We understand because of a very busy schedule our public hearing has been rescheduled
from July 23rd to July 30th. Therefore we would request another meeting be scheduled as early
as possible in August, perhaps the week of the 6th. Our reason for this request is that if approvals
are granted, we would like to start construction this year, and there is extensive road work to do.
Also at this time we have over 50 senior citizens anxiously awaiting the outcome.
Thank you for your consideration in this matter.
Sincerely
Brian Edwards.

TO WHOM IT MAY CONCERN :
On May 7 , 1996 , a farmer drove through our property, on a tractor JUL 1 1996
pulling a trailer , he drove up the hill to the Collinsouth Windsor
PEiit & wing Commissiop...,
behind us , about an hour later he came back down the hill,
with the trailer filled with barrels , estimate about 12 barrels.
we shouted at him to stop , but he continued on . We stopped his
worker in a pick-up truck, but he couldn't answer any of our questions .
Riight after that , the builder Mr . Edwards pulled in, we questioned
him as to who authorized the removal of the barrels, and what were their
contents, he stated he knew nothing about them, while we were speaking to Mr.
Edwards, the farmer and his worker returned in the pick-up truck. We questioned
his identy, and who gave him permission to remove the barrels and their
contents. He finally told us he was Rusty Levack, we asked the builder if
he reconized or knew who he was, and he said no he did not know Mr Levack's
name, or reconize him. Mr. Levack denied having any conection with Planning
& Zonning, after many denials, he admitted he was a member of the commission,
and stated that Attorney futwimings, gave him permission to remove the barrels.
We called the D . E .P . , and they toldvto inform ibhre town , and the fire
marshall , which we did. The fire marshall and Mr . Folger from islands
wetlands , came out , took the report , looked at the soiled land, took
pictures , and left . M r . Lanning went to Mr. Levack's farm , he told us
Mr. Levack showed him some 27 barrels rusty with holes as the barrels he took
from the Collins farm, that he planned to use for water. Most of barrels
couldn't hold water, and no way could that trailer that pulled out of here
full of barrels , hold 27 barrels. We knew for a fact that barrels up on the
hill did contain some sort of liquid, we had been up there many times, and our
sons worked for Mr.Collins and had also seen liquid emptied into barrels
at the top of the hill. We also spoke with a man who rented the shed
on the hill , who said there were barrels in the shed he rented, full
of some liquid , and were to heavy for him to move, he wrote a letter
a
1
stating this information , which we gave to Mr .Folger, & the town manger.
We callad the town manages ,cnu,p,le'.of weeks ago to see if they had
any results ftc informed us that he has turned everything over to the fire
marshall, so on June 28 th. we called the fire marshall to see if he had any
answers for us, he informed us that he turned over his report to the engineers
at the enviormental company who is now handeling the case .
We are very concerned as to the results of this incident, and find it
hard to understand how all these meetings and articles in the paper stating
building on this propertyin August, and no one has answered t h Bse issues,
meanwhile the builder has meetings with inland wet lands, and planning and
r
z o n n i n g, voting on permits for this land. We would like someD to answer our questions
and concerns , and don't know who to turn to!

MEMORANDUM July 17, 1996
TO: Marcia A. Banach, Director of Pla ning
FROM: Jerry C. Iazzetta, Town Engineer
RE: COLLINS HILL II, 96-39P
We have reviewed the drawings dated 5-21-96 for the proposed Collins
Hill II 96-39P application. Since many of the drawings are the same
as for the Sunrise View Estates Subdivision 96-36P application, we
will not duplicate those comments and only address those for the
Collins Hill II application. Therefore, the following comments are in
addition to those in my July 17, 1996 memorandum on Sunrise View
Estates.
1 . Plot Plan should show road centerline information, road widths,
cul-de-sac radii, datum used, monuments for road and coordinates
for same for Butter Hill .
2. It would be appropriate to place a yard drain at end of retaining
wall near south corner of Unit 26 .
3 . Yard drains must be private.
4. Unit 23 should have footing drain tied into storm system.
5 . Roof leaders not addressed.
6 . Positive grading around YD' s 11 , 14 and 16 are required to make
them effective (Sheet 8) .
7 . Sheet 13 - Plan should indicate road centerline information, road
widths, cul-de-sac radii; size, type pipes for sanitary and
storm mains; sanitary lateral and footing drain inverts at
mains; gravel access road.
8 . Cricket Court should be eliminated from Sheet 13 or crossed out
as this is not part of proposed application.

10. Maximum grade of 3s at intersection, per the Public Improvement
Specifications - design shows 40.

Dear Ms. Banach:
As you know,I am the attorney for Collins Crossing,L.L.C. On behalf of my client and with
the full authority of my client, Collins Crossing,L.L.C. hereby withdraws the four above
referenced applications, 996-36P,#96-37P,#96-38P and 96-39P. This withdrawal'is without
prejudice to my client's future resubmission of one or more applications which may or may not
contain elements of the above referenced applications.
In addition, previously, my client had offered to deed to the Town of South Windsor a parcel of
land approximately 5 acres in size, adjacent to and westerly of Nevers Road. So there be no
misunderstanding, said offer of conveyance was associated with the above referenced
applications and was not intended to be a separate independent offer. So there be no
misunderstanding as to the legal status of that offer,my client also rescinds its offer to the
Town.
Sincerely yours,

Dear Attorney Cummings:
Re: Appl #96-31P, Collins Crossing
At the July 24, 1996 meeting of the South Windsor Wetlands Agency/Conservation Commission, a
motion to approve the request for significant activity associated with the construction of a stream
crossing on property located on the westerly side of Nevers Road, northerly of Sand Hill Drive, RR-zone
(Assessor's map #89, parcel 23 & 28) failed.
The concerns expressed by the Agency were:
1. a major impact on the watercourse.
2. an environmental impact upon the area.
3. there were feasible and prudent alternatives to the proposed stream crossing.
Very truly yours,
INLAND WETLANDS
