Warren, Chairman, IWA/CC FROM: John E. McCahill, Zoning/Wetlands Enforcement Officer RE: Application #93-52P, Helmar Wolf & Arturo Guerra (Beldon Road/Ellington Road) DOCUMENTS REVIEWED: Application form and Plan Prepared for Helmar Wolf & Arturo Guerra (dated 9/21/93 ) , revised 12/10/93 DATE: December 22, 1993 COMMENTS: 1 . Application #93-47P was withdrawn on December 1, 1993 . This plan, as submitted, includes modifications to the previous plans as suggested by Town Staff . 2 . The application form, item G, indicates abutting property owners have been notified by certified letter that an application is pending. A sample copy of the letter has been submitted. 3 . Note #9 , sheet 3 of 5, states "inland wetlands field verified by John Ianni, Soil Scientist of Highland Soils on September 11, 1990" . John Ianni should verify the limits of the wetlands as shown on the plans and a report of his findings should be submitted. 4 . The proposed limits of clearing are shown on the plans . The symbol for the proposed tree line should be included in the legend. Note #2, sheet 5 of 5, states "developer' s surveyor to clearly mark clearing and grubbing limits" . Note #18, sheet 3 of 5, states "stumps are to be chipped on site or they shall be removed from the site and properly disposed of" . 5 . As indicated in the Zoning Data Block "a variance was granted to Section 10 . 1a of the Zoning Regulations to allow a residential building lot on property located on the west side of Beldon Road, north of Podunk River, on February 6, 1992" (appl . #2033-92 ) . Elizabeth A. Warren - 2 - December 22, 1993 Application #93-52P Section 10 . 1a addresses the "buildable area" requirement. As a variance was granted they should not be showing a 90 , x 90 , buildable square. 6 . The plans have been submitted at the scale of 1" equals 201 . 7 . It would appear that the 12" ACCMP (pipe) under the proposed driveway might not be necessary. It would seem that they could accomplish the same drainage by adding a catch basin to the existing 24" RCP (pipe) . If they determine that the 12" ACCMP (pipe) is needed, a detail should be added showing how it will be tied into the existing headwall . They would also need to ensure adequate cover over the inlet end of the pipe. 8 . The discharge area (channel) below the existing headwall at the Beldon Road/Ellington Road intersection is not very stable and has been subject to past erosion. They should consider the use of filter fabric and rip rap in this area. The plans indicate "existing rip rap area" . Based on field observation ( 12/16/93 ) this does not appear to be rip rapped although, there are signs of past dumping of asphalt fragments along the westerly side of the channel . 9 . There is at least one area where the proposed slopes appear to be greater than 3 : 1 ( 3 horizontal to 1 vertical ) . Note #15, sheet 3 of 5, states "Maximum slope of any cut or fill areas to be 3 : 111 . Slopes should be reduced where appropriate (particularly southwesterly of the proposed house where they are approximately to 2 : 1 ) . 10 . Note #10, sheet 3 of 5, states "public water service may be available to site from Ellington Road. " How would this line be brought to the house? Is a well being considered? 11 . Revised plans, and additional information, should be submitted to Town Staff for review prior to presentation of the application to the Commission. JEM/pmm ■ ,?esigoofessionals, inc. uAUCI DS. Messrs. DeMallie and Perna have apprised us of the nature of your discussion, and we submit the following: 1. Arturo Guerra and I purchased this property, known as the Podunk Farm, in the mid-1980's, with the intention of building a residence on a 1 1/2 acre lot at the corner of Beldon and Ellington Roads. We bought the property from Skip Daly, who told us there used to be a house and driveway where we would like to build. We were also informed at the Town Hall that we could build a house there, and we would conform to the A-20 zoning requirements. 2. Subsequent to this purchase, the buildable square regulation was adopted. We had a demonstrated hardship, and the Zoning Board of Appeals granted us a variance on February 6 of last year. 3. After receiving Town Staff comments on our original proposal, we withdrew the application and asked our engineers to substantially reduce the size of the house, garage, driveway and filling. This resulted in a plan that now has no inland wetlands nor flood plain involvement, and has less activity near the wetlands. 4. This is a buildable lot. It is served by public water and sewer. The basement will be 6 feet above the 100 year flood plain, and the first floor will be some 15 feet higher. 5. The Town has a 24" drainage pipe across the front of this lot, with no easement. I agree to grant to the Town an easement to correct this problem. 6. The Town WPCA requested access rights to the public sewer line on our property, and we recently granted the Town an easement to correct this problem. 7. We agree to install rip rap in the vicinity of the headwall, but only if the rip rap scheduled for the 30 lot Beldon Road subdivision is not completed. We have every expectation that this bonded improvement will be done, and I was recently informed that JMJ has hired a separate contractor to perform the work. We have recently granted the Town an easement for this drainage and rip rap work. The State and Town have been discharging drainage here for decades. 8. We have been mowing the meadow on this lot 3 or 4 times annually, and we have not fertilized it. 9. We are not favorably disposed toward an outright prohibition on the use of fertilizer anywhere on this lot. This watershed covers many square miles, and tons of fertilizer is applied annually, much of which enters the Podunk. At the restaurant we spend thousands of dollars each year to control the nutrient problem. At a minimum, we would like to be able to apply fertilizer around the house. We agree to restricting fertilizer use in the meadow. 10. If the Inland Wetlands Agency insists on a conservation easement, we would prefer that it be no wider than 25 feet along the Podunk River, with allowance for some shrub and tree cutting to preserve the river views, and for a possible future footbridge across the Podunk.
