South Windsor, Ct.. 06074 Dear Mr. and Mrs. Zettlemoyer: One of our members, Mr. Wayne Gerlt, informed us after the public hearing on December 6th, that he was distantly related to you by marriage, and therefore, declined to vote on this matter. The matter will have to be re-heard with an alternate sitting, and we have scheduled the matter for January 3rd, 1980, at 7:30 p. m. Will you please arrange to be present at that time? Yours very truly, vg Robert W. Warren, Chairman Zoning Board of Appeals ZONING BOARD OF APPEALS JANUARY 3, 1980 TOWN HALL, SOUTH WINDSOR, CONNECTICUT 7:30 P. M. MEMBERS PRESENT: Warren, Eriksson, Steben, Gerlt, Murrin ALTERNATES PRESENT: W. Paul Cote' (sitting for Gerlt on Application 1346-79) This hearing was held in the caucus room in view of the fact that the Town Council was using the Council Chambers. Mr. Warren announced that the correct zone on Application No. 1353-79 was GC rather than I as indicated in the legal notice . APPLICATION No. 1346-79 - CARLTON L. ZETTLEMOYER, of 191 Newberry La., requests a variance of Article 5.2, Section 5, to allow construction closer to the sideline than permitted on premises known as 191 Newberry Road, Zone A-40. Mr. Zettlemoyer had appeared before this Board last month, however, Mr. Gerlt declined to vote on the matter since he was distantly related, and Mr-. 'Zettle- moyer had been asked to return to this meeting with an alternate sitting. He stated he wished to build a two car garage which will be 22' x 32' , and also add a breezeway to the house. He said the oversized garage would be used to store 'snowmobiles. The previous garage was 22' x 22' . There is approximately 42' between them and the house next door, and a variance of 4.1' was required. The lot is heavily treed, and there is a slight incline. Mr. Eriksson questioned Mr. Zettlemoyer as to whether or not a business was being operated from these premises and Mr. Zettlemoyer said no, that he simply had a phone answering service, and may occasionally store a few plumbing fixtures in the house. Upon questioning he stated the sign had been up for almost two months, and none of the neighbors have objected. No one spoke in favor or in opposition to this request. APPLICATION NO. 1345-79 - GREGORY L. MC FETRIDGE, 970 Ellington Road, requests a variance of Section 4.3 to allow dead storage in an existing building on premises known as 970 Ellington Road, in an A-20 zone. Mr. McFetridge appeared before the Board and stated that he owns- 12 acres of land across the road from the Podunk Restaurant, and there are two old tobacco barns on the property. He has a prospective tenant who wished to rent a barn to store two Hudson automobiles. He noted there may be as many as five old cars stored at one time, and said the cars are only taken out for automobile shows. He stated they would not be operating a business, and no gasoline or flammable material would be stored in the barn. He mentioned that the wood floor of the barn has been shored up to support the weight of the cars, and presented a copy of the lease to the Board. No one spoke in favor or in opposition to this request. APPLICATION NO. 1348-79 - CHAPEL HILL REALTY, INC., 626 Ellington Road, requests a variance of Article 5, Section 5.2 to allow a building lot with less than required frontage on premises on the north side of Ellington Road, in an RR zone. Attorney Thomas Dennis appeared and stated he had been before this Board a few months ago to secure a variance on this lot, and since that time the lines have been redrawn , and they need an amendment to the variance that was previously -2- i Zoning Board of Appeals 1/3/80 i granted. He said the width of the lot at the building line is 150.74' and the regulations require 175' . Therefore, a variance of 24.26' is needed. He said a house will be moved onto this lot, and it is the only lot in the area where it can be moved since they can't turn a corner because of trees and poles. No one spoke in favor or in opposition to this request, however, Mr. James Greeson questioned Mr. Dennis about who owns the property. Mr. Dennis said it was owned by Elmore, and Chapel Hill Realty owned the house that was being moved. Mr. Greeson asked if there would be at least 20' on each side line, and Mr. Dennis said yes. Mr. Greeson noted that his barn on the adjacent property would be quite close to the house, and since it was two stories high would overpower the house. Mr. Dennis noted that the house right .now is next to a two story colonial and doesn't look too bad. APPLICATION NO. 1349-79 - JOHN T. WHOLLE Y, 1906 Main Street, requests a variance of Article 5.2, Section 5, to allow construction closer to the rear line than permitted on premises known as 1906 Main Street, A-40 zone. Mr. Wholley appeared before the Board and stated he wished to add a family room to his house which was built in 1762 and is located between Main Street and John Fitch Boulevard. The addition will be 20' x 17' , and has been approved by the Historical District Commission. The addition will come to approximately 5' of the highway line. No one spoke in favor or in opposition to this request. APPLICATION NO. 1350-79 - FRED J. SCHILYE, 488 MillerRoad, requests a variance of Article 5.2, Section 5, to allow construction closer to the side and front building lines than permitted on premises known as 488 Miller Road, Zone RR. Mr. Schilke appeared and stated that since he moved into the house in question 1 in 1976 they have increased their family and now it is a family of six, and need more room. They would like to turn the existing garage into a family room and move the garage forward. They've explored the possibility of adding to the house in some other fashion, but it is not practical due to the location of the septic system, and also the design of the house. He noted that the zoning regulations have changed since the house was built, and that none of his neighbors objected to the proposed addition. He said he needed a 13' variance on the front, and 8.5' on the west side. He noted that the nearest house on one side was about i 20 f t. away, and on the other side about 40 f t. No one spoke in favor or in opposition to this request. } APPLICATION NO. 1351-79 - STRANO REAL ESTATE, 172 E. Center St. , Manchester, 1 requests a temporary and conditional permit to allow a sign larger than Article 4.1.5 permits on the Frank Muzikevik Farm on Avery Street until it is sold, ( in an RR z one. No one appeared on behalf of Strano Real Estate. APPLICATION NO. 1352-79 - Electro-Methods, Inc., P. 0. Box 54, South Windsor, requests a variance of Article 4.4.3, Section 4.7.4.3. to allow a sign larger -3- Zoning Board of Appeals 1/3/80 than permitted on premises known as 330 Governors Highway, I zone. Mr. Alfred Stanger appeared and stated he was a partner in this business, and they felt a sign similar to the Industronics sign would identify their business better. They noted people have had difficulty in locating them. The proposed sign would be about 4' high, 12' long, and about 2' thick with their logo on it. Since they have a second shift they would like the sign illuminated. He noted they are about 500-600 feet from Route 5. No one spoke in favor or in opposition to this request. APPLICATION NO. 1353-79 - ALBERT AND MARIAN KOWBROSKY, 140 Chestnut Street, Suite 314, Springfield, Massachusetts, requests a State Hearing under 14-54 of the General Statutes for a General Repairer's License to operate a body shop on premises known as 395 John Fitch Boulevard, in a GC zone. Mr. Kowbrosky appeared and stated he was leasing property at 395 John Fitch Boulevard for the purpose of running an auto body shop called Corvette City Auto Body, where they would work on Corvettes. He said he previously was in Windsor Locks for three years and the business was destroyed by the tornado . He noted that much of the work will concern fiberglass , and that they would put up a fence if necessary . No one spoke in favor or in opposition to this request. Mr. Eriksson asked if this was the Ram building, and Mr. Kowbrosky said yes. Mr. Eriksson noted that the place was an eyesore, run-down and ill-kept and said he felt if approved it should go before the Planning and Zoning Commission for approval of a site plan of development. The rest of the Board agreed, and Mr. Warren told' Mr. Kowbrosky that it is normal for new businesses in town to appear before the Planning and Zoning Commission. WORK SESSION Application No. 1346-79 - Carlton L. Zettlemoyer The Board noted that the neighbors had no objection to the addition, and that Mr. Zettlemoyer had stated he was not running a business from this location. Mr. Murrin moved to approve application 1346-79, Carlton L. Zettlemoyer of 191 Newberry Lane, requesting a variance of Article 5.2,Section -5, to allow construction closer to the sideline than permitted on premises known as 191 Newberry Road, Zone A-40. The variance will be for 4.1' on the east side. The Board feels the location of the house and driveway make the location of the proposed garage the most feasible. Mr. Steben seconded the motion. Warren, Eriksson, Steben, Murrin andCote' in favor. None opposed. The motion was unanimously approved. Effective Date: January 16, 1980 -4- Zoning Board of Appeals 1/3/80 Application No. 1345-79 Gregory L. McFetridge The Board agreed that they would like to have more control over a situation such as this, and felt that the request should be denied since a variance would remain with the property permanently. It was felt the proper way to handle this situation would be with a temporary and conditional permit. Mr. Eriksson moved that application No. 1345-79, Gregory L. McFetridge, requesting a variance of Section 4.3 to allow dead storage in an existing building on premises known as 970 Ellington Road, in an A-20 zone, be denied since insufficient hardship was shown. The Board feels that the applicant should request a temporary and conditional permit rather than a variance. Mr. Gerlt seconded the motion, and it was unanimously approved. Application No. 1348-79 - Chapel Hill Realty Mr. Gerlt moved that application No. 1348-79, Chapel Hill Realty, requesting a variance of Article 5, Section 5.2, on property on the north side of Ellington Road, in an RR zone, be granted. The variance will be for 24.26' on the width at the building line on the lot designated as Lot #4 on the survey prepared by Reino E. Hyyppa & Associates, dated November 7, 1979, on file with this application. The Board feels there is an existing subdivision and allowing this lot with 150.74' width is insignificant when viewed against the 175' required. Mr. Eriksson seconded the motion, and it was unanimously approved. Effective Date: January 16, 1980 Application No. 1349-79 - John T. Wholley Mr. Eriksson moved that application No. 1349-79, John T. Wholley, requesting a variance of Article 5.2, Section 5, to allow construction closer to the rear line than permitted on premises known as 1906 Main Street in an A-40 zone, be granted. The variance will allow a 17' x 20' addition to the rear of the house, which will come within 5' of the John Fitch Boulevard access line as shown on the plot plan submitted with this application and dated May, 1973, prepared by Melvin C. Stead, Sr. The Board feels there is a hardship because the house was built in 1762 and predates zoning, and notes that the addition has been approved by the Historical District Commission. It is also noted that the location of the lot between Main Street and John Fitch Boulevard is prohibitive. Mr. Steben seconded the motion, and it was unanimously approved . Effective Date: January 16, 1980 Application No. 1350-79 - Fred J. Schilke Mr.Steben moved that application No. 1350-79, Fred J. Schilke, requesting a variance of Article 5.2, Section 5, to allow construction closer to the side and front building lines than permitted on premises known as 488 Miller Road, in an RR zone, be granted. The variances will be for 13' on the front building line, and 8.5' on the west side. . The Board feels the variances should be granted since the requirements in this zone have been changed since the house was constructed, and also notes that it is in keeping with the area and none of the neighbors object. -5- ti Zoning Board of Appeals 1/3/80 Mr. Gerlt seconded the motion, and it was unanimously approved. Effective Date: January 16, 1980 Application No. 1351-79 - Strang Real Estate Mr. Gerlt moved that application No. 1351-79, Strano Real Estate of 172 E. Center St. , Manchester, requesting a temporary and conditional permit to allow a sign larger than Article 4.1.5 permits on the Frank Muzikevik Farm on Avery Street until it is sold, in an RR zone, be denied, since there was an insufficient showing of need. Mr. Eriksson seconded the motion, and it was unanimously approved. Application No. 1352-79 - Electro-Methods, Inc. Mr. Murrin moved that application No. 1352-79, Electra-Methods, Inc. requesting a variance of Article 4.4.3, Section 4.7.4.3, to allow a sign larger than permitted. on premises known as 330 Governors Highway, in an I zone, be granted. Said sign will be approximately 4' high, 12' long, 2' thick, will bear the company's logo and will be illuminated from within. The Board feels this sign is necessary to identify this business . Mr. Steben seconded the motion, and it was unanimously approved. Effective Date: January 16, 1980 Application No. 1353-79 - Albert & Marian Kowbrosky Mr. Eriksson said that we should give the Planning & Zoning Commission a chance to try to get the owner to do something about cleaning up this property, and the other Board members agreed. Mr.Eriksson moved to approve application No. 1353-79, Albert. and Marian Kowbrosky, requesting a State Hearing under 14-54 of the General Statutes for a General Repairer's License to operate a body shop on premises known as 395 John Fitch Boulevard in a GC zone, subject to approval of a site plan of Development by the Planning and Zoning Commission. Mr. Gerlt seconded the motion and it was unanimously approved. Xffective Date: Janaury 16, 1980 GENERAL Mr. Eriksson moved that Wayne Gerlt be nominated Chairman. Mr. Steben seconded the motion. All in favor; none opposed. It was a unanimous vote and so ordered. Mr. Eriksson moved than Robert W. Warren be nominated Secretary of the Board. Mr. Steben seconded the motion. All in favor; none opposed. It was a unanimous vote and so ordered. -6- • Zoning Board of Appeals 1/3/80 rIrs. Graney submitted her resignation to Chairman Gerlt effective immediately.
