for the premises, a copy of which is attached as exhibit A. The garage
building located on the premises was constructed many years agog Prior
to the widening of U.S . Route 5 . As a result of the widening of U.S .
Route 5 the roadway was extended closer so that, as shown on the map,
the building line actually bisects the building. Therefore, the
building itself is nonconforming.
The requirement of parking the vehicles behind the building line,
therefore, requires that most of the vehicles be placed behind the
building which is dark, unlighted and not secured. over the years
applicant has made numerous complaints to the police concerning theft,
vandalism and other damage done to the automobiles parked to the rear
of the building. In addition, due to the fact that Route 5 is a four
lane divs)ded highway the State of Connecticut reserved wide shoulders
in addition to the paved portion of the road. Therefore, the combination
of the building being forward of the building line and the wide shoulders
of the highway make it impractical for applicant to reasonably secure
its vehicles.
In 1978, the zoning board of appeals granted a two year temporary
conditional permit effective February 15 , 1978, to allow one row of cars
not exceeding 15 cars to be parked in front of the building line provided
not more than 25 cars in all would be parked on the premises. The pro-
blems concerning vandalism and theft of vehicles has not improved and since
applicant intends to be occupying the premises in substantially the same
manner as it has over the last six years, applicant requests a variance
upon the same terms and conditions as was allowed for the prior temporary
conditional permit. In the event the variance is granted then applicant
would resubmit a new plan of development to the Planning and Zoning
commission.

I axr writing to you now concerning your operation at the above
address. Upon instection on October 20, 1980 and October 27, 1980,
it was revealed that you are in violation of the terms of Appeal
#1232--78, plus the temporary and conditional permit has expired.
You are hereby ordered to file the necessary applications for the
Board of Appeals on, or before, November 18, 1980 for the meeting
of December 4, 1980, otherwise I shall refer these violations to
the Town Attorney for legal action.
I trust that you will adhere to this order to prevent any further
action.

Dear Don;
As you may recall, I spoke to you around the middle of October to
indicate that Mr, Treglia had been in contact with me with respect
to filing the necessary Zoning Board of Appeals application for
additional temporary conditional permits with respect to the above
premises, Unfortunately, as a result of business pressures, political
activities, and illness, I simply did not process the file in as timely
a manner as I should have. Therefore, any responsibility for any delay
in Mr. Treglia' s response to your notice to him that such an appeal to
the Zoning Board of Appeals was required is entirely my fault, not his.
Please rest assured that I have placed this file in a top priority status
and hope. to have the Zoning Board of Appeals application for additional
temporary and conditional permits filed with your office before the end
of November,
