FITCH MEADOW SPECIAL EXCEPTION AND SITE PLAN MODIFICATIONS
1. Application for a modification to the site plan and special exception that
were approved for this project in 1991 for a property located on the
westerly side of John Fitch Boulevard, northerly of Kimberly Drive, DRZ.
2. The original approval was for 30 units with a daycare center including an
apartment. The applicant is proposing to eliminate the daycare and
apartment and in its place construct two additional units.
3. Phase I of this development is currently under construction. Six of the
units are being dedicated to the Town's Moderate Price Housing Program.
The addition of two units will not require any additional units needing to
be dedicated. It appears that all zoning requirements have been met.
4. There are regulated wetlands in the vicinity of these two additional units,
however, there is currently a wetlands permit in place and this change will
not increase the impact on the wetlands, therefore no IWA/CC action is
required.
5. Public water and sewer currently service the site from Route 5. WPCA
approval will be required for the extension of the sewer to service these
two units.
6. The original road layout had a turnaround area for the proposed daycare.
Portion os this turnaround will be removed and the driveways for the units
will come off of that. This turnaround is required to remain because that is
how the applicant is meeting the 600 foot cul de sac length. The road is
going to be a Town road when the project is completed.
7. The applicant has indicated that the landscaping will be consistent with the
rest of the development.
If this application is approved, the Planning Department is requesting that the
zoning data table for the entire development shown on the map. Also, the
landscaping plan on file should be modified show plantings around the two
additional units.

FITCH MEADOW SITE AND SPECIAL EXCEPTION
1 . This is an application for a Special Exception to section
4 .5 .5 .b (formerly 4 . 11 .5 .b) and site plan of development
for the newly created DRZ zone on 14 . 96 ac. parcel of land
located on the westerly side of John Fitch Boulevard,
northerly of Kimberly Drive, DRZ zone. The zone change and
general plan of development was approved 2/26/91 .
2 . The applicant is proposing 31 single famiKay
ousing units;
and one apartment to be located over the care center.
The proposal calls for 20% of the units to be affordable-
totalling six units . These units will be sold and resold
according to the guidelines which were adopted by the Town
Council. The units will count towards South Windsor's 5
year goal of producing 143 units per the capitol region
Fair Housing Compact for Affordable Housing.
3 . The net buildable acreage is 11 . 36 and the density for the
project is 2 . 8 . Our regulations allow up to 4 units per
acre with 20% affordable housing.
4 . The applicant is also proposing a day care approximately
2, 750 sq ft which will have one apartment on the second
floor. There are 11 parking spaces required which have
been provided in the front of the daycare. There is also
adequate room for a bus turnaround at this location. A
proposed play area in the rear of the daycare appears to be
40 feet from the closest unit. Screening has been provided
between the day care and the first unit.
5 . The number of parking spaces r quired is 2 1/2 sp/unit or
80 spaces for the dwelling units in addition to the 11
required for the daycare. In addition, there are four 10 X
30 spaces set aside for recreational vehicles which is
shown enclosed by a wooden fence and screened with
. evergreens and deciduous trees . This area has been
relocated from the original general plan to a location
along the main drive.
6 . The applicant is proposing passive recreation to meet the
recreation requirement. Our regulations require either 600
sq ft of developed recreation area per unit-- about 1/2
acre for this application-- or 3600 square feet of
undeveloped recreation area per unit-- or about 2 .4 acres.
.. LJ&S, The rear of the property is shown to be a open space and
J the last 300 feet of the property as a conservation area.

4- stone -.dust--._paths- one-which-o-r-iginates-next--tc--the proposed
day---care-facility and a second path which comes off of one
of the driveways in the rear of the development. After
discussing this location with the applicant, he has agreed
that. -a-bett-e -glace-to-pitt this path may be along the
driveway to the detention basin coming off of the main
road.
7 . Impervious coverage for the site is 15%; '30% allowed. The
proposed building heights do not exceed the 30 ft maximum.
It appears that all other zoning regulations have been met.
There are regulated '-wetlands and an intermittent
gas watercourse on t-he site. The application has been
submitted to tie IWA/CC and will be heard by the Commission
on"Monday,eptember 16 .
9 . Public water and sewer are available to the site from Rte
5 . WPCA approval is required. Community Systems
requirements of P.A. 83-133 must be satisfied.
10 . Fred Shaw, Ass't public Works Director has stated for the
purpose of refuse and recyclable collection property owners
must grant to the Town, its agents and employees the right
to enter and reenter harmless from any and all liabilities
that may occur with respect to refuse and recyclable
collection.
11 . The traffic pattern for the site is as two way road that
terminates in a cul de sac. The driveways are off of the
:rain road and there are several drives that serve more than
one unit.
Because this drive comes out onto a state road, the curb
cut will be subject to DOT review and approval. The
applicant has provided P provisions for a left hand turn land
for traffic heading northbound on Route 5 .
12 . A bus shelter has been provided at the entrance of the
development.
13 . Sidewalks are proposed to be constructed along one side of
the main interior road.
14 . There is a good portion of this site which is wooded. The
landscaping plan shows that many of the existing trees will be
saved, particularly along the easterly frontage of the
property.
The is a 25 ' buffer shown around the perimeter of the site
as required in our regulations . The buffer plantings
consisting of norway spruce, eastern white pines and maples
will interspersed among trees that are to be saved. (A
shematic of the buffer in 5 years and at maturity have been
shown on the plans . ) A six foot fence is. shown at the
property corner in the area of the retention basin to
ensure that the screening requirement is met in this area
as discussed during the general plan application.
15 . The landscaping for the interior of the site shows the
streets lined with red oaks and red maples . Typical
planting have been provided for each of the unit types to
include various types of shrubs around the foundations .
2 - - 1 /J
16 . The houses Lposed for this site include y9 -3 bedroom
units and- 3 bedroom units ranging in size from 1150 to
1400 square feet. The affordable units are interspersed in
size and location. The Architecture and Design Review
Board reviewed these plans and were pleased with the
colonial architecture and the layout of the project. They
had no other comments .
17 . There is no phasing proposed for this project at this time.
If this application is approved, the planning department has no
other modifications to request.

RE: FITCH MEADOW 96-78P
We have reviewed the plans dated 11-14-96 for the proposed Fitch
Meadow Special Exception and Site Plan and have the following
comments :
1 . WPCA approval may be needed for the extension of the sanitary
sewer main.
2 . We have a concern about the proposed "circular driveway" for
lots 32 and 33 .
a. It is recommended that the access onto Fitch Meadow
Drive either be a shared driveway with one curb cut or
both driveway widths should be reduced. (Each are over
20 feet wide. )
b. If this "circular driveway" is to remain, it should be
a private driveway and not part of the town road with
maintenance the responsibility of the lot owners .
C . If driveway is to remain as shown, a right to utilize
this circular driveway needs to be granted to both
lots .

Affordable Housing
Attached is a copy of the price list for all houses in Phase 1.
Lot 29 is an E Model house that has already been designated as an affordable unit. It is priced$3,000.00
less than the identical E Model house on Lot 7 that is not an affordable unit.
Lot 3 is a B Model house and the unit that we recently requested Town approval as the second
affordable in Phase 1. Lot 3 is priced$4,000.00 less that an identical B Model house on Lot 4.
Affordable units have not been designated for Phase 2 of the project. We are currently working with the
engineer on lot layouts for Phase 2. As soon as that layout is complete we will be able to submit our
request for the Phase 2 affordable units.

Dear Bryan:
Re: Fitch Meadow, Lots 13 & 14 Driveways
This will confirm the Planning &Zoning Commission approval for the separation of the shared
driveway for Lots 13 and 14 at Fitch Meadow. This approval includes the following conditions:
1. The driveway for Lot 14 must be moved away from the catch basin and electrical
service box. (We acknowledge that it will probably have to infringe somewhat on the
cul-de-sac.)
2. The driveways for both Lot 13 and Lot 14 should be reduced to 12 feet in width.
3. There will be no additional curb cuts created by future separation of shared
driveways.
If we may be of further assistance, please do not hesitate to contact me.

• Comments:
Town staff agree that there is potential to use the driveway at Maneely's to access the Fitch Meadow
detention basin. There are some items that need to be worked out to make the detention basin fully
accessible from Maneely's parking lot; these items are listed on the attachment from Mel Stead,
Superintendent of Streets. Also, instead of dimensioning an easement, we suggest that a "right to
access"format be used. (It is unlikely that Town trucks and equipment accessing the basin would be
able to stay within the confines of a dimensioned easement.)A hold harmless agreement would also be
needed.
Please feel free to work directly with Jerry lazzetta and Mel Stead to address the items attached

OBSERVATIONS --- FITCH MEADOW
DETENTION POND PROPOSAL
12/3/97 — M. Stead
■ Maneely's plan appears out dated. Pavement extends out to rear property line and to the left
to rear of building.
■ There is a concrete dumpster pad with dumpster at southwest corner of lot.
■ There is an earth berm with spruce plantings between the pavement and the detention pond.
This adds 3 or 4 feet to the slope down to the flowline of the splash pads.
■ Berm would have to be negotiated in 2 places, as equipment travel would not be possible
along the edge of pond parallel with parking area.
■ Access along the west property line on Fitch Meadow property is possible but two 6-inch
diameter trees would have to be removed (orange ribbons on them). One dead 16"dia. tree
needs to be removed; one 4" dia. tree needs to be removed.
■ Even with trees removed, access would be narrow but passable to get to outlet structure.
■ The access to outlet structure should have the loam removed, gravel placed then reloamed
and seeded.

ROUTE 5, SOUTH WINDSOR
MODERATE HOUSING PROGRAM
We are becoming increasingly concerned about our inability to comply with the requirements of
the Moderate Housing Program. The Fitch Meadow project was set up originally with a
requirement to include six Moderate Housing units. We were successful in selling two units in
Phase 1 to buyers that qualified under the program guidelines. With the exception of these two
units, we have not been able to arouse any interest from over one hundred potential buyers..
We agree that the program had tremendous value and necessity at the time it was introduced. Real
estate prices were at an all time high and builders could afford to offer sizable reductions in price
to approved buyers under the program. Buyers did not worry about the negatives because it was
the only way they were going to be able to purchase a new home. Those conditions do not exist
in todays real estate market and buyers see no reason to take on the very real encumbrances of the
program when they do not have to in order to buy a house.
Please consider the following points that summarize almost two years of unsuccessful effort to
comply with the program:
• The program allows for the sale of three bedroom homes at a maximum price of$159,000.
We have sold 20 houses at prices ranging from $100,000 to $134,900. Every house has
been $24,000 to $59,000 below that maximum figure. If the primary objective of the
program was to give buyer an opportunity to buy within the price structure of the program,
it could be said that we are selling 100% within the guidelines, not 20%.
• When we are selling houses at $100,000 to $134,900 it is impossible to offer a reduction in
price that makes it irresistible regardless of the negatives. We are currently offering a
$6,000 reduction in price on any house sold under the program.
• Buyers will not accept the requirement that all future buyers must qualify under the plan. On
a resale, the owner must find someone that likes the house, accepts the price, accepts the
neighborhood and also qualifies. That buyer may never be found and the house may remain
on the market as unsaleable.
• Most important, because prices are so low buyers do not need the program.
• Even if a buyer is interested, they may not qualify because of salary or assets.

Article VII of the program states that the program may be amended or terminated at any time by
the Town Council. We are not recommending that the program be canceled. However, in the best
interest of the people that the program is intended to serve; there should be a way of interpreting
the plan based on the availability of housing within the program pricing structure or have a
moratorium on the plan until economic conditions require that it be activated to provide moderate
priced housing. One possible interpretation could be to exempt any project where every house is
being sold below the guideline of two and one half times the medium income for a family of five.
We have asked our Realtor, Cile Decker Associates, to provide us with information as to why
they have not been able to sell the number of houses required under the plan. We are attaching a
memo from Cile Decker dated June 25, 1998 for your review.
Several of our buyers have stated that they did not think it was possible to purchase a house of the
quality we are offering in a neighborhood like Fitch Meadow for such a low price. These
comments confirm that we are providing an opportunity for people with limited financial means to
purchase a new home. We are proud of what we have been able to provide and we need a
common sense evaluation by the Town on what can be done regarding the Moderate Housing
program so that we can complete a project that has already provided housing for numerous
borderline buyers.
We are prepared and willing to meet at any level that is appropriate to resolve this issue.
Thank you for your time and attention to this request.

FROM: Cile Decker
SUBJECT: MODERATE HOUSING AT FITCH MEADOW
DATE: June 25, 1998
As the party responsible for the marketing of the Fitch Meadow subdivision and having
a good understanding of the Town of South Windsor's requirements regarding
compliance with the existing Moderate Housing regulations, I feel that I must share with
you my observations and my concerns.
We find that the buyers for Fitch Meadow are reluctant to pursue purchasing under the
Moderate Housing Program for the following reasons:
• It is very difficult for most to meet the guidelines due to the required income
restrictions and asset limitations.
• The property prices in the subdivision all fall below those required for Moderate
Housing when the plan was put into place. Most people do not wish to consider an
affiliation with Fitch Meadow as a Moderate Housing connection, but rather as a
normal purchase.
• The fact that the properties must remain in the program even upon resale will
greatly limit any current buyers abilities to market homes for resale, since
subsequent buyer's must meet current guidelines.
• All owners must be occupants of the units they purchase, thereby eliminating the
ability to rent, if necessary, due to unforeseen circumstances.
• The $6000.00 reduction incentive is very substantial but, still, buyers are
uncomfortable with the Moderate Housing Guidelines and tend not to take
advantage of the opportunity.

The program was initiated several years ago when prices of residential homes were
escalating in excess of 1 1/2% per month. It was virtually impossible to purchase a
home for less than $150,000 in South Windsor. Currently, there are many
residential properties being offered in a much lower price range, some below
$100,000. The need for such a program has greatly diminished and the potential
participants are difficult to attract.
I have advertised Moderate Housing opportunities at Fitch Meadow in the
newspapers and have received no response. We have offered Moderate Housing
opportunities at our weekly "Sunday Open House" held at the property and find
them to be less than attractive to buyers.
My concern is that, at Fitch Meadow, we must sell another four units under this
program. I know that this will be very difficult to accomplish. I feel that the Town of
South Windsor should consider some adjustments to the program. I understand the
ramifications of the Housing Compact that this community has entered into, along
with other communities, committing to the Moderate Price Housing Program. The
program filled many needs years ago when it was implemented. Economic
conditions have modified substantially since that time and certainly the "Housing
Market" has endured and survived very significant changes.
I believe these facts indicate an urgent need to review the program as it currently
exists and to seek such appropriate modifications that would be beneficial to all
parties. At least an effort should be made with significant persistence! Change is
inevitable, and programs must be reviewed in order to assure that they continually
meet the needs of those for whom they were created.

To Whom It May Concern.
I have been recently informed that the owners/association of the Fitch
Meadow Development plan to put the entrance to a walking trail directly
across my back yard. It is a few short feet between the rear of my house
and this proposed trail entrance.
The association's representative informed me that I signed something in my
homeowner's book when I bought the house that said it was to be. I can find
no such document or verbiage in my book.
I have twice written the Developers ( C & C)and, while I have received a
reply, I am not satisfied in the least.
I respectfully request that the powers that be in the government of the
town of South Windsor re-examine this proposed walking trail entrance's
location. I find it hard to believe that it would be an "approved" location for
such, especially when alternatives are readily available nearby. I am also
wondering if it would be possible to halt the construction of this trail
entrance until the matter is thoroughly investigated.
Thank you,

Dear Andre and Bryan:
As you know, I have been a happy resident of Fitch Meadow since "the beginning".
I must, however, voice my protest against the walking trail entrance. Have you actually seen,
in person, where that is planned to go? It is dreadful! Cannot this be moved to the RV parking
area ... or somewhere not to infringe on anyone's privacy?
I saw the petition, everyone said "yes" to it, but as I recall, when a gazebo was planned at the
other end of the street, the resident whose privacy would have been compromised were very
vocal, and everyone else supported their rights as such.
Please reconsider where this entry point will be, and let me know you thoughts.
I am prepared to take further steps, if necessary, to block this action.
Best regards,
Kimberlee J. Aust

WALKING TRAIL ENTRANCE
We have received your letter of May 19, 1999 and are sorry to hear that you feel the walking trail
location compromises your privacy. Let us give you some of the background that has brought us
to this point.
• A walking trail has always been on the original engineers plans that were approved by the
Town and that trail was in the area of the Day Care center. Approximately the same
location presently planned for the trail.
• The Day Care center with a fenced in play yard would have been immediately adjacent to
your property. We were successful in getting the Town to agree to eliminate the Day Care
center and a second floor apartment in favor of two single family homes.
• It is our intention to put a split rail fence on both sides of the trail to the back property line
of your property with a gravel path to the edge of the woods.
• The original approved engineers drawings showed the R/V storage area between Lots 26 &
27 or right in the middle of the project. We were successful in getting the Town to approve
moving the R/V storage area to its current location near Route 5. It was our suggestion that
a gazebo be located in the old R/V storage location. We believe the relocation of the RN
storage greatly improved the overall appearance of Fitch Meadow. At a meeting of home
owners we were asked to eliminate the gazebo and landscape that common area.
Landscaping for that area has been professionally designed and will be done shortly.
We believe that all of the changes that have been made have been in the best interest of all home
owners and helped create a successful and highly praised neighborhood.
It is out intention to proceed with the walking trail as currently approved by the Town. We hope
this information confirms that we have improved not hindered your privacy and that we have
always proceeded with the home owners interest in mind.

RE; WALKING TRAIL ENTRANCE,FITCH MEADOW
Dear Bryan:
Thank you for your quick response to my recent letter expressing concern over the location of the entrance
to the walking trail.
I understand that the trail has always been part of the plans.....however,as your letter so clearly illustrates,
these plans evolved, and continue to evolve as does the development itself. I also can appreciate the point
made as the walking trail entrance being a lesser evil than a day care center.
That being said,I still would request that you revisit this issue. I still don't understand why the entrance
cannot be off the RV storage area. It seems to me a very awkward place, between two private homes,to
locate this entrance. I wonder if the town official who approved this plan had his wits about him/herself
that day. Perhaps that is the place that I should be voicing my concerns.
Your kind attention,as always,is most appreciated.
Best regards,
KIMBERLEE J. AUSTIN
