Mr . Russell Hopowiec d/b/a Cafe Pesto 1750 Ellington Road South Windsor , CT 06074 RE: ZBA Application #2123-93: Russell Hopowiec, d/b/a Cafe Pesto 1750 Ellington Road Dear Mr . Hopowiec: At the meeting of the Zoning Board of Appeals held on May 6 , 1993, your request for an 8 ft. variance to Section 10 . 2 of the zoning regulations to allow a 57 ft . front yard (65 ft . required) at 1750 Ellington Rd . , RC Zone, was approved . The Board noted the hardship with this appeal as being that the building is presently existing as non-conforming. This action is effective May 6, 1993 and upon your filing of the enclosed form in the Town Clerk ' s office at your own expense. In addition, a six month temporary and conditional permit from May to October for a 12 ft . deck and to allow outside dining for seating of 16 people (8 tables of 2 seats) , was approved. As part of this approval , if it can be shown that the 12 foot deck is included within the 57 foot front yard distance as part of the variance granted, then that part of the temporary and conditional permit becomes immaterial and the deck is then considered part of the variance granted on this applicant . This action is effective May 6 , 1993. This permit will expire on October 31 , 1993 and will have to be renewed before April of 1994 is the use is to be continued.
