Grace, Esq. 25 Oakland Road South Windsor, CT 06074 Dear Attorney Grace: At the June 13, 1985 public hearing you indicated that your clients, B & B Associates, Inc. , have not attempted to purchase or trade land with the abutting owner in order to accommodate their addition and canopy and make this property conforming. The Board wished to give B & B Associates, Inc. an opportunity to investigate this option before taking action. Therefore, the application was tabled until the July 18 , 1985 meeting. In addition, the Board would like more information on how this error originally came to be in order to prevent a possible repetition of this kind of mistake. Please provide our secretary, Mrs. Cote, with this information prior to the July 18 , 1985 meeting. If you have any further questions, I can be reached most evenings at 644-8426 . Request for variance Dear Board Members: Please find enclosed correspondence from Palmberg & Russo, Engineers, which formally explains the reason for the error regarding the placement of the newly constructed building for B & B Associates . Also enclosed is a letter from Mrs. Barbour, the President of B & B indicating her attempts to pur- chase land on the easterly boundary of the corpor- ation' s property. Negotiations are continuing and expect that two (2) feet will be purchased at a substantial price from the adjoining property owner. We also expect that it will take sometime for new mapping, further approvals, etc . We expect that this purchase will satisfy the adjoining land owner. As indicated by Mrs. Barbour, it is extremely impor- tant that the variance be granted for the companies financing of the new building . The granting of the variance will in no way eliminate the completion of the purchase of the adjoining land. The applicant would be pleased to appear at the board' s hearing if requested. Your kind consideration is appreciated. Very truly yours, e /a4m W. 1 40 0 William E. RUSSO, PROFESSIONAL ENGINEER June 27 , 1985 William E. Grace, Esq. 25 Oakland Road South Windsor, Conn. 06074 Dear Bill, We have reviewed all our records pertaining to the B&B building, and our findings are as follows: In 1982 we prepared a site plan for the addition to the existing building and our distance to the side line on the easterly side as shown on that plan is 64.5 feet and it should have been 61.5 feet. It appears from studing the original drawing that the draftsman misread the 61.5 feet as being 64.5 feet. When this latest site plan was prepared the new building dimension was 70 feet which included 16.5 feet of the existing building so that gave an offset to the property line of 81 feet (64.5' + 16.51) , and when the new dimension of 70 feet for the new addition is subtracted from 81 feet it leaves a distance to the side line of 11 feet as we have shown. If we had used the 61.5 feet which is correct we would have known the pro- posed addition would be too large or a variance would be required. Our records indicate that we did not stake the proposed addition for con- struction. If we or someone else had, then the error probably would have been found and corrected before construction started. I would like to say that since I started practicing as a land surveyor in 1971 that this is the first time I've had this problem and I do not know how to prevent human error. We have a system of checks and balances to help eliminate this type of error, but unfortunately this one got by. Sincerely, William R. Palmberg Palmberg & Russo WRP/dto July 5, 1985 Town of South Windsor Zoning Board of Appeals South Windsor, Ct. 06074 Dear Board Members, We are presently making an attempt to purchase land on the westerly side of property owned by Louis Treglia to bring our easterly bound- ary into compliance with the South Windsor zoning laws . We ask that the variance be granted so we may proceed to complete the mortgaging process of our Connecticut Development Authority Industrial revenue bond. We have time limitations that require an early positive decision by the Board. We will make every effort to complete the purchase of the land necessary but, we expect it may take an extended period of time for re-surveying and board approvals before the actual closing can take place. Grace, Esq. 25 Oakland Road South Windsor, CT 06074 Re: Application #1617-85, B & B Associates, Inc. Dear Attorney Grace: This is to notify you that the above-named application to the Zoning Board of Appeals requesting a variance to Section 5 .2 of the Zoning Regulations to allow construction 2 1/2 feet closer to the side yard than permitted at property located at 31 Edwin Road, South Windsor, has been granted. In granting this approval the Board noted that a hardship was created by a surveying error which caused a condition that was unreasonably difficult to rectify without recourse to a variance. It was also noted that two-feet will be purchased from the adjoining property owner, and that granting this variance to complete the mortgaging process will not stop the purchase of the adjoining land. This action is effective August 2, 1985 , and upon your filing the enclosed form in the Town Clerk's Office. Very truly yours, ZONING BOARD OF APPEALS By i iwt c In Thomas Murrin, Chairman TM/src emc;/
