Request for renewal of a Temporary & conditional permit for an in-law apartment at 35 Devonshire Drive, A-30 zone. The original ZBA approval was granted in November 1994. ZBA imposed two conditions: • Only a living room, kitchen and bedroom permitted, and • When the space is no longer utilized as an in-law apartment, it must be converted back to single family living space. 2. The wording of the T & C permit regulation is that, "Temporary and conditional permits may be granted by the Commission for a use which is not specified elsewhere in these regulations for a period not to exceed two years. Such approval may be given after a Public Hearing if, in the judgment of the Commission, the public convenience and welfare will be substantially served, and the appropriate use of neighboring property will not be substantially or permanently injured, and traffic and other hazards will not result from such use." 3. The A-30 zone does allow for an accessory apartment, which is similar to the in- law apartment except that the accessory apartment does not need to be used by a relative. According to the information in the ZBA file, the existing apartment at this address may be somewhat larger than the accessory apartment regulation allows (maximum 700 square feet; the ZBA records indicate the in-law apartment is between 900-950 square feet). 4. This approval is for an in-law apartment for a family member/relative only. When the in-law apartment is no longer occupied by a relative of the family, the apartment cannot be treated as a second dwelling unit. Instead, the kitchen must be removed and the living area must be converted into other living space for the main dwelling. 2.
