Clark 137 Maskel Road South Windsor, Ct 06074 October 28, 1992 Town of South Windsor Zoning Board of Appeals 1540 Sullivan Ave. So. Windsor, CT 06074 Dear : Members of Zoning Board of Appeals Subject: Objection to Variance Request at 129 Maskel Road, South Windsor My name is Forrest R. Clark of Lot #21 , better known as 137 Maskel Road, South Windsor. I have resided at this address for more than 32 years. My property abuts lot #22, known as 129 Maskel Road, for a distance of 202.79 ft. Both of these lots are very small, less than one half acre (approx. 20,000 sq. ft.). I am gravely concerned about the application now before the Zoning Board of Appeals for a variance change from 20' to 10' closer to my property line for a 10' x 16 ' shed. As you can see from the very small lots we operate with, we are living in very close proximity to one another. Since Mr. John W. Keegan has lived at 129 Maskel Road for approximately 15 years he has done nothing to his property but run it down to a real eye sore. Early this summer 5 of his neighbors who's property either abuts or is adjacent to 129 Maskel Road., confronted him as a group to express our deepest concerns over his lack of consideration for the neighborhood and his lack of pride for his own property which we feel has greatly reduced the values of the neighboring properties, if we are forced to sell for any reason. Winter storms the past two years blew many, many of the asphalt shingles off his roof slamming into my house and automobiles requiring me to keep cleaning the asphalt marks off my property. At times I would pick up 2 or 3 armfuls of his roof shingles off my property. The lawn where Mr. Keegan now lives was probably the best kept up and best looking lawn on Maskel Road before he moved in. Today it is the worst looking lawn on the street. At one October 28, 1992 Page-2 point this summer the grass on his front lawn was 22" high and 27" high on his rear lawn. His house hasn't been painted in nearly 20 years. In some windows curtains are hanging that wouldn't make a good cloth for an auto mechanic to wipe the grease off his hands. Throughout the years he has cut down the nice shade trees on the property and yanked out all the shrubs around his house. Because of Mr. Keegan's lack of concern and consideration for his property and just as thoughtless toward his neighbors I am asking you, the Zoning Board of Appeals, to extend the courtesy to me that you would like to have extended to yourselves if you had the misfortune of living next to a neighbor of this caliber. Mr. Keegan's request for 10' variance change comes up before the board next Thursday, Nov. 5, 1992. Although his request hasn't reached the Zoning Board of Appeals as of this writing, I am very upset he has already poured the concrete foundation for this shed and I believe it to be even closer to my property line than the minimum 10 ft. requirement. My wife confronted Mr. Keegan about the location of the poured foundation and his answer was quote, "This is where I want it and this is where it will be," although Zoning Enforcement Officer John E. McCahill informed me he told Mr. Keegan in advance of the concrete being poured that approval for the variance may not be approved. We use our back lawn a great deal in the warmer weather to socialize with friends, for family picnics or to just sit, read and relax by ourselves. We do not want to be confronted with yet another eye sore on lot #22, so we are asking you to reject this application for variance. Thanking you in advance for your kind consideration. Very truly yours, Forrest R. Clark w Forrest R. Clark 137 Maskel Road South Windsor, CT 06074 November 5, 1992 Town of South Windsor Zoning Board of Appeals 1540 Sullivan Ave. So. Windsor, CT 06074 Subject: This letter supersedes letter of Oct. 28, 1992, Re: Objection to Variance Request at 129 Maskel Rd., So. Windsor Good Evening - Members of the Zoning Board of Appeals: My name is Forrest Clark, residing on Lot#21, commonly referred to as 137 Maskel Rd., So. Windsor, and have lived at this address for more than 32 years. The south side of my property abuts lot#22, known as 129 Maskel Rd., for a distance of some 202.79 ft., occupied by Mr. John W. Keegan, who has lived at this address for approximately 15 years. As you can see from the map of record in possession of the Town of South Windsor these lots are very small, less than one half acre (approx. 20,000 sq. ft.) zoned RR. It is my understanding that a basic requirement for building on lots zoned RR must be done no less than 20 ft. from the property line unless there is a hardship of some sort that would make it unfeasible to build within this requirement, then a variance may be approved. I would invite any and all members of this board to physically inspect lot#22 to see what factor could even be considered a hardship and ask Mr. Keegan to prove it. My contention is, there is absolutely no obstacle to hinder construction of the proposed 10' X 16' shed Mr. Keegan has applied for anywhere on lot#22 within the present zoning laws governing the 20 ft. required distance from the property boundary line. I am deeply disturbed that a concrete foundation has already been poured (Oct. 27, 1992), 10 days before the application reaches the Zoning Board of Appeals to be acted upon. And to further make matters worse this concrete foundation is nearer the property line than the 10 ft. variance change would permit if the application was to be approved. My wife confronted Mr. Keegan about the location of this foundation and his answer to her was, quote, "This is where I Nov. 5, 1992 Page 2 want it and this is where it will be." Mr. Keegan cannot plead ignorant to the fact he was not aware of the possibility his request for variance change might not be approved. Zoning Enforcement Officer John E. McCahill told me he personally informed Mr. Keegan in advance of the concrete pouring that he would be taking a chance if he went forward with the cement work prior to this hearing because approval for his variance change may not be forthcoming as he has anticipated. I do not wish to get into personality issues but I feel facts must be stated. As stated earlier, our lots are very small which equates into a situation that we are living in a very close proximity to one another. Since Mr. Keegan has been living at 129 Maskel Rd., for approximately 15 years he has done very little to his property except run it down to a deplorable state. The appearance of his property finally got to such a sorry state of affairs that in June of this summer, to the embarrassment of 5 neighbors that live in close proximity to Mr. Keegan, felt we must approach him about our concern as to how his lack of attention to his property was effecting the value of our real estate investment, saying nothing of having to look at an eye sore every time we went outside. As a group we expressed our concerns over his neglect and lack of consideration for his neighbors. Most of us on Maskel Rd., take pride in our homes and surrounding property and try to keep it up to the point it is a credit to the neighborhood and it only takes one to pull the immediate area down. Because of Mr. Keegan's 15 year track record of being a neighbor who has shown no respect or concern for his neighbors I do not want another eye sore on lot#22 that sits only 10 ft. from my property line adjacent to my back lawn which we use a great deal in the warmer weather to socialize with friends, for family picnics or to just sit, read and relax by ourselves. If this variance is approved, his shed would be right next to our back yard activity center. It is my understanding the purpose of zoning regulations is to give the town a direction in which to proceed and exercise the ability to upscale and upgrade the appearance of properties to make the various areas of the town more attractive by conforming to certain types of regularities thus helping to keep up the values of properties protecting the investor and enhancing the town as well. It is difficult to say what will eventually happen to the property at 129 Maskel Rd. One day Mr. Keegan will say he wants the shed to be close to his back door for his convenience and the next day he will tell you he may move back into the City Nov. 5, 1992 Page 3 of Hartford and rent out this So. Windsor property. I believe most of us would agree that if the owner doesn't take care of his property while he lives there, conditions will not improve if he follows through and uses this location as a rental property. I am asking you, the Zoning Board of Appeals, to please extend the courtesy to me that you would wish to have extended to yourselves if you had the misfortune of living next to a neighbor of this caliber who is outright stealing money from my estate. I have been retired for nearly six years and I need all the net worth I can muster to carry me through my life expectancy. Loosing money on my real estate value is something I can ill afford. I am asking you to reject this application for variance. Thank you in advance for your kind consideration. Very truly yours, 7 '1" Forrest R.
