S E C T I O N - 3. 10 . 9
3 . 10 . 9 A building containing a permitted use, but which does not
conform to the requirements of these regulations regarding
building height limit, floor area, width of lot, percentage
of lot coverage and required yards and parking facilities,
may not be enlarges or altered or rebuilt unless :
a. Such enlargement provides for a permitted use containing
no more family dwellings than now exist.
b. Any additions are constructed within the applicable yard
requirements.
VARIANCE REQUESTED: 3. 10 . 9 b. Front Yard, Side Yard
This house was constructed over thirty-three years ago, in 1957 .
The limitations specified in these regulations were not in effect at
that time . The fact that certain regulations were adopted after a
house was built places that house in the unique circumstance of
being non-conforming . The Owner/Applicants made no contribution
toward placing their home in this situation, therefore, they should
not be penalized in their attempt to improve their property.
S E C T I O N - 5 . 2
VARIANCE REQUESTED: Front Yard - Per Regulations 40 . 0 '
- <Front Yard Requested 25 . 51 >
- Variance Requested 14. 5'
The house was originally constructed with a front yard set-back of
25 . 51 . This is consistent with the neighboring houses that were
constructed during the same period, ( 1957 ) . By incorporating the
garage addition on to the existing garage it is both necessary and
practical to maintain the fronts of the existing and added garages
on the same plane . If, this variance is not granted the front of the
new garage will be located 14 . 5 ' to the rear of the front of the
existing garage resulting in a architectural oddity.
VARIANCE REQUESTED: Side Yard - Per Regulations 10 '
- <Side Yard Requested 61 >
- Variance Requested 4 '
The house was originally constructed with a north-side side yard of
201 . The garage addition is to house a pickup truck that requires
an- overhead door width of 9 ' . Such an addition should be a minimum
of 12 ' wide with a potential of 14 ' wide, thus the request for the
4 ' variance . The rear yard of the house lot can be accessed by the
south-side side yard which is 18 . 41 . If the variance is not granted
the garage cannot be built wide enough to accommodate the required
9 ' wide door .

ZONING BOARD OF APPEALS
VARIANCE REQUESTED: Impervious Coverage - Per Regulations 15%
- <Impervious Requested 23%>
- Variance Requested 8%
The current impervious coverage is 3, 460 s . f. or 17% of the 20,000
s . f. lot. Of the 3, 460 s. f. impervious coverage, 1, 560 s. f. ( 7. 8%)
is the house and 800 s . f. ( 4%) is the above ground pool . The
proposed house addition will increase the building size by 1, 396
s . f. for a total area of 2,956 s . f. which is less than the allowed
3, 000 s. f. ,however, the total proposed impervious area will be
4, 460 s . f. or 23% which is 8% in access of the maximum 15% allowed.
If one discounts the temporary above ground swimming pool, that
accounts for 18% of the impervious area, the resulting proposed
impervious area is 3, 660 s. f. or 18%. If this variance is not
granted the impervious coverage will still be 17% and the
Owner/Applicant will be deprived of the benefit of substantial
improvements to their property . Further, the neighborhood will not
realize the improvement in property values that will result from the
addition of a refurbished 2, 956 s . f. ranch style house with a two
car garage.
