107 Dart Hill Road.
I have checked the land records and found no such conveyance to
the Town by the present owner, Estate of Benjamin Hochberg or the
previous owners, Quality Built Homes and John Shutteren. On the
original map submitted by Quality Built Homes for Dart Hill Estates,
which is recorded on the Land Records, the 50 foot wide strip
appears to connect Dart Hill Road with the rear of the property, and
appears to be part of the same piece. I have not been able to
discern from the land records any indication that the strip fronting
Dart Hill was conveyed to the town.
I feel that the surveying map prepared by Lombardi Associates,
which is on file with the Zoning Board of Appeals accurately
reflects the boundaries of the 7 acre parcel .
Additionally, there is a 1973 sewer caveat concerning this
property which lists the present owner as the owner of the parcel
located between 89 and 107 Dart Hill Road.
It is apparently your understanding that the Town of South
Windsor has title to the 50 foot strip fronting Dart Hill Road. If
this is correct, please let me know under what document or authority
the Town is claiming ownership of this strip.
I would like to hear from you prior to the May meeting of the
Zoning Board of Appeals, if possible, to clarify any ambiguities
surrounding ownership of this parcel.

Reference Application #1909-89, construction of a single family
home on the rear of a 7 acre lot located on Dart Hill
Road.
Dear Mr. & Mrs . Pollack:
At the meeting of the Zoning Board of Appeals held on May 11, 1989, a
variance was granted to section 3 . 14 of the zoning regulations to
allow a construction of a single-family home on the rear of a 7 acre
lot located on property on the east side of Dart Hill Road, RR zone.
The permit is subject to the approval of the Fire Marshall and Town
Engineer. The house shall be located as shown on maps prepared by A
R Lombardi Associates, Inc. , sheet 1 of 1, dated November 30, 1988,
Project #88-1788 .
The hardship shown is that there is a 90' access from a town road and
the remainder of the land is suitable only for one house.
This action is effective May 11, 1989 and upon your filing of the
enclosed form in the Town Clerk' s office at your own expense.
Very ruly yours.._

Dear Mr . Ericson:
Northeast Utilities does not presently foresee any problems with
a driveway being placed underneath their transmission wires.
Northeast Utilities will submit to me, however , additional
requirements for gradation of the road, as well as the slopes
adjoining the road.
If a variance is granted by this Board, construction will not
begin until Northeast Utilities submits to me their requirements for
the construction of the driveway.
I do not expect any such list for several weeks.
