South Windsor.Town Hail PRESENT: Cottle, Murrin, Warren, Murray (for Steben) , Dzikiewicz (for Eriksson) Application #16Y9-86 - R1r1R Associates Attorney John Casey appeared before the Board representinc this application. He described the location of the property. He said the buildings in this area on Ellington Road were legal when they were built, but the zoning has since changed. Therefore, they are non-conforming permitted 'uses. He said RWR Associates would like to utilize the existing building. It is attractive and will help maintain the colonial atmosphere of the area. Attorney Casey said that one of the partners, William Urso, and the Engineer, J. E. Page, were present this evening. It was noted for the record that no one spoke in favor of or in opposition to this appeal. In reply to questioning from the Board, Mr. Casey said that the shed on the property has been removed, and the house in the driveway location will also be removed. He also stated that this application has not been acted upon by the Plannino and Zoning Commission yet. However, they have conferred with Mr. DeMallie and :Mr. Martel of the Town Staff. mr. Warren commented that the addition was larger than the original house. Mr. Casey said his client still feels that the original house sets the "tone" for the property. He said he feels it is always a good idea to keep an existing structure if you can. Mr. tMurrin asked if there were building elevations yet. Mr. Page said they were not that far with the plans. He said the building will blend in with the surroundings. Application #1650-86 - Rose M. Martinelli and Joseph Martinelli Mr. ;Martinelli appeared before the Board. He said the house is presently non- conforming. He said when the house was built it was in an A-20 Zone, and now the zone in that area of Foster Street is RR. He said he also wishes to build an addition to an existing garage because the fireplace extends into it, and now it is too narrow to be able to put in a second car. He noted that he had no other location on the property to put a garage. It was -noted for the record that no one spoke in favor of or in opposition to this application. ,Mr. Warren asked about the sign advertising the hearing. Mr. Martinelli said he Put it up on time, but it blew across the street. He then put it up again closer to his house. Mr: Warren said he drove by and did not see the sign. Mr. Martinelli said he felt the sign was up most of the time. i1r. Ilurrin asked what the closest neighbor's feelings were. iMr. .14artinelli said she had no objections. He noted that she also had a variance, and he had not hjected to that. Application I,E1650-86 - Rose M. Martinelli and Joseph Martinelli Mr. Dzikiewicz moved to grant a variance to Section 3.10 of the Zoning Regula to allow a garage addition to a non-conforming house and to grant a variance Section 5.2 of the Zoning Regulations to allow an addition within the existi side yard and to correct variances for front line on two sides at propert located at 857 Foster Street, South Windsor (RR Zone) , y In granting this variance, he noted that the installation of a fireplace ren the present garage too narrow for its intended use. He also noted that this house was built prior to the present zoning requirements. Mr. Warren lrx med that even though the house next door also had a variance, there was ample room for emergency equipment to these lots from Saginaw g Stre The motion was seconded by Mrs. Cottle, and voted unanimously in favor. Application #1651-86 - Pasquale J. Salemi, Sr Mrs. Murray noted that if there were a problem out in full force. She, therefore, assumed that lthishproposalors was ohky wit feet. The Board established that it was still 150 feet. It was noted that Mr. Sheehan had said the A-40 lot width requirement waw t sil 2 Mr. Murrin said he is bothered by two big departures: 1 lots with 50 foot frontage on the street, and 2) five under-widtholots one th street with no justification except financial. He said open space subdivisi were intended to address the problem of unbuildable pieces. The land trust discussed. Mr. Murrin did concede that the land trust would effectively do the same thing as an open space subdivision. Mrs. Murray said that sooner or later doing something with rear acreage wi have to come to South Windsor. She said this property used to be tobacco la Mr. Warren said he felt there was a hardship other than financial for the lots on Chapel Road, and he noted that with 400 foot depth, they are still acre lots. Mr. Murrin said he has a problem with five lots with 100 foot fr Mr. Warren moved to approve this application as e seconded by Mrs. Murray, Warren, Murray and Dzikiewiczin favor; Cott was le an Murrin opposed. The motion was defeated since it failed to gain the tnecessa four affirmative votes. EFFECTIVE DATE: March 22, 1986 Application 461652-86 - Abbev Road Associates The Bord reviewed the letter from the Planning Department and confirmed tha this provision was already in the Zoning Regulations under 5.3.C.2. It was also determined that the parcel met the minimum requirement for an open spac subdivision of 15 acres. Mr. Warren moved to grant a variance to Section 5.3.0 of the Zoning Regulati to allow relief from 10 acre minimum open space requirement at property, consisting of 15.89 acre* located on Abbey Road, between Miller Road and Woo Pond Road, South Windsor " (RR Zone) . The board noted that the hardship is because the garage was inadver- tently constructed in violation of the variance originally granted because of the misinterpretation of the variance letter received in March, 1986. The board also noted that they felt this was an honest mistake in figuring out the original variance.
