On September 20,1993 the Inland Wetlands Agency approved a two lot subdivision on the east side of Clark Street for the aWlirant Thp plAnnin& 70nin9 Camission then approved the application on 9/29/93. Lot No. 1 had 3.62 acres and ample frontage, and the subject lot had 3.01 acres and 206.72 feet of frontage. Lot No. 2,however, was the subject of two separate Town encroachments. In the early 1970's the Town constructed a sewer force main serving the adjacent pump station. This encroaches on Mr. Jacques' land. In the early 1980's the Town once again encroached on Mr. Jacques' land and con- structed a bituminous driveway and fence. The Town never secured permission for these encroachments from the landowner. The Planning & Zoning Commission has requested that iv1r. Jacques donate the encroachment area to the Town, which amounts to ap=rnximatel7 _ 3,350 square feet, and reduces the frontage from 206.72 feet to 153 feet, necessitating a variance 'of 22 feet. Hardships: 1) The hardship was created by the Town, not by the applicant. Please observe that the lot is viable with or without the land donation, and this will not alter the house placement whatsoever.
