He indicated he was very reluctant to have North East Utilities remove the trees because they leave all the large wood that they cannot chip on the owner's property. Mr. Gerit's concern was leaving the large wood in the wetlands. I discussed your husband's concerns with Jeff Folger, the Inland Wetlands Enforcement Officer. Jeff did not have a problem with leaving the wood from the trees on the property. I hope this takes care of your concerns and you move forward to have North East Utilities remove your trees. This would remove the potential for the trees falling into Miller Road and causing damage to utility lines and people using the Town's road. Very truly yours, Karl E. It is imperative that we talk about trees on your property that border Miller Road. I believe there is a higher than average chance for some of your trees to fall into Miller Road and possibly cause damage to the power lines and anyone using the public road. I have been in contact with Northeast Utilities and I think we can work out the tree removals with some help from you. Please call me at 644-2531 so I can apprise you of the current situation. The current applicant is looking to the Commission for an interpretation of how this zoning regulation applies to this application. We would like to get that interpretation this evening, so that if a variance is needed, an application can be filed with ZBA for their September meeting. 6. Fred Shaw, Sup't of Water Pollution Control needs more information concerning lot#1 sanitary sewer connection, and the pressure system to serve lots 2 and 3. 7. There are regulated wetlands on a large portion of the property. This application does involve some regulated activity and will be heard by the IWA/CC on September 4. There is no 100- year floodplain; however, this may be more related to the fact that the FEMA study ended at Foster St. Ext and did not encompass this property, rather than the absence of 100-year floodplain on this property The plans reflect that equal cuts and fills will be provided to maintain the site balance. 8. The Town Engineer is asking that the street line be established on Miller Road with this application. In conjunction with the setting of the street line, there will be new Town property along Miller Road. The Tree Warden has indicated that 15 trees will need to be removed from within the new right-of-way prior to Town acceptance; an two trees will need to be trimmed to provide 14 feet of clearance over the traveled portion of the road. 9. These trees range in diameter from 12-18 inches. Using a thorough visible inspection, I have found numerous defects in these trees. Each tree has hollow cavities in the trunk or large splits, which can be points of failure. The ash are all very top heavy and the wood, by nature, is brittle. These trees are potential hazards to the town road and should be removed. If you have any questions, please feel free to call me at (860) 648-1584. Sincerely, Jason T.
