After consideration of the entire record, the following facts are found and conclusions of law are reached: 1. The respondent is a public agency within the meaning of §1-18a(a) , G.S. 2. By letter of complaint filed with this Commission on November 16, 1994, the complainant alleged that at the respondent's November 9, 1994 regularly scheduled meeting, ("November meeting"}, an executive session was called and convened for an Improper purpose. 3. It is found that at the respondent's November meeting an executive session was called and convened to discuss "tthel Notice of Violation at [the Charbonneau residence] , . . ." 4. At the hearing into this matter, the respondent argued that the executive session was properly convened in accordance with §1-18a(e)(2) , G.S. , and §15.3 of its enforcement regulations since a "warning letter- and a "notice of violation" had been wailed to Charbonneau concerning his property. 5. It is found that on or about September 36, 1994 the respondent mailed a "yarning letter" to Charbonneau (hereinafter "September letter-), and then on or about October 18, 1994 a "notice of violation" was sent to him, (hereinafter mOctober notice"). 6. Section 1-18a(e)(2) , G.S., states that an executive session may be convened to discuss strategy and negotiations with respect to Rending claims or Pending litigation to which the public agency . .. is a party . . . Section 1-18(aj(q) , G.S. , defines a "pending claim" as: . a written notice to an ggencv which vets forth a demand for legal relief or which asserts a legal right stating the intention to institute an action in an appropriate forum if such relief or right is not granted. (8mphasis added.) 8. it is found that neither the respondent's September letter, nor October notice constitute a pending claim as defined by1-1ga)(g). G.S. 9. Section 1-18(a)(h) , G.S., defines "pending litigation" as: (1) a Written notice to an agency which sets forth a demand for legal relief or which asserts a legal right stating the intention to institute .an action before a court if Such relief or right is not granted by the agency: (2) the service of a complaint against an agency returnable to a court which seeks to enforce or implement legal relief or a legal right; or (3) the agency's consideration of action to enforce or implement legal relief or a legal right. 10. It is found that the respondent failed to allege or prove that Charbonneau took any action as required by 5§1-18(a)(h)(l) or 1-18(a)(h)(2), G.S., to threaten, assert or commence legal action. 11. it is alga €outd that neither the September letter nor the October notice constitute pending litigation under §1-18(a)(h) (1) or 51-18(a) (h)(2) , G.S. 12. It is further found that the respondent failed to prove that its issuance of the September letter and October violation constituted 'consideratiDn of action to enforce or implement legal relief or a legal right" as required by 51-18(S) (h)(3) , G.S. 13. It is concluded that the respondent did not convene the executive session at issue for a proper purpose as required by S1-18(a) (e) , G.S.: and therefore violated the open meetings provisions contained in N1-21, G.S. 14. Additionally, it is found that upon the facts of this case, the attendance of zoning/wetlands enforcement officer McCahill for the entire executive session was in violation of 1-21g(a), G.S. K.F Plant P.O. Box 375 East Windsor Hill, CT 06028 Dear Mr. Whalley: Re: Ongoing pollution impacts to Bancroft/Stoughton Brook from clay mining activities at 1440 John Fitch Blvd. This correspondence is to recap the meeting between you, Denise Savageau, and me on January 9 h 1997 to discuss site conditions and problems on 1440 John Fitch Boulevard. As we discussed the problems are twofold, first, you have a colony of beavers present on the property that continues to fill the outflow structures at the settling ponds. This causes a severe backup of water behind the outfalls which has to be periodically maintained. The second problem is that large areas of the borrow area that are not being used for excavation, storage, or access need to be vegetatively stable to minimize sediment impacts to the ponds and to surrounding wetland and watercourse areas. You have taken steps through voluntary cooperation to begin controlling stormwater runoff from the access roads leading to the borrow pit. Runoff channels have been identified and channel protection using brick material as rip-rap has been installed. The sand stockpile located adjacent to the northern access road has been pulled back from the slopes that border the wetland located there. Seeding efforts have begun along the berms surrounding the smaller settling ponds. The total amount of open land area present and unfortunate results in dealing with unforeseen problems, such as the beavers blocking the outlet structures suggest a more formal approach to natural resource protection on the site. It is in the best interests of the natural resources of the Town of South Windsor and Redland Brick to develop a comprehensive stormwater management plan for the site. This plan would provide short and long term practices, schedules and time tables for proposed treatments, and processes for handling problems in the future. I appreciate the attitude of cooperation you have expressed through our meeting and the through the timeliness of your response to previous concerns. I will provide any assistance necessary to affect a resolution to this situation. Folger Zoning and Wetland Enforcement Officer Town of South Windsor 1540 Sullivan Avenue South Windsor, CT 06074 Re; KF Plant, 1440 John Fitch Boulevard FEA 13 i997 South Windsor Dear Mr. Folger: INLAND WETLANDS AGENCY/ CONSERVATION COMMISSION Thank you for your letter of January 27, 1997 concerning the meeting between yourself, Denise Savageau, and me on January 9 concerning site conditions at the KF Plant, 1440 John Fitch Boulevard, South Windsor. I appreciate the fact that the Town of Windsor recognizes that the KF Plant faces a problem caused by a colony of beavers, whose activity has caused problems with drainage form the plant into the adjacent Bancroft/Stoughton Brook. We are working to find a way to deal promptly with the beaver problem, and hope to avoid future drainage problems. As your letter recognizes, the Plant has also already taken various other steps to control stormwater discharges. Your letter requests the development of a "comprehensive stormwater management plan" for the Site. In fact, the KF Plant has already developed, with its environmental consultants, Environmental Risk Limited of Bloomfield, a stormwater management plan. The Plant is observing the requirements of that stormwater management plan. If you would be interested in reviewing the plan, to see whether it might be altered or modified in some reasonable way to deal with concerns of the Town, please let me know and I will happy to review our plan with you. We can then discuss any concerns you might have. I assume that your January 2, 1997 issuing a Notice of Violation ("NOV") against the KF Plant is superseded by your January 27, 1997 letter, and that it is not necessary for the company to make any response to that NOV. Please contact me immediately if my understanding on this point is incorrect. Thank you for taking the time to meet with me. I look forward to working with you. Simon J. The Commission has invested a large amount of time and effort in the master planning of South Windsor's Interstate 291 corridor. Included in the master planning effort was a comprehensive rezoning that includes Burnham Street. The new I-291 Corridor Zone has high standards for site aesthetics.During the planning effort, the I-291 Corridor Committee and the Planning and Zoning Commission were careful to be sensitive to concerns previously expressed by the Town of East Hartford for this area. Since of South Windsor has invested so much time and funding in the planning efforts for this area, the Commission expressed concerns regarding the proximity of the proposed trucking terminal to Burnham Street. The Commission recognizes that this site has an existing building, and requests that, if approval is granted, such approval include a requirement for extensive screening and landscaping. Inventory storage and temporary storage of automobiles is permitted. Many examples of these, and other more intensive B- 2 uses are found in this vicinity. Safeguards include significant and specific regulations governing the parking of automobiles, parking lot construction, etc. Examples of all of the above uses can be seen in numerous places in B-2 zones throughout the town and particularly along Route 3 which is primarily B-2 and specifically B-2 in this area and over the front portion of this property. The public at large accepts these uses as consistent to the normal interaction of business, services and infrastructure necessary to the daily activities in this area. All infrastructure is presently accessible to the site including sewer, water, electricity, and natural gas. Roads and highways are more than adequate to accommodate the B-2 zone. This zone change is not contrary to zoning contemplated and already permitted in this area and is merely an easterly extension of the existing B-2 zone. In re: Property of Rosella A. Whitney, a/k/a Rosella A. Abbe 389 Abbe Road, South Windsor Dear Marcia: Enclosed please rind a copy of a property survey prepared by Al Schindler for the Rosella A. Whitney(a/k/a Rosella A. Abbe)property on Abbe Road. I also attach for your reference copy of a warranty deed dated April 3, 1929, recorded in Volume 27 at Page 219 of the South Windsor Land Records(the house and house lot)and also a copy of a quit claim deed dated December 20, 1948, and recorded at Volume 36,Page 404 of the South Windsor Land Records(the excess acreage deed). The house known as 389 Abbe Road is located on the original house lot deed recorded at Volume 27,Page 219. The additional acreage is being added to Parcel A, to comprise the total parcel of 1.24 acres, being transferred from the"extra acreage deed"at Volume 36,Page 404. Parcel B is the remaining portion of the"extra acreage"referenced in the deed at Volume 36, Page 404. Since 1948,there have been three conveyances by Rosella A. Whitney, a/k/a Rosella Abbe--the first, in 1954,was to Virginia Skillin and is recorded at Volume 48,Page 211 of the South Windsor Land Records. The second and third conveyances.were in 1979,to I.R. Stich Associates and recorded at Volume 265 at Page 309, and Volume 265 at Page 311 of the South Windsor Land Records, respectively. Those three conveyances all came out of the extra acreage parcel referenced in Volume 36 at Page 404. Therefore, it is my opinion that there is no subdivision issue created by reason of the conveyance of the house and house lot shown as Parcel A on the enclosed map, since Parcel A existed as a house and house lot of record since 1929. Before there could be a conveyance or sale of Parcel B, however,as a building lot, subdivision approval would be required since, as indicated, there were conveyances out of Parcel B after the adoption of subdivision regulations. We anti_cpate a closing and salve on the house and house lot on Tuesday,May 6th. At that time, we intend to record the mylar map. Understanding the policy of the Town of South Windsor that you review any mylar maps before they are filed, I would appreciate your reviewing the above and, hopefully, confirming that no subdivision approval is required for the conveyance of Parcel A, 389 Abbe Road, in accordance with the above title history. Windsor, CT 06074 Dear Mr. Levack: was astounded to learn that property owner abutters in the Town of South Windsor are not required to be notified of applications for exceptions or special approvals under the Zoning regulations. The Town and/or the applicant(s) for approvals by the Planning and Zoning Commission should be required to automatically notify abutting property owners of each and all Planning and Zoning actions and hearings where the use is not permitted as of absolute right in any particular zone. Therefore, where any special permit, special exception, variance, or other consideration for Zoning approval is submitted to the Commission said abutters must be notified, and not only where Inland Wetlands approvals are at issue as is the current regulation. Please advise as to whether and when this modification to our regulations will be effected. Should I need to pursue any action or process in order to so initiate and implement said modification, please so advise as well. I look forward to hearing from you. Thank you. Sincerely, Charles A. Windsor, CT 06074 SOUTH WINDSOR PLANNING MY- Dear Ladies: The following are submitted for additions and revisions to the present Town Zoning Regulations, both as general requirements and as conditions of any zoning approval: The Town must adopt and promulgate regulations and restrictions to ensure that there is appropriate, consistent, and compatible transitions of abutting projects and uses in adjoining and differing residential zones and in commercial or industrial to residential zones. Further, it must be ensured that abutting projects and uses in less restrictive zones, whether residential, commercial, or industrial, be of consistent and compatible size, style, scope, scale, and character as projects or uses in higher adjoining zones, i. e., residential. All applicants to the Planning and Zoning Commission for either special exceptions, special permits, changes of zone, or any other deviation from or modification to uses unequivocally permitted as of absolute right must be required to notify all property owner abutters. Projects must be limited in future use to the purpose for which originally approved by the Town. A project must not be permitted to be converted to other use(s) should the project prove not feasible to the developer, owner, or operator either from a market, feasibility, or profitability standpoint; for the convenience of the developer, owner, or operator; or for subsequent economic hardship of the developer, owner, or operator. Cooking stoves must not be permitted in the units of any non-single family project or facility designed or operated either for patients or for residents of any age, unless the project or facility is a conventional multi-family apartment or condominium project in a zone in which such is permitted. Violations of the restrictions upon stoves must result in immediate revocation of any zoning approval. The Town must otherwise supervise the construction of the installation of public water or sewer lines through Town Rights-of-Way property in residential neighborhoods and/or which abut private properties. The Town must restrict the destruction of trees and natural habitat for such construction. Any so minimized areas opened by such construction must be replanted with tall, mature trees and shrubs so as to preserve the natural state of the Right-of-Way land, the character of the area, and habitat for the wildlife. Box 503 South windsor Ct. 06074 Sept. 19, 1997 Marcia Banach, Director South Windsor Planning Department Town of South Windsor 1540 Sullivan Ave. South windsor, Ct. 06074 Dear Marcia; I was called today to be told that the Zoning Board of Appeals meeting for October was changed from October 2 to October 9 . The ZBA secretary asked if I wanted to have all of the ZBA members called. Upon questioning her, she stated that because of the Rosh Hashanah holiday, Staff personnel took it upon themselves to change the ZBA meeting day. I was further told that it was too late to schedule the meeting back to the 2nd. of October because the submission of the paperwork for the legal notice had passed. Please be advised that the Zoning Board of Appeals makes all of the policy decisions relative to ZBA activity. Scheduling meeting dates is a policy decision. I have not delegated any policy authority to Town Staff and to my knowledge, past Chairpersons have not done so. If there is any misunderstanding concerning this issue, please let this letter be my directive to you that there are certain administrative functions which have been delegated to Staff. However, no policy decisions have been nor will they be delegated to Staff as long as I am the Chairperson of the ZBA. I am available most of the time if policy decisions need to be made. Therefore, I request that you, as Director of Planning take the necessary action to assure that everyone in your department are fully aware of the limited administrative Zoning Board of Appeals functions delegated to our Town Staff. I will notify all ZBA members and alternates of the date change and the secretary of the ZBA of this directive. Very Truly Yours: ea`i io'sephJ. Due to the fairly recent change in zoning regulations related to the extension 291 Corridor, Ms. Lippee thought it would be in my best interest to bring my proposed use of the building to the attention of the board. At this time we would like to use this building to house Daniels Electric, an electrical contractor, and a machine shop with low noise finish grinding. These proposed businesses would not use any outside storage. Our plans our to clean up the site and remove the debris from the location. We hope you concur with Ms. Lippee that these uses are permitted. Sincerely, Daniel P. As indicated in number 4,sidewalks will be located as defined by the PZC. The Planning and Zoning has generally required sidewalks on at least one side of the road. (I have enclosed the wording currently existing in the Subdivision Regulations.) However as we are both aware, sidewalks are not always required. The next step to making this type of roadway allowed "by regulation" is to add some language to the actual Subdivision Regulation specifying the criteria under which this roadway can be proposed. We will be drafting an amendment and at that time you may want to provide some input about the requirement of sidewalks in developments with this road pattern. I will be sure to keep you informed as we go forward with any regulations. Michele Town of • • • Planning Department Memo To: Matt Galligan, Town Manager From: Marcia A. Banach,AICP, Director of Planning; Michael J. Gantick, P.E., Director of Public Works Date: 12/22/97 Re: Possible Acquisition of Property at 706 Sullivan Avenue and 42 Troy Road Pursuant to your request (and correspondence from Attorney John J. Kindl dated November 6, 1997), we have reviewed the above-referenced properties for desirability as Town-owned land. Both properties are located in our General Commercial zone, and both are conforming lots insofar as each meets minimum lot size, frontage and depth requirements in this zone. The property at 706 Ellington Road has one hundred thirty feet of frontage on Sullivan Avenue and is about 600 feet in length, with a total area of about 1.7 acres. The Town wetlands map shows regulated wetlands on the back portion of the property (as much as one-half to two-thirds of the property). There are no structures. This property is located slightly east of the intersection of West Road with Sullivan Avenue, and continues north about 2/3 of the way to the intersection of Troy Road and Brookfield Street. It is our opinion that this property may have some future value to the Town in the event that a major reconstruction of the West Road/Troy Road offset intersections is ever pursued. The property at 42 Troy Road has about 275 feet of frontage and is about 2.2 acres in size. The Town wetlands map indicates that much of this property is regulated wetlands, and a site visit confirms that much of the property is clearly wet much of the time. There is a derelict house on the site, as well a large quantity of old farm machinery and other junk scattered about on the property. It is our opinion that, due to the large amount of wetlands and debris on this property, it is not a desirable property for Town ownership. 0 Page 1 h One Corporate Center 730 Hopmeadow Street 2360 Main Street Hartford Simsbury P.O.Box 159 Connecticut 06103-3291 Connecticut 06070 Rocky Hill 860 525-6645 860 651-9348 Connecticut06067 FAX 860 522-1781 860 563-9305 SOROKIN SOROKIN GROSS HYDE&WILLIAMS PC FAX 860 525-9099 FAX 860 529-6931 ATTORNEYS AT LAW Reply To: One Corporate Center Direct Dial(860)541-3307 November 6, 1997 Town Council REC VEI . Town of South Windsor ED a Town Hall 150 Sullivan Avenue NOV r 1991 South Windsor, CT 06094 RE: 42 Troy Road and 706 Sullivan Avenue, South Windsor, CT SOUTH WINNO PLUNH KPT. Dear Council Members: Please be advised that this firm represents Richard Marshall,Trustee, the record owner of the above-referenced property, also shown as Parcels 27 and 28 on Assessor's Map No. 111. These two abutting parcels, located in a CG Zone consist of approximately 4 acres of land. The 42 Troy Road parcel contains 2.2 acres and has approximately 275 feet of frontage on the west side of Troy Road; while the 706 Sullivan Avenue parcel contains 1.7 acres and has approximately 130 feet of frontage on the north side of Sullivan Avenue. Other than a derelict frame structure on the Troy Road parcel, these properties contain no improvements. As your tax records will also reflect, these parcels are subject to significant outstanding real estate taxes, interest and lien fees, as well as a sanitary sewer lien in favor of the Town of South Windsor. As Trustee of the trust holding record title to this property, our client has recently undertaken an evaluation of the status of this property and,as a result, has requested that we inquire on his behalf as to whether the Town of South Windsor would be interested in acquiring title to these parcels. In light of the location of this property and the significant frontage on both Troy Road and Sullivan Avenue, the ownership of these properties by the Town may be beneficial in connection with future road expansion or other municipal development. Accordingly, I would respectfully request your consideration of this proposal at your convenience and your communication to the undersigned with your response in this regard. Should you require any further information or have any questions with respect to this correspondence, please do not hesitate to contact me. Thank you for your anticipated careful consideration of this request. 4c ely, a Kindl JJK/elt cc: Richard Marshall T 'lwmirlt Z ings; Town of • • • Town Manager'sOffice Memo To: Marge Anthony, Chairman, Zoning Board of Appeals From: Matt Galligan, Town Manager N" CC: Marcia Banach, Director of Planning Date: 01/30/98 Re: Planning Department Staff Attendance at ZBA Meetings I would like to address an issue that arises at Zoning Board of Appeals meetings, and offer a resolution to the problem. As you are well aware, the Planning Department is generally where ZBA applicants receive information and suggestions regarding how to proceed when said applicant wants to do something that is not allowed in the zoning regulations. They also are the department to whom applicants submit their actual applications. While the Planning Department does their best to provide accurate, helpful information and advice to potential applicants, they frequently receive feedback following ZBA meetings about the numerous "errors" that the Planning Department has forwarded to ZBA. We also hear about applicants who did not understand why they were requesting variances; and we have even heard on many occasions that the information presented to ZBA was not exactly the same as the information presented to the Planning Department. Needless to say, this type of confusion leads to extreme frustration on your part as well as on Planning Department staffs part. It is quite discouraging to hear feedback time and time again regarding the "errors"they make, yet have no way to attempt to clarify information as questions arise at your meetings. Marge, our goal as professional staff has always been to serve our boards and commissions as effectively as possible. In order to meet this goal, Marcia Banach, Director of Planning, and I agree that it would be mutually beneficial to both your Board and to the Planning Department to try to resolve this issue by having either 0 Page 1 Michele Lipe, Assistant Director of Planning, or Marcia attend ZBA meetings and sit in the audience, where they will be readily available to answer your questions if confusion arises. They can also, if it seems appropriate for an application, speak during the applicant's public hearing to provide you with any relevant information. Therefore, Planning Department staff will begin attending your February 5 meeting. It is our hope that their attendance at your meetings will prove to be beneficial both to ZBA members and to applicants. 0 Page 2
