Rice We are applying for a variance to section 10.2 of the South Windsor Zoning Regulations to allow a 35 feet rear yard rather than 50 feet in the A-30 zone (15 feet variance). Over the past six months we have been working with our builder(U& R) to design a 4,000 square feet, four bedroom residence similar to the Scholz design attached to this application on lot 6 at Charing Woods. We have spent considerable time refining the design, and concluded this lengthy process recently. We are now under contract for the house construction, and with cold weather fast approaching, are anxious to begin construction in early November(construction was originally scheduled for mid-October). We are also under contract to sell our current residence on Stonefield Trail, which requires us to close early next year. We first learned of the zoning setback problem earlier this week when U&R's engineers, Design Professionals, were asked to prepare the building permit plot plan and discovered the encroachment of the deck (15+ feet) and family room (10+feet). The house, as proposed , would be 39 feet from the left side property line, and 58 feet from the right side. The house placement is critical because of the grades, which drop off dramatically toward the right side. Selecting another lot is not possible because most other lots have been spoken for, and none meet our personal requirements. We have been searching for a lot for over one year. If granted, this variance would have no impact on any abutter to the rear because there will never be any residence to the rear. The State of Connecticut purchased the large tract to the rear for another large detention basin to serve Avery Brook watershed, and thus the land is permanently dedicated to open space. We feel this is an important factor, in that a major reason for rear yard setbacks is to protect the neighbor behind your lot. Front and side yards will be maintained. Our exceptional difficulties and/or hardships include: 1). There is no reasonable alternative to placement of the custom-designed house on this lot, given lot characteristics such as grade, and given the house footprint. 2). House depth is tied into the internal layout, which is very important. To reduce the depth to conform to the 50 feet rear yard would require a radical change in the design. 3). We were unaware of the zoning setback problem for the family room and deck until we were at the very end of the design process. 4). We are under very tight time constraints, due to contractual obligations associated with the sale of our present home and the onset of winter. 5). The zoning setback in the rear yard (50 feet) does not serve to protect a rear abutter(permanent dedicated state land). 6.) This is our lot of choice after a long search. Even if we were to consider switching lots, all potentially suitable lots are already under deposit, and are thus unavailable to us. In conclusion, members of our family sincerely appreciate your consideration of our application and are hopeful that you will recognize the unusual hardships associated with building our home on our chosen lot.
