Request for approval of a temporary and conditional permit to allow a new single family home at 2033 Ellington Road to be used as a model home and sales office for the recently-approved Chase Farms subdivision on Niederwerfer Road. ,The applicant is also requesting,Commission_approval-.to.-.ccanstxet m-od-eThomes in e su ivision itself, that item is else-ter m is agenda. 2. A permit is needed because the use of the new home as a sales office constitutes a business use that is not allowed in residential districts. This use could not be done as a home occupation because, among other limiting criteria, a home occupation has to be clearly secondary to the primary use of the home as a residence. Temporary & conditional permits may be granted by the Commission for a use which is not specified elsewhere in the regulations, if the public convenience and welfare will be substantially served, and the appropriate use of neighboring property will not be substantially or permanently injured, and traffic and other hazards will not result from such use. Model homes are not listed as a permitted use in any zoning district; however, sales offices would be permitted routinely in commercial districts. 3.), We want the Commission to be aware that at this time the home is not in compliance with zoning regulations as there is no garage. The Chief Building Official will not issue a permanent Certificate of Occupancy until the building is in compliance with zoning regulations; however, if the Commission is comfortable with the garage being restored prior to a permanent C.O. being granted, the Building Official has indicated he could issue a temporary C.O. 4. Signage allowed in the RR zone varies by use. There are three sizes allowed: a) signs bearing the name and occupation of the resident, 2 square feet b) signs advertising the sale, rental, construction and repair of the premises on which they are located, 4 square feet; and c) signs pertaining to a permitted non-residential use, 12 square feet. We suggest that signage be limited to 4 square feet. The 12 square feet sign is the sign that churches, schools, golf courses, etc., are permitted. 5. If this permit is approved, the Commission may want to consider reasonable limitations to hours of operation, outside lighting, number of employees/number of customers, etc., to ensure minimal disruption to the residential neighborhood. 6. If approved, the Planning Department requests the following conditions: • A driveway turnaround be provided; no backing out onto Ellington Road • All parking needs must be met on-site; no parking on Ellington Road • The model home is not to be used as a construction headquarters; sales activity only is allowed • If the Commission wants the garage restored, that should be included as an approval condition IC, s .
