Planning Department/Engineering Department staff will review plans only once -- if the resubmissions are not complete/correct , the Town Planner ' s report will reflect that revisions were not made as requested . i 1 VALLES ACCESSORY APARTMENT PH 5/25 2nu- Ldi :,- e1f 1 . Request for a special exception to convert an in-law apartment to an accessory apartment. The in-law apartment had a ZBA 2-year temporary and conditional permit which was granted in May 1991 . The ZBA application indicates that the applicant had applied for a variance to Section 4 . 1 .8a, which is our two-family home conversion regulation. The variance was needed because the house was built after 1940, and our regulation requires the house to be built prior to 1940 to qualify for conversion to 2-family. ZBA granted a 2-year T&C instead of a variance, with their usual condition that after the in-law apartment is no longer needed, the kitchen be removed and the apartment converted to ordinary living space. 2 . The proposed accessory apartment has 1160 square feet of living space plus a 10, x 12' deck. Our regulations require that the accessory apartment cannot exceed 700 square feet or 40% of the combined gross floor area of both units, whichever is smaller. It appears from the building department file that the addition is about the same' size as the original dwelling, with the garages underneath the addition. Our regulations do have a waiver provision, which allows the Commission to waive one or more of the criteria, after determination of the following: a. there will be minimal adverse impacts on existing uses in the area, b. surrounding property values will be conserved and the character of the neighborhood will not be unduly disrupted; and c. due consideration to preservation of historic factors has been demonstrated. I would note that the lot. is well screened on both sides by mature evergreens . Also, Commissioners should consider implications of precedents that approval of this accessory apartment could set. 3 . The other criteria for accessory apartments include: - the main dwelling unit was constructed prior to September 1, 1990 - this main dwelling unit was built in the mid- 19701s; the owner of the dwelling units must occupy either the accessory apartment or the main dwelling unit - which is the case; - the entire structure must maintain the appearance of a single family dwelling - I will leave that determination to the Commission; - Off-street parking for at least 3 vehicles must be provided - there are 3 garages; - adequate water and sewage disposal must be provided - that criteria had to be satisfied in order for the building permit to have been issued in 1991; and - not more than 10% of the existing single-family units within 1000 feet of the proposed accessory apartment contain existing accessory apartments/in-law apartments; we don't show any accessory apartments within this area. Arlo 14 44 Ap :- ,3 1 - c-j The condition of this approval is that the owner(s) of the property must reside in the apartment or the main house. Reaffirmation of occupancy by owner will be required every two years. This will be done by a letter from the Planning Department requesting the reaffirmation of occupancy. The enclosed Special Exception form must be completed and filed in the Town Clerk's office. The special exception will take effect upon filing.
