Dear Attorney Novak:
Re: 130 Buckland Road (William Krawski), Zone Change Request
At the request of Mr. William Krawski, 130 Buckland Road, South Windsor, please be advised that Mr.
Krawski has an application pending with the Planning and Zoning Commission for a zone change from
AA-30 (residential) to Restricted Commercial for property located at the above-referenced address.
The public hearing for this application was originally expected to occur on July 12. However, upon
receipt of the zone change map it was discovered that a small portion of Mr. Krawski's property is
located within 500 feet of the Town of Manchester, thereby requiring the statutorily-imposed notification
to the Capitol Region Council of Governments and scheduling of the public hearing no sooner than 35
days after that notification. This application was officially received by the Planning and Zoning
Commission on June 14, thus making it impossible for us to meet the statutory notification and
scheduling requirements by July 12. The public hearing has been rescheduled to July 19.
If you have any questions, please do not hesitate to contact me at 644-2511, ext. 253.

TOWN PLANNING AND ZONING COMMISSION REPORT ON ZONING REFERRAL
TOWN OF SOUTH WINDSOR #94/63
COMMISSIONERS:
Receipt is acknowledged of the above-numbered referral. Notice of this proposal was
transmitted to the Planning Division of the Capitol Region Council of Governments
under the provisions of Section 8-3(b) of the Connecticut General Statutes, as amended.
The referral involves proposed zone change from AA-30 (Limited Residential) to RC
(Restricted Commercial) on a parcel of land located north of Buckland Hills Drive, east
of Buckland Road, abutting the South Windsor/Manchester Town Line.
Comments:
The staff of the Regional Planning Commission of the Capitol Region Council of
Governments has reviewed this referral and finds no apparent conflict with regional
plans and policies or the concerns of neighboring towns.
If this zone change is granted, the Commission should ensure that abutting residences
and residentially zoned parcels are sufficiently protected with buffer areas. The
Commission may also wish to consult with the Town Attorney on whether this
rezoning could be considered.-,o
Questions concerning this referral should be directed to Carol Szymanski.
In accordance with our procedures this letter will constitute final CRCOG action on this
referral. The public hearing date is scheduled for 7/19/94.

KRAWSKI ZONE CHANGE PH 7/19/94
ft
1 . Request for a zone change from AA-30 to RC for about 16
acres on two newly-created lots on the east side of Buckland
Road. Property to the north of the subject property is zoned AA-
30; property to the east and south are zoned AA-30 and Designed
Commercial; and property across Buckland Road to the west is
zoned Rural Residential .
2 . The recently-adopted Town Plan contains the subject property
in the Buckland Road Gateway Development Area, which is
designated for high-quality economic development. (Copy of the
relevant page has been provided to each Commissioner. ) The
Commission has directed Town Staff to develop new zoning
regulations for the Buckland Road Gateway Development Area in
accordance with the guidelines in the new Town Plan; however, if
this property is rezoned to Restricted Commercial, it will not be
subject to the new zoning regulations, but rather will be subject
to the existing RC zoning regulations . If the Commission gr nts
this zone change request, the applicant should be aware t4tft-E
-C riee-ion—wii±- expect-- any--devre-iopment
the guidelines in the new Town Plan for the Buckland Road Gateway
Development Area .
3 . The existing AA-30 zone allows single family residences, some
farm uses, housing for the elderly, schools and churches , and
uses providing essential community services . The requested RC
zone would allow offices, retail stores , restaurants, hotels , and
some personal service shops . Day care centers, senior residence
developments, and commercial uses that the Commission considers
to be similar to the listed permitted uses are uses permitted by
special exception.
43 . Public water is available in Buckland Road. There is no
public sewer in Buckland Road. The Water Pollution Control
Authority is in the process of finalizing the contract with the
consulting firm that will be performing the sewerage feasibility
study for Buckland Road. The firm' s estimated time frame for
completing the feasibility study is about 12 weeks . At the end
of the study, WPCA anticipates having a sewerage concept plan for
Buckland Road. One of WPCA' s main objectives is to determine
whether, and to what extent, Buckland Road sewerage can be
gravity fed; . if not, what alternatives are feasible . It is clear
from the WPCA meeting minutes that Joe Carino has been keeping
WPCA well informed regarding PZC' s goals and concerns for the
Buckland Road area.
_t. There are regulated wetlands on this site. IWA/CC approval
will be required for any development.
lei . Buckland Road reconstruction is scheduled for completion in
September. The consultant for the access management plan is
expected to be on board this summer, with a 12-18 month study
duration. The applicant should be aware that, even before the
access management plan is in place, location and number of curb
cuts will be a primary concern for site development.
16 . If this application is approved, there will be buffer
requirements along the entire perimeter of the site, including
along Buckland Road frontage since the property across Buckland
Road is zoned residential . The buffer requirement along the road
frontage is generally a deterrent to commercial site development,
since commercial uses usually require street visibility.
Applicants proposing to develop commercial sites across a street
from residentially-zoned land generally approach ZBA for a
variance to the buffer along the street frontage.
