Levack South Planning and Zoning Commission July 4, 6 South Windsor, Ct J1tC v 1"6` Dear Chairman Levack and Commission Members, sxxl- win'-d ' manning; & Aring... 5si6if I will be out of town during the upcoming P&ZC meeting scheduled for July 9 and would like to share my views with you on the agenda item concerning the request of Paul Kuehn for approval of a building lot per the special exception regulations concerning interior lots. I have reviewed section IV F dealing with"INTERIOR LOTS"and while I can see instances where allowing building on property with out street frontage would make sense , it DOES NOT in this case. The approval criteria states that the commission will evaluate a long list of criteria including items such as the impact on aesthetics, proximity to neighboring properties, and the impact on property values. The applicant must demonstrate to the commission that these impacts are minimal. Placing a building lot/modern style house in the middle of four existing houses, one that dates back to the mid 1800's, most assuredly will effect the residents in a negative manner. While I have not had a chance to review the plans, the parcel of property in question has to be marginally meeting the requirements of lot size being 2X code and width being 1.5 frontage code. I would like the P&ZC to take a close look at how the two requirements are being met and to caution them on the fact that access roads and right of ways are exclusive of these requirements. I have live at 383 Foster Street for the past 20 years. Since moving in U&R and Stoner have developed the area on three side of me, but that was to be expected as a town grows. I was told that the forth side would not be developed due to lack of frontage. What bothers me is that new special exceptions to the zoning regulation get passed(with the best of purpose)and get manipulated to the short term benefit of individuals. Kuehn sees this regulation as a possible means of making more money as he plans to sell the rest of his property and move out. The surrounding property owners will be left with the negative consequences permanently(i.e.,diminished property value and negative impact on aesthetics with the inevitable removal of natural wooded areas). The P&ZC is our protection and puts sanity/humanity into the process. As an abutting property owner, I would ask that you turndown Kuehn's request for interior lot approval or at least table it to a later date so closer review of the plans and more sides of the issues can be heard. Sincerely Richard Muller MEMORANDUM July 9, 1996 TO: Marcia Banach, Director of Planning FROM: Jerry C. Iazzetta, Town Engineer RE: KUEHN RESUBDIVLSION- 9641P We have reviewed the drawings dated 6-12-96 for the proposed Kuehn Resubdivision and have the following comments: 1. Cleanouts are required at every bend of the sanitary lateral and every 100' of pipe maximum spacing. 2. Detail required for sanitary trench and footing drain trench. 3. As a possible alternate, applicant may want to investigate an "infiltrator" system with an emergency overflow for the footing drain. 4 . Iron pin required for the south corner along Foster Street. 5. The streetline should be established by deed for the frontage along Foster Street. JCI:bmr /russo/ENGINEERING/kuehn-96-41 P KEUHN INTERIOR LOT-- PH 7/9/96 1. Request for approval of a Special Exception for an interior lot and subdivision for property located at 155 Greenwood Drive, AA-30 zone., a 105 ac. lot with an existing house. The requirements for the interior lot include 60,000 sf minimum lot size and 225 feet minimum lot width. The proposed interior lot would be over 4 acres in size and almost 260 feet in width The remaining lot with the existing house would be 1.05 acres. There is also a 2.63 ac piece north of the existing house which is being left as remaining land. It is not proposed to be a building lot at this time. i 2. Access to the interior lot is proposed to be a 18' wide paved drive south of existing lot 20.' The driveway servicing the new interior lot will include a turn-around driveway. The Fire Marshall has no concerns with the proposed driveway. The property owned"Laurel Lane' would not be used as access to the new interior lot. 3. It appears that all other zoning requirements have been met. 4. The interior lot will be serviced by public sewer and public water. WPCA approval is required. A sewer benefit assessment will be required. There should be cleanest at each bend of sewer lateral (building sewer). There's should be a sewer lateral trench detail. 5. There are no regulated wetlands on the new lot and they are not proposing to disturb more than 20,000 sf. There is no 100-year floodplain. 6. The criteria for approval of interior lots include: a. the subject area's boundary configurations, topography, soils or other natural resource characteristics; b. proximity to neighboring properties and dwelling units; c. restriction of existing views; d. proposed buffering/screening; e. potential drainage, traffic& environmental impacts f. driveway locations, slopes& sight lines g. utility service capabilities h. property value impacts; and i. future land use alternatives. 6. This approval . is based on the following modifications: 1. This approval is for 2 lots, numbered 1 and 2. 2. Drainage and construction for this subdivision is subject to the approval of the Town Engineer. 3. All lots shall be serviced by the Town of South Windsor sanitary sewer system and are subject to the approval of the Water Pollution Control Authority. 4. Water shall be supplied to this subdivision by the public water. 5. All plans used in the field by the developer must bear the stamp and authorized signature of the Town of South Windsor. 6. All easements for conservation purposes, drainage or utilities, that may be required in connection with the approval of this subdivision, must be submitted on standard Town easement form where appropriate, to this Commission prior to filing the mylars and issuance of building permits. All deeds for open space, public improvements and roadways must be submitted prior to request for Town acceptance; all deeds must be in accordance with the policy for accepting deeds and must be approved by the Engineering Department and Town Attorney. 7. Footing drains are required for each house. Prior to the building of any structure on a lot, a topographic map, drawn to a scale of 1" = 40', shall be submitted for each lot in the subdivision, showing proposed contours, elevations and the location of the footing drains. No building permits will be issued until the proposed contours, floor elevations and location of footing drains have been approved by the Town Engineer. 8. This cash bond must be submitted prior to issuance of a Certificate of Occupancy. 9. Quantity estimates must be submitted to the Town Engineer (on the enclosed form) for the purpose of determining subdivision bonding, and all bonds shall be posted prior to filing the plans. If the developer chooses to submit a Letter of Credit for a one year term, in lieu of a surety bond, said Letter of Credit must be renewed on a yearly basis until completion of the development. If a new Letter of Credit has not been received within 30 days before the expiration date, the Commission may, at its option, call the Letter of Credit it is holding. 10. A drainage assessment fee in the amount of$50 shall be submitted to this Commission. 11. No building permits will be issued until all modifications have been complied with, and the final plans have been filed in the Town Clerk's office. 12. WPCA approval is required. A sewer benefit assessment will be required. The sanitary lateral for Lot #2 should be connected to the manhole in Greenwood Drive. Cleanouts are required every 100 feet maximum. Size and type of pipe for lateral should be indicated. 13. Detail for temporary roadway patch is required. 14. There should be no interconnection between the new driveway and Laurel Lane; a means of physical separation should be detailed on the final plans. 15. The enclosed Special Exception form must be completed and filed in the Town Clerk's office. The special exception will take effect upon filing. Black and white transparent mylars of Sheets 2 & 3 with the above modifications, together with three blueprint copies of the entire set of plans must be submitted to this Commission within 30 days to be stamped and signed. The letter of approval of this Commission as well as WPCA must be reproduced on the mylars. After the mylars have been signed by the commission, they will be returned to you for filing in the Office of the Town Clerk by December 28, 1996. After filing these plans, a copy of the receipt must be submitted to the Planning Department. Very truly yours, PLANNING & ZONING COMMISSION Frank A. Levack South Windbag & Zoning Commies Planning and Zoning Commission October 22, 1996 South Windsor, Ct Re; -Letter, R. Muller to Planning and Zoning Commission, "Kuehn Special Exception" 7/4/96. -Appl#96-41P,Kuehn Resubdivision&Special Exception, 9/12/96 Dear Chairman Levack and Commission Members, In the reference letter(attached)I requested that the application by Kuehn for Special Exception for development of an interior lot be closely reviewed to make sure it met the requirements for lot size and minimum impact to neighbors. At the time I wrote the letter I felt that putting a house in between three existing houses, a lot that did not pass close scrutiny as being in compliance, consideration of the impact on existing neighbors and a plan that did not meet spirit of the exception, would be more that enough to reject the request. At the hearing meeting considerable objections were raised by the neighbors in the area Neighbors in the development, from which access would be made, voiced concerns over where the driveway was to be placed and property values. The request was"Tabled"due to "serious problems"with the Plan. Well, you passed it,regardless of the input received at the hearing Meeting. Small concessions were made to the development neighbors and nothing was done for the two houses most affected (#383 and#387 Foster Street). You were elected to represent the people of South Windsor, not the developers or people out to make a buck and then leave town. The Special Exception Regulation gave you significant latitude in accepting or denying an application you should have used good judgment and rejected the application.. Did you even come out to look at the property and assess the impact on existing houses? The PZC needs to be much more sensitive to the impact of developments on the existing neighbors. I have lived in South Windsor for 20 years at this address,I have experienced(so far) developments being put in on three sides of my property. The latest"Stoner"Laurel Estates development plan was changed after the original PZC meeting and resulted in a tree stump dump in my front yard which to this day has not been graded and seeded as promised(it's been 7 years). As you probably can tell,I am not very confident in the building departments'capability of judging creative contractors'requests for plan changes and the potential impact to existing residences. 1 What I would like from the PZC is the following: -Consider in the future when plans get Tabled for serious problems, the affected property owners get a chance to comment on the revised plan before it is passed. -A copy of the final Kuehn plans as a record of what was passed(lessons learned from Stoner development). -To be contacted for input if the developer asks for changes or variances to the current plan. -An explanation on how the Special Exception requirement, that the minimum lot width"must be one and one-half time the required lot width for the zoning district", was complied with. Of the 225 ft requirement, the minimum lot width is approximately 190 feet by my calculations. There is an upper section that does comply, but the requirement does not say 1 1/2 somewhere, its says a width at the minimum lot width line must equal 1.5 times....". Does it mean that the house needs to be positioned at the upper area that does comply??? I do appreciate the time you donate in the service of the Town of South Windsor, however I do remind you that you are elected to represent the homeowners and to show good judgment when the current homeowners interest conflict with new development interests. The existing homeowners are stuck if an area around them is to be developed, the only hope they have is that the PZC will protect there interests because no one else will.
