RE: Land at 1075 Main Street, South Windsor, CT
Estate of Robert Brown
Dear Mr. Goodwin:
You have asked for a legal opinion concerning the existence of
a right of way in favor of property which you have signed an
agreement to buy at 1075 Main Street, South Windsor, CT presently
owned by the Estate of Robert H. Brown, deceased.
I have reviewed the land records and maps as recorded in the
South Windsor Town Clerk's Office and have concluded that a right
of way exists over a twelve foot road on land presently owned by
Richard Lindquist and Susan T. Lindquist as shown in a deed dated
May 1, 1978 recorded in Volume 241 at Page 65 of the South Windsor
Land Records. This right of way has existed at least since
November 8, 1929 as shown in a deed of the thirteen and one-half
acres (the parcel at 1075 Main Street) from Richard P. Jones and
Olive A. Jones to Ralph C. Lasbury recorded in Volume 27 at Page
258 of the South Windsor Land Records, wherein the said right of
way is both dominant and subservient to this parcel (that is, both
in favor of and subject to the right of way) .
Therefore, I am of the opinion that a right of way exists in
favor of the owners of this land over a 12 foot strip on the
northerly edge of land now or formerly of Lindquist and the South
Windsor Cemetery Association, Inc. partly by each, as shown on a
map or plan entitled, "Topographic Plan, John W. Goodwin 1075 Main
Street South Windsor connecticut Jan 5, 1995. Design Professional,
Inc. " and that this right of way is permanent and runs with the
land to which it is attached.
Very truly yours,
Ja es H. Throwe

I have reviewed the subdivision plan of Mr. John Goodwin, dated January 5, 1996,

The proposed driveway appears satisfactory for public safety access, provided any

Mr. John Goodwin has shown me his plan to create an 11 acre house lot behind 1075

The following comment is in addition to those in my April 10, 1996

1 . It is my recommendation that the driveway be widened to 18
feet because of the fact that several properties will
utilize it. This should be widened at least to the point
where the proposed 13 ' gravel drive enters this driveway.

Re: Application #96-19P John Goodwin Interior Lot Request for Special Exception to
Article 4.6 in Subdivision to create one interior lot
Dear Ms. Banach:
Our office has been retained by the South Windsor Cemetery Association, Steven P. and
Beth A. Grigorian and Drs. Richard R. and Susan T. Lindquist. In connection with the
representation of my clients, I reviewed the Planning & Zoning Commission file at the
Planning offices in the Town of South Windsor on May 8, 1996. At that time, I inquired as
to whether the applicant submitted an application to the Inland Wetlands Agency in
connection with the pending matter, pursuant to Section 8-26 of the Connecticut General
Statutes. I was advised that no such application was submitted to the Wetlands Agency.
Section 8-26 of the Connecticut General Statutes states "if an application involves land
regulated as an inland wetland or watercourse under the provisions of chapter 440, the
applicant shall submit an application to the agency responsible for administration of the
inland wetlands regulations no later than the day the application is filed for the subdivision or
resubdivision. The commission shall not render a decision until the inland wetlands agency
has submitted a report with its final decision to such commission. In making its decision, the
commission shall give due consideration to the report of the inland wetlands agency." The
language in the statute is clear and, in my opinion, the pending application is improper in
that the applicant has not filed the subdivision application with the Wetlands Agency for its
review and comments.
I would appreciate a call after you have had an opportunity to review this matter.

MEMORANDUM Planning
Windsor Town f
anning & Zoning Commission
TO: Planning & Zoning Commission Mr. Russell LeVack South
FROM: Agt. R. Bond #114 Traffic Services Unit Windsor
DATE: 9-May 96 Police Services
SUBJECT: Application 96-19P
To The Commission,
I had been approached by Mr. John Goodwin relative to the above application, property
located on Main Street. Mr. Goodwin presented plans for this property and asked me to
review same with regards to public safety and access for emergency vehicles.
Based on the plans reviewed, I found no problems with the site plan and a letter indicating this
was signed for Mr. Goodwin.
Since that time, I have personally inspected the property, particularly the 12' right of way along
the south side of the property. After this inspection, I have some concerns regarding the right
of way and its proximity to the home (Lindquist) at 1047 Main St..
The positioning of this home is such that there is approximately 19' between the edge of the
house itself and the fence along the north property line. Current usage of the Lindquist
property indicates that this area is used for parking and access to the home.
Use of a 12' right of way for vehicular access to the proposed home would place vehicles
some 4' away from the house. I believe this would pose a hazard for residents and/or visitors
to the Lindquist home.
I would recommend that other avenues of access to the property be explored.
Respectfully,

Re: Report on the Goodwin subdivision plot plan - 1075 Main Street
Date: May 14, 1996
The project consists of the subdivision of land creating a rear lot which would be used as a
residential house lot.
Site: The site is located in the Connecticut River Watershed. The wetlands in question on the
property are located in the rear of the property at the toe of a slope of varying length. The upper
area is a historical Ag field which presently has a sparse successional forest emerging on it.
Impact: The proposed house site is located on a level terrace with a distance of 165 feet to the
nearest wetland point. There should be no impact to the wetland area due to the construction of
the house as shown.
Less than 1/2 acre is proposed to be disturbed so it does not appear that conservation approval is
necessary.
The abutter's attorney has interpreted State statute to read that if there is wetlands anywhere on the
property, it should come before the Commission.

RE: GOODWIN SUBDIVISION
We have reviewed the drawings dated January 5, 1996 for the
proposed Goodwin Subdivision and have the following comments :
1 . Sanitary lateral is shown at less than 2% slope. Town
standard is for 2% minimum slope. Also size and type of pipe
need to be shown.
2. Iron pins should be placed at all corners and angle points .
3 . The information on the easterly property line of lot 2 cannot
be read as it is overlayed with tree symbols . This should be
relocated such that it can be easily seen.

Dear Rusty,
I am writing to the Commiafion concerning our son, John W.
Goodwin and his application before you. We are in favor of
one building lot being granted behind what is now 1075 Main St.
Because my husband, Ken, and I are retired and Ken suffer-
ing a stroke last year, we have decided to sell our home at
588 Main St . to our daughter, Jane. We still would like .to
live on the street during warmer months and feel 1075 Main St .
is appropriate for our needs . If John is permitted to build
in the back, not only can we improve the existing house and
property, but John can help us with our needs as we get older
and less independent. In our opinion, building a home in
the back would be the best use of the property . John ' s
plans do have precedent. In addition to other interior lots
already on the street, there are many extended second and
third generation families who enjoy this historic part of
South Windsor.
John attended -Union School, received confirmation at
First Congregational Church, was a member of the 4-H Club
and is a friend. of Wood Library. I am a trustee of Wood
Library and have been on the Historic District Commission.
We have lived on the street since 1963 , hence we have an
appreciation for our surroundings and would not do anything
that is not in keeping with the neighborhood. John has been
shoveling the driveway, mowing the lawn and keeping the
1075 Main St. property looking presentable while his
application is pending.
Of course_, we may be biased, but we would appreciate
the Commission considering these facts and explanations when
ruling on John' s application. He is currently leasing a
home at 1838 Main St . with his wife and two small children.
He wants very much to have his children grow up on the street,
as he did. We know he would be a good neighbor and an asset
to the Main Street community.
Sincerely,
e
Mrs . Kenneth C. Goodwin Sr.

Subject: Zoning Application for. l075 Main Street
Dear Mr.Lavack;
I am writing as the current co-owner of the property on 1075 Main Street to voice
my support of John Goodiv n's application for building.
My family has been acquainted with the Goodwins for many years and are verb
pleased that they have offered to purchase our property. As a well-established
Main.Street family,v,,e are con-vin.ced they will be continue to be contribution to
the community.
Since I grew up on Main Street, this home means much more to nie than just
another property. NVe are confident the Goodwins will offer much needed
improvements to the home and attached property. In addition,I have reviewed
John's plans to build in our back lot and am convinced it will enhance the
neighborhood. In any event, it will be a considerable improvement over the site
since I am currently unable to maintain the back lot.
Given the needed maintenance of the property, high suitability of the building
plans for the neighborhood, and impeccable character of the Goodwins,I request
your favorable consideration of their zoning permit.
Sincerely yours,
Mark S.Winward.

RE: OLD MAIN STREET REAR LOT DEVELOPMENT Manning & Zoning COMM15816h
Dear S.W. Zoning Commission:
A trend has recently developed which if allowed to continue will destroy the harmony of
Old Main Street.
I would like to register my disapproval of the recent practice of the South Windsor Zoning
Commission to allow set-back housing along Old Main Street. It is inappropriate,
anti-historical, unstructured, unaesthetic, and disorderly.
It will ruin the order, structure, history and beauty of the street if it is allowed to
continue. It destroys open space and replaces it with new, cluttered housing. The new
units if set at angles on rear lots will destroy the historical fabric and character of our
historic street.
New homes should front the street like the existing homes to preserve the architectural
harmony of the street. New homes should not be angled and not built on flag lots behind
existing older homes. Main Street is historical and unique, and has beauty, character and
dignity. New housing on flag lots set behind existing homes will destroy the most
valuable historical street in South Windsor.
What has been a beautiful street for 350 years will become a cluttered mess with cul-de-
sacs, houses set at angles, just like South Glastonbury. It can all happen in a short time,
and is not reversible. Once all the rear lots are built, Main Street will lose its character
and look like every other hodge-podge street in America. It will become a jumbled mix
of odd styles, dream houses and angles that don't fit together. The order, space and
symmetry will be gone. Unfortunately there is no law protecting beauty. In America, in
our headstrong quest for individual freedom, regardless of the consequences, we have
given ourselves the inalienable right to destroy that which is orderly, symmetrical,
homogeneous, structured, historical, beautiful and timeless. We replace it with immediate
self-centered gratification, with no respect for tradition.
I would respectfully request that the South Windsor Zoning Commission turn down future
requests for rear lot development on flag lots. New right-of-ways to single homes should
not be granted between existing older homes. This will prevent rear lot development and
will preserve the character and beauty of our historic Old Main Street.
Sincerely,
rLol 1D Pz C_ Bruce E. Burnham, M.D.

Dear Mr. Goodwin:
Re: Appl *96-19P, Goodwin Interior Lot
We are pleased to advise you that the Planning & Zoning Commission voted on June 25, 1996 to
approve with modifications the above-referenced application for a Special Exception to Article 4.6.1.a of
the Zoning Regulations and a Subdivision of property to create one interior lot on property located at
1075 Main Street, A-40 zone as shown on plans prepared by Design Professionals, Inc. Job No. 95-862
and dated January 5, 1995. This approval is subject to the following modifications:
1. This approval is for 1 lot, numbered 2.
2. Drainage and construction for this subdivision is subject to the approval of the Town Engineer.
3. All lots shall be serviced by the Town of South Windsor sanitary sewer system and are subject to
the approval of the Water Pollution Control Authority.
4. Water shall be supplied to this subdivision by a well.
5. All plans used in the field by the developer must bear the stamp and authorized signature of the
Town of South Windsor.
6. Footing drains are required for each house. Prior to the building of any structure on a lot, a
topographic map, drawn to a scale of 1" = 40', shall be submitted for each lot in the subdivision,
showing proposed contours, elevations and the location of the footing drains. No building permits
will be issued until the proposed contours, floor elevations and location of footing drains have been
approved by the Town Engineer.
7. If, for any reason, finished grading and other individual lot site work is not completed, the Town
Engineer shall determine the amount of a cash bond to ensure final grading and site work. This
cash bond must be submitted prior to issuance of a Certificate of Occupancy.
8. Quantity estimates must be submitted to the Town Engineer (on the enclosed form) for the purpose
of determining subdivision bonding, and all bonds shall be posted prior to filing the plans.
If the developer chooses to submit a Letter of Credit for a one year term, in lieu of a surety bond,
said Letter of Credit must be renewed on a yearly basis until completion of the development. If a
new Letter of Credit has not been received within 30 days before the expiration date, the
Commission may, at its option, call the Letter of Credit it is holding.
9. A drainage assessment fee in the amount of$50 shall be submitted to this Commission.
10. No building permits will be issued until all modifications have been complied with, and the final
plans have been filed in the Town Clerk's office.
11. Iron pins required at all corners and angle points.
12. Sanitary lateral must meet Town standard of at least 2% minimum slope, and size/type of pipe
must be shown.
13. Disposition of roof leaders must be shown.
14. Details required for sanitary trench, cleanout, driveway and roadway patch (if new sanitary
connection).
15. Driveway apron must be bituminous concrete.
16. Screening plantings are required along the east/southeast lot boundary area.
17. The new driveway should avoid trees by curving if necessary.
Black and white transparent mylars of Sheet 2 with the above modifications, together with three blueprint
copies of the entire set of plans must be submitted to this Commission within 30 days to be stamped and
signed. The letter of approval of this Commission and WPCA must be reproduced on the mylars.
After the mylars have been signed by the commission, they will be returned to you for filing in the
Office of the Town Clerk by October 14, 1996. After filing these plans, a copy of the receipt must be
submitted to the Planning Department.
The enclosed Special Exception form must be completed and filed in the Town Clerk's office. The
special exception will take effect upon filing.
