Dear Mr. Zieky:
Re : ZBA Application #1792-88 - general Building Supply Company
At the March 10 , 1988 meeting of the Zoning Board of Appeals,
a variance of approximately 25 feet was granted to Section 5. 4
of the Zoning Regulations -to allow development with less buffer
than required on property located at the northwest corner of
Burnham Street and Route 5.
T%e board noted the hardship being that the adjacent commercial
property and the configuration of the adjacent lots make it unlikely
that residential development will occur close enough to require the
full buffer.
This action is effective "larch 25 , 1988 and upon your filing of
the enclosed form in the Town Clerk ' s Office at your expense.
Very truly yours,

Zoning Board of Appeals Minutes :C3c March 3, 1988
f
Application #1791-88 continued:
Mr. Eriksson asked if Mrs. Petersen' s appeal would be dropped if
a variance was granted? Mr. Wise said there was a good possibility
that it would.
'_sir. Grace said the Mobil Station had no objections to this appeal.
Mrs. Anthony asked if the planting plan was for aesthetics or for
a buffer? Mr. Grace said for aesthetic purposes.
With no further discussion, the public hearing on this item was
closed.
Application #1792-88 - GR Realty - General Building Supply Co.
Attorney Lew Wise was present, representing the applicant. He said
they are proposing to construct a 26 ,900 s. f warehouse on this
property and to transform the old trucking building which is presently
on this property. They are looking for a variance for this project
to conform to the old buffer regulations. He said if they go by
the new regulations they will lose 4 ,000 s. f. of warehouse space.
He said because of the trucking terminal and the layout of pavement
for the trucks , this is the only location for the warehouse. He
said they plan to improve the appearance of the trucking building
along with removing some of the pavement in the front and replace
it with plantings. He said they have been working on this project
for some time.
Mr. Peter DeMallie, from Design Professionals , was present. He said
much time has gone into this project to find a practical location and
determining the proper size needed of the warehouse. He said the
pavement will be removed in the front and landscaped to improve the
appearance from the residential area across the street.
No one in the audience spoke in favor of or in opposition to this
appeal.
_Mr. Eriksson asked if these plans had been filed with PZC yet and
was told they had not.
Mr. Murrin asked if more property could be purchased on the west to
make this plan in compliance? Mr. DeMallie said the property to the
west was in a RR zone, thereby requiring them to get a zone change.
He said they were not even sure the property could be purchased.
Mr. Elliot Zieky, from GR Realty, was present. He said General
Building Supply Company--will rent this warehouse from GR Realty.
Mr. Wise said the only area that needs a variance is in the northwest
corner of the property.

Application #1792-88 - GR Realty - General Building Supply Co. Continued:
Mr. Murrin asked what type of buffer plantings were presently being
proposed? Mr. DeMallie said two rows of staggered white pines, which
is typical for a buffer.
With no further discussion, the public hearing on this item was closed.
Application #1793-88 - Charles R. Eastwood
Mr. Charles Eastwood was _present. He said he needs an 8 foot variance
to add an addition to his house, which would consist of a family room,
bathroom, and two car garage. He said his lot is 100 feet wide.
He said when his house was built the setback was 10 feet. He said
the other boundary is 10 feet from the house. He said this is the
only way he can go. They will replace the carport with the new
addition.
No one in the audience spoke in favor of or in opposition to this
appeal.
Mr. Eriksson asked how close the house adjacent to his property was?
Mr. Eastwood said not very close. He said his neighbor recently
received a variance to add an addition to their house which is 15
feet from the property line . and is setback further from the road.
He said his house does not line up with theirs. He said all of the
lots in this area are 100 feet wide. He said his neighbors have no
objections to this appeal.
Mr. Warren noted that Mr. Eastwoods house is non-conforming to the
new regulations and he should at some time file an application to
make the house conforming. Mr. Eastwood said he would do that at
another time. He wanted this variance first so he could get things
started.
With no further discussion, the public hearing on this item was
closed.
Application #1794-88 - Capuano Developers - Lot #14 , Governor' s
Square
Attorney Peter Alter was present, representing the applicant. He
said they are seeking a variance to the new buffer regulations
for lot #14 of Governor' s Square and for a reduction in the parking
spaces required. He said Governor' s Square consist of approximately
77 acres on the southerly side of Governor' s Highway with two buildings
presently being built on sites #2 & #7. Lot#14 is in the extreme
easterly corner of the parcel. Because this parcel is across the
street from a A-20 Zone and to the side of a RR Zone they are being
required to have a 100 foot setback, 50 feet of which must be for a
buffer. that would visibly hide the building within 5 years. The

Application #1790-88 - Earl Reichle continued:
it would have to be a stand that would be of a removeable nature
with ample off-street parking.
After a lengthly discussion, motion was made by T. Murrin to grant
a two-year temporary & conditional permit for a temporary and
removeable roadside stand as defined in Section 4 . 1. 4b of the Zoning
Regulations with use permitted for 8 months in each of the two years.
The stand should be 40 feet from the road with ample off-street
narking provided. The plans presented with the application for a
variance, which was not approved, was not of a temporary and removeable
nature. Motion was seconded by M. Anthony. All voted in favor.
Unanimously carried.

After a brief discussion, motion was made by T. Murrin to deny without
prejudice a request for a variance to Section 8. 4 of the regulations
to allow a reduced number of parking spaces as required and granted
the requested variance to Section 5.4 of the buffer regulations sub-
ject to the condition that the intent of the buffer regulations
regarding the kind of plantings and purpose of the buffer zone will
be complied with as close as possible within land available as shown
on the man.
The board noted the hardship to be that subjecting a site as small
as this one to too much buffering would make the site unusable, losing
an unacceptable amount of land. They also noted that the site plan
was submitted to PZC prior to these new buffer regulations being
placed in effect.
Motion was seconded by M. Anthony • All voted in favor. Unanimously
carried.

a variance to Section 8. 4 of the regulations for a reduction in the
required number of parking spaces on lot #14 , Governor' s Square, and
granted a variance to Section 5. 4 that a 50 foot frontyard be added
to the 50 foot buffer zone; the variance will require only a 40
foot frontyard to be added to the 50 foot buffer. The intention is
to allow the building as shown on the map but to prohibit the 20
parking spaces shown in the required buffer zone. It was suggested
that the parking be rearranged in the buffer zone and moved from the
buffer zone to comply with the intent of the regulations. The
variance is only for the northerly side of the property across from
the three residential homes and extends westerly only to the edge
of the westerly residential zone. '_`Motion was seconded by L. Neary.
All voted in favor. Unanimously carried.
The board noted the hardship to be that just a small portion of the
property is across from a residential zone requiring the strict
buffer. The balance of the property is in Industrial or Industrial
