Sorenson, Secretary PLANNING AND ZONING COMMISSION JANUARY 89 1985 PUBLIC HEARING AND SPECIAL MEETING SOUTH WINDSOR TOWN HALL MEMBERS PRESENT: Conde, Smith, Klenke ALTERNATES PRESENT: Hallowell (sitting for Montana) ; Rossi (sitting for Gilligan) SPECIAL MEETING Mrs . Smith moved that Robert V. Conde be elected Chairman for this meeting , seconded by Mrs. Klenke and unanimously voted in favor . Mrs . Klenke moved the Special Meeting be recessed until after the public hearing. Mrs . Smith seconded the motion and it was unanimously voted in favor , and so ordered. PUBLIC HEARING The secretary read the legal notice as it appeared in the newspaper, a copy of which is attached hereto. 1. Application of Frederick P. Mahr, for a zone change from RR to A-30 for approximately 12 acres located on the Ellington/South Windsor, town line, west of Newmarker Road. Attorney Harold Cummings of 1665 Ellington Road, South Windsor, was present on behalf of the applicant. He said that last summer they requested a zone change on this parcel as well as another, for an A-30 subdivision, and it was not granted. There are significant differences between this application and the previous one. Last summer it was presumed the land would be developed from Ellington and the Commission had severe concerns. The Commission has granted zone changes to A-30 for the Natsisky property, which borders this parcel, and the Jean Marc Jacques property. Mr. Jacques controls the Natsisky property, and granting this zone change would be entirely consistent with what the Commission has done in this area. Mr. Cummings said that there is a three way agreement among the Mahr family, Mr. Lavitt, who is the developer from Ellingtou and controls the land to the north, and Mr. Jacques, who controls the Natsisky and Newmarker properties. The combined properties could produce a subdivision containing approximately 162 lots, and Mr. Cummings showed the Commission a conceptual plan prepared by Meehan Associates, dated Oct. 1984. Jean Marc Jacques will exercise his options on the Natsisky and Newmarker properties and the Mahr piece will be acquired by him. Access to the proposed subdivision will be off Dart Hill Road and will be extended in phases to reach the Mahr property. The Mahr property will drain into the Newmarker and Natsisky properties. They are proposing a development in four phases with approximately 40 acres in each phase. Sewers are available, and as part of the package Mr. Lavitt brought Connecticut Water to the edge of his property. There are plans to sewer into Vernon and South Windsor. Planning & Zoning Commission -2- 1/8/85 Mr. Cummings noted that the only access to this piece is a right-of-way called Newmarker Road and it does not meet Town standards. If this zone change is not approved and this land does not become part of the JMJ development, the applicant will be unable to do anything with this land since the Commission has already denied access from Ellington. Planning Director Peter DeMallie reported that he has not seen the conceptual plan presented this evening. He noted the Commission did previously deny the zone change request for this land, and the zone has been changed to A-30 on about 130 acres south of this property. The Town Plan calls for low density development, which is one family per acre. There is still no inter-town sewer agreement, but it is in the works. Mr. DeMallie concluded that he is not opposed to this zone change. Mr. Conde asked if a report had been received from CRCOG, and the secretary noted that it has not yet been received although CRCOG was given the required 35 day notice. She noted that in the previous application which the Commission denied, CRCOG had noted there was no apparent conflict. The Town Engineer, Rick Martel, stated he had no comments on this zone change. Attorney Ray LeFoll spoke in favor of this application, and stated that he represents Jean Marc Jacques, who owns 70 acres on Newmarker Road. Mr. Jacques has a bond for deed on the Natsisky parcel, and Mr. LeFoll submitted a copy of it to the Commission. Mr. LeFoll said he requests approval of this zone change to allow inclusion of this parcel with the other 130 acres Mr. Jacques plans to submit for subdivision approval. He noted it is logical to include this parcel. Mr. Jacques has an option agreement with Mr. Lavitt and they will exercise it immediately upon approval of the zone change. They are pursuing the inter-town agreement for sanitary sewers. Mr. Joseph Natsisky of Newmarker Road said he is opposed to the proposed zone change. He owns the adjacent parcel and is against it. All of the water from Mahr's land drains into his land. Lavitt's houses on Grant have pipes and the water runs into the woods and eventually into his land. It is nothing but a swamp, and Mr. Natsisky said he would appeal this matter if it is approved. Mr. Natsisky said he used to grow tobacco and potatoes here, and he gave an option to JMJ, and he wishes he hadn't. The Chairman asked Mr. Natisky to point to his property on the conceptual plan which was submitted earlier, and Mr. Natsisky did so. Commissioner Hallowell said that one of the requirements for a zone change is that the up and downstream flooding must be addressed. Mr. Cummings referred to the conceptual plan, and said Phase one of the proposed development will involve a large detention area. The area of concern is going to be acquired by JMJ, and drainage will go in first and the road network will be extended north so that by the time it reaches the Mahr parcel the drainage will be in place. The proposed development will enhance an existing problem by putting in detention and control devices. Mr. Hallowell said the Commission does not have elevations, but if they can't sewer the back portion into South Windsor, how is it going to be drained into South Windsor? Mr. Ken Smith of Reino Hyyppa & Associates said they have done some preliminary investigation and basically drainage flows north to south and that is where the detention basin would go. Regarding the sanitary sewer, they are in the process of laying it out on a preliminary plan and most of the sewers Planning & Zoning Commission -3- 1/8/85 will go into Vernon. The specifics have not been worked out yet. Commissioner Rossi asked how much land would remain in Mr. Natsisky's name if this project goes through, and Mr. LeFoll said about 2.3 acres located on the southerly portion. Mr. Conde asked for clarification of whether the property to the south had already been zoned A-30, and Mr. DeMallie said it is A-30. The option is for ownership of the land. 2. Application of Burr Meadow Associates for a Special Exception to Section 4. .3.2 and Site Plan of Development, for condominiums to be known as Condominiums at Sunfield Drive, located on the northwest corner of the intersection of Pleasant Valley Road and Clark Street, 5.79 acres, MF-A zone. Attorney Ralph Alexander was present and referred to the narrative which had been submitted with this application and asked that it be made part of the record. He submitted the qualifications of the engineering firm of Palmberg & Russo. He noted that this application is for a special exception/ site plan for Condominiums at Sunfield Drive. The General Plan was approved in September 1984 with certain conditions and this application is submited in accordance with that approval. Several minor changes were made at the suggestion of the Town staff. David Harms of Palmberg & Russo then stated that the site is located on the northwest side of Clark at the intersection with Pleasant Valley Road. Phase I is on the westerly portion of the site. Phase II is on the easterly portion, and there are a total of four buildings. Access to the site is from a point on Clark Street and there is one principal roadway known as Sunfield Drive. Sheet K-2 shows easements, including the right to drain to the Town cf South Windsor. _ Catch basins are proposed - one on Pleasant Valley Road and two on Clark Street. The right to grade will be requested from the northerly abutter, CL & P. Referring to the site plan, S-1, Mr. Harms said the site generally runs downhill and there are two low spots. One is the existing pond, and the other is approximately 70' east of the center of the site. In accordance with the Town Engineer's requirements, the site frontage has been upgraded including two catch basins on Clark Street, and one on Pleasant Valley Road. In addition, 6" bituminous concrete curbing has been proposed along the entire frontage on Clark and Pleasant Valley Road. Drainage will be through catch basins, and piped underground to detention basins where it will be discharged. Drainage in each phase is separate and detention basin #1 is located to the northerly property line and detention basin #2 at the easterly property line. Water is supplied from a 12" main in Clark Street. Waste water disposal will be- picked up from the existing sanitary sewer in Clark Street. Fire protection is through one hydrant in each phase. Access for fire apparatus is available, and a bus-shelter will be located by the main entrance. Ray Alexander noted that landscaping has been done by Alan Viets, and the recreation facility in this complex is a victory garden and page 5 in the narrative outlines the garden. There is one abutter and on page 20 there is a letter from her stating that she approves of the landscaping plan. Sheet #L-2 shows how condition #6 of the original approval concerning landscaping to the north was complied with. The buildings are two story, clapboard with vinyl siding. The roof has an uneven pitch to give the appearance of a Planning & Zoning Commission -4- 1/8/85 saltbox. The windows are double hung. Mr. Alexander then briefly reviwed the floor plan of the various units. The Town Planner reported that the plan is essentially the same as the General Plan which the Commission approved last year. It evolved over a period of two years and numerous meetings with Town staff. The garden will have picket fences and stone walls and is not a typical garden. It will be aesthetically pleasing not only to the residents, but to people driving by. Mr. Martel, Town Engineer, said he had only a couple of comments. One is that the plot plan should show iron pins on all property corners; the 50 year flood should be addressed on the topographic plan. Pleasant Valley Road and Clark Street should be upgraded and the developer should quit claim to the Town a 25' strip from the center line of Pleasant Valley Road to his property line. No one in the audience spoke in favor of the application. Speaking in opposition was , Rose Pastula of 889 Pleasant Valley Road, who questioned how these units could be built on 5.78 acres. Mr. Conde informed her that it is within the regulations. She said the Town Engineer said Pleasant Valley Road will be upgraded, and they don't want it touched, and she asked what he meant by upgrading. Mr. Conde said that traffic will not be increased, but the road will be made safer. Mr. Martel noted that the road will be brought up to Town standards. Mrs. Pastula said she still doesn't understand the drywells, and Mr. Conde explained that they are designed to handle the water, and right now there 's nothing in Pleasant Valley Road to handle drainage. Mrs. Pastula said that if anything goes wrong, the taxpayers will have to take care of it, and she's tired of paying taxes. Mr. Alexander noted that the people in the condominiums pay taxes, too, and don't get anything in return. Mr. Conde suggested that questions be addressed through the Chair. Mrs. Rossi asked for clarification concerning the 50 year flood, and Mr. harm noted that the systems have been designed to handle water from a 50 year storm, and anything larger would overflow. Mrs. Smith asked when the Victory Garden would be built, and was told it is part of Phase I. Mrs. Klenke asked about the nearby strip of CL & P, and Mr. Alexander said that parcel is about 5 acres, 400' across, and then some brush and a single family house. Mr. Hallowell said he would like to know how the pond area on the CL & P property will be restored, and that it should be included as part of the plans. Mr. Conde said that within the past couple of months, a couple of developers have come to the Commission to permit more two-bedroom units in place of one-bedroom units. This development shows 30% of the units are single bedroom. He asked what group of people they were trying to attract. Mr. Ray Alexander said their market has been mostly young people, new people into the marketplace, and empty nesters, with very little in the middle. They have been successful with one-bedroom units. Mr. Alexander said in the original Burr Meadows development, they did receive permission to have larger two-bedroom units, with two bathrooms, however, they still have a number of one-bedroom units. Planning & Zoning Commission -5- 1/8/85 3. Ap2lication of Jean Marc Jacques for an Open S ace Subdivision consisting of 65 lots in an A-20 zone, on 70.3 acres located on the westerly side of Clark Street, and approval of Section 1, consiting of 37 lots. Attorney Ray LeFoll was present on behalf of the applicant. He said the applicant is here to get approval for an Open Space Subdivision with a total of 62 lots. He. then introduced Ken Smith of Reino Hyyppa & Associates, who made the following comments: Pointing to the key map he noted that Podunk Mill is to the north of the property and Clark Street runs to the south. Plum Gulley Brook is in the northeast corner of the property. They are looking to develop approximately one-half of the property at this time consisting of 33 lots and this encompasses about 31 acres, of which about 10 acres will be conveyed to the Town as open space. In Section II an additional 14 acres will be conveyed to the Town of South Windsor. This project is to the north of a project approved several years ago, known as Beechwood Farms, and that approval has elapsed. They have met with LaCava's engineers a number of times to discuss sanitary sewers and they are in agreement that the sewer which will service this development as well as LaCava's future development will be across Lot #10. Fuss & O'Neill (and LaCava) have agreed to make a minor alignment to come into the roadway system proposed in this plan. Mr. Smith outlined the roadway system they are proposing. They will put a conservation system in back of the lots adjacent to the wetlands area. The land naturally drains to the east across the CL & P easement. On the easterly side of the CL & P easement a detention basin will be constructed, and the water will flow back into the waterway which flows in an easterly direction into the Plum Gulley Brook. The sanitary sewer will come from Clark Street, and they have an easement so that it will be further away from Plum Gulley Brook than originally planned. It will then run in a westerly direction, and across Victor Drive, and then across Lot #10 so that it can connect to the LaCava development eventually. Some of the lots in the wooded areas have larger frontage of 125' in order to preserve trees between the lots. Mr. LeFoll noted that they have been to IWA and have not received final approval, but he said he has been informed that they have an unofficial approval. IWA is awaiting a copy of the Rose easement which would allow them to locate the sewer across the Rose property away from Plum Gulley Brook. He said they should obtain their final approval at the next IWA meeting. He noted that installation of the sewer will be 4' lower than required by this subdivision, in order to accommodate LaCava's future development, and a monetary agreement has been reached between LaCava Construction and Mr. Jacques. Peter DeMallie, the Town's Planning Director, reported as follows: The zone change to A-20 eras approved in July, 1984, -and with this proposal open space of 241 acres for 62 lots will be secured. When the zone change was approved, Mr. DeMallie said he recommended that the land be developed as an Planning & Zoning Commission -6- 1/8/85 open space subdivision in order to acquire land around Plum Gulley Brook and Vinton's Pond as open space. The open space will have 350' frontage along Clark Street and over 300' frontage on both sides of what will be Stanley Drive. Access to the Phase II open space will be off Sally Drive. The Phase II open space will tie into Tudor Hills and Beechwood Farms open space. By connecting into the Beechwood Farms sewer, they will not be required to tie into the Evergreen Lane pump station and it looks like the sewers can be gravity flow. Lots 5 through 10 are larger, and wooded, and an effort will be made to save the trees. Sheet #5 precludes issuance of c/o's on lots where there is stockpiling. Calculations for allowable lots should be added to the plans. The plans should indicate it is an open space subdivision in an A-20 zone, and the direction of drainage flow should be shown. On the key map the other land of Pleasant Valley Homes should be labeled as Parcel A. The detention basin should be outlined on the key map. Monuments should be placed at all angle points of open space Mr. DeMallie recommended that sidewalks be installed on the north and east sides of streets as opposed to south and west sides. He said they should be installed on the north side of Stanley Drive; east side of Victor Drive and north side of Sally Drive. The Commission may wish to install sidewalks on the east side of Clark Street which is opposite this site. Town Engineer Martel reported as follows: On the key map both Class D certifica- tions will be needed. The plot plans should show at least one typical lot with the building line offset dimensions shown. The easements should be shown as being to the Town of South Windsor. The developer should retain slope rights on Lots 11 and 13 for work on future phases, and driveways for Lots #1 and #33 should exit onto Stanley Drive and not Clark Street. Prior to any approval, the Engineering Department needs quantities for bonding purposes. Mr. Martel said before construction is done on the sewer, the sanitary sewer easement should be on file. Clark Street should be upgraded, and the Town will want a quit-claim deed for 25' from the center line. Mr. Martel said the plans are lacking a conservation plan, and right now there are two significant stockpiles on the property. He said he would like to know what will be done with them, and if there will be any excess material. Mr. Peterson pointed to the location of the stockpiles on the map, and noted they are outlined on the topographic map. The stockpiles consist of excess materials from other sites, as well as unsuitable construction materials, such as clay, which cannot be used. As the construction of the sewers start, the material will be moved into the trench for the backfilling of the sewers. A small portion will be left, and eventually used under the foundations of some of the houses. The other stockpile will be used in the same manner. Obviously, when material is taken out of the ground, and this excess material is put in,you end up with excess material again. Town Staff has suggested we look into placing some of this excess material around the houses, and Mr. Peterson said they are looking into this possibility. He noted they are trying to determine how much excess material they will have, and eventually it may be sold. He said he has not designated a stockpile area on the map, and would like the Town Staff to go to the site with him to look at this. Planning & Zoning Commission -7- 1/8/85 No one in the audience spoke in favor of, or in opposition to this application. Commissioner Hallowell said the only access to the 14 acre open space parcel is a 20' drainage right-of-way. He suggested that at some point the Town should have a 50' gravel-type drive for access. At one time the Town looked at the opposite side of the pond for use as a recreational area. Mr. Hallowell said he sees a potential conflict in the road network where Stanley Drive will tie into Quarry Brook Drive and Sally Drive, and this should be looked at. Regarding sidewalks, Mr. Hallowell said it appears the Commission has sideswalks on the north and west in many instances , and he believes north and west is proper, not south and east as indicated by Mr. DeMallie. Mrs. Rossi asked the length of Stanley Drive which ends in a cul-de-sac, and Mr. Peterson said it was approximately 2500' to Lots 18 and 19. It has not yet been approved by the Fire Marshal. Mrs. Smith asked if the flood plain area was included in the open space area, and Mr. Peterson said that 50% is included. A discussion ensued regarding the calculations for open space and Mr. DeMallie said based on the Subdivision requirements they have considerably more than 10 acres. Mr. Conde asked if the calculations for lot size have been verified and Mr. DeMallie said that was done correctly. A comment was made concerning developable recreational land, and Mr. Peterson said that in an open space subdivision developable land is not required, and Mr. DeMallie said that is correct. Attorney LeFoll said that regarding the comment concerning a 50' access to the open space, that presupposes ingress and egress of vehicles and that is something they would like to discourage. Mr. Hallowell noted that this is the only area in Town that the Recreation Commission has expressed an interest in, and it may not be practical now, but 25 or 30 years down the road it may be desirable. He said the Commission should not landlock 14 acres of potential recreational land. Mr. Conde agreed with Mr. Hallowell and said that the Commission could take the land for the 50' right-of-way now, but it could be left in its natural state. Mr. LeFoll said that if they are required to put in a 50' access they will lose a lot. Mr. Hallowell noted that they have provided a 50' right-of-way to the 2 acre Hoffman parcel, but only provide a 20' drainage easement for access to a 14 acre parcel of prime recreation property. Mr. LeFoll said the right-of-way to the Hoffman parcel is intended to be 20' , and the maps do not portray that. Mr. Conde noted that this issue will be addressed when the Commission discusses this matter. Mr. Peterson said he would like to point out that the terrain is very steep and the only access he would think would be a pedestrian type. Mr. Conde asked if the LaCava subdivision is really complete enough . so that they have plans for the sewers and road layout, and Mr. Peterson said yes, that it had been approved by PZC but the plans were never filed. Mr. Conde said that once they determine where the stockpile will be, a plan should be submitted to the Commission showing where these areas are. Planning & Zoning Commission -8- 1/8/85 Mrs. Klenke said that Lot 25 seems to have a nightmare of easements and appears to be a swamp. She suggested the Commission take a close look at it. SPECIAL MEETING The Special Meeting was reconvened at approximately 10:25 P. M. 1. Country View Estates, Phase IV Mrs. Smith moved that Country View Estates, Phase IV, be granted a 90 day extension of time in which to file their final plans. Mrs. Klenke seconded the motion and it was unanimously voted in favor and so ordered. The meeting was adjourned at 10:30 P. M. Respectfully submitted, Virginia S. I visited Town Hall on January 12 and saw the correspondence letter sent to the builder, R.J. Alexander , as well as his reply. All Mr. Alexander addressed was the problem he apparently had in locating the island between buildings eleven and twelve. This is all well and good but I do not think this has any bearing on our missing island between 13 and 14. As it is right now this parking area resembles a. supermarket parking lot , a large area, of paved tar with nothing to break it up. I have talked with many of the residents of 13 and 14 and it seems a.11 of us desire this improvement. Th.e next important project which is missing, and until my visit to Town Hall I donnot think they were aware of, is the stone wall which was to be built at the left entrance to Sunfield Drive and extending some length along Clark Street. In the letter sent to Mr. Alexander by the town the only stone wall mentioned was a small one between buildings twelve and thirteen. The wall I refer to is at the entrance to Sunfield Drive is a lot larger and would enhance the beauty as well as the value of the property. It would also create more similarity between the old and new addition to Burr Meadow because the older section has such an entrance wall as well as interior walls. I will not be able to attend the meeting on January 20th with this matter on its agenda, but I trust Burr Meadow residents interests will be protected by the town. These two examples of unfinished projects in Burr Meadow at Sunfield Drive were approved long ago and I, as well as other resi- dents here , expected them to be constructed and hope this is done in the near future. One cracked sidewalk flag west of the bus shelter must be repaired . 3 . Staked haybales on the north side of the site should be removed . 4 . Marcia A. Banach Town Planner Town of South Windsor 1540 Sullivan Avenue South Windsor, CT 06074 Re : Burr Meadow / Sunfield Dear Marcia, This is to address the items outlined in your letter of November 20, 1986 concerning the referenced project. The items are addressed in essentially the format of your letter. 1 . Island Missing: Site conditions necessitated the elimination of the referenced island. The similarly located island in the parking area at the west end of buildings #11 and #12 was moved twice to accommodate the traffic flow, ie . some people need as much room to maneuver a Toyota in and out of a garage as others would require for a dump truck . We had irate homeowners screeming at us to, "Get that thing the heck out of the way" . Locating the referenced island would have created a worse situation because of the proximity of the garages, therefore in the interest of safety it was eliminated. 2. Cracked sidewalk flag: The cracked flag in the sidewalk will be repaired in a season when this type of operation is practical . It would V serve no ones good to try to repair the referenced walk flag during the winter months . The amount of the maintenance bond would be more than the necessary incentive for us to make the repairs in the spring. 3. Staked haybales: The staked haybales have been removed or scattered depending of the condtion of the bale . 4. Landscaping concerns : a) Recreational garden area: a) 1 and b)2 Daylillies? The daylillies were eliminated as a totally inappropriate landscaping feature . As the declarant of Burr Meadow we had an obligation to ourselves and the owners to produce a project that is not only attractive but reasonable to maintain. Landscape maintenance is one of the largest budget items for Burr Meadow Society, Inc. and daylillies require an excessive amount of maintenance . I have been retained on the Owner controlled Board of Directors and believe, based on my experience, our decision was in the best interest of the condominium. Burr Meadow Associates a)2 Picket fence : The final form of the garden enclosure is a product of the practical mechanics of constructing dry stone walls and the cost-benefit relationship of the ammenity. The 3' picket fence fits the stone corner sections . Further, we did not construct the gate access shown located at the intersection of Pleasant Valley Road and Clark Street because it is contrary to the best interest of the users of the garden facility. a)3 Austrian Pines: During the planning and development of the project we worked very closely with Mrs. Francis Mauroski , our southerly neighbor. She had been planting an area that strattled the property line for many years and asked if we minded if she maintained the area as a garden. Additionally, a row of pines existed in approximately the area designated for the Austrian Pines. We made the decision to have the nine pines in question planted along the southerly boundry line to increase the density of the buffer at Mrs . Mauroski 's garden or backyard. a)4 Planting northeast corner: The plantings designated for the inside the northeast corner of the garden fence were planted outside the northeast corner. b) General : b) i Terra-tex: Our paving contractor would not guaranty the performance of this product in this climate . The terra-tex circle would provide no protection for the trees planted in the center of the circle since there would have been no berm curb installed. We believe the existing application to be an improvement over the terra-tex. b)2 Daylillies: see a) 1 above . b)3 2.5 foot wall : the elimination of this wall was an economic trade-off for the moving of some garages and a dumpster in an effort to better accomodate the real workings of the site . Burr Meadow and Sunfield were produced with one of the most creative and aggressive landscaping and site design programs in this town. While a landscape plan is a necessary guide for the decorating of a site it must bend to the practical workings of the site . We believe we have provided a finished product that lives up to the spirit of the plan, If not every detail . We are available if you have any questions concerning this matter. In follow-up to our telephone conversation of Friday July 11 we are requesting that the $ 10,000 recreational facilities portion of the maintenance bond requirement be eliminated. As was discussed Section 4. 13. 3. 3 ofthe Town of South Windsor Zoning Regulations requires; "the Developer shall present Maintenance Security equal to twenty percent ( 20%) of his original value for two years from the Qate_of_final_completion_of_all_ecreational_facilities, to guarantee the satisfactory preformance of all recreational facilities" . This letter is to certify that the recreational facilities at Burr Meadow were completed prior to July 20, 1983 which is more than two years ago. Two events marked the completion of the required facilities . First, both the tennis court and the swimming pool and pool house were completed and open for use at the "Open House" which was attended by some members of the Commission and some members of the Town staff . The date of the "Open House" was July 14, 1983. Second, a Certificate of Occupancy was issued for the pool house on July 20, 1983. Based on my personal knowledge and our records to support the dating of the two, previously discussed, events I certify that the recreational facilities located at Burr Meadow where completed prior to July 20, 1983 and are more than two years old. The developed recreation for the complex consisted of the constructing of a gardening center at the intersection of Clark Street and Pleasant Valley Road. After carefully researching the facts and the law at that tine, I • concluded that the !!FA zone upon that six acre parcel constituted non-conforming use zoning which could not be affected by the sub- sequent change in the regulations. Therefore, the parcel itself is subject to development as a condominium despite the higher acreage requirement existing in the regulations. At the time this parcel was zoned, we did not require 'q property to be contiguous and not 'separated by a public street. Alexander B4rr Meadow Associates Post Office Box 583 South Windsor, Connecticut 06074 Dear Mr. Alexander: Your letter addressed to Business Manager Mercure has just been referred to my office for reply. You asked, as a part of the Special Exception/Site Plan approval process, that we gi ve your office information on the impact of 40 new condominium homes on our school system as well as the need for a bus shelter at the entrance to the condominium development. Our experience show§ only .15 children per condominium unit come from a condominium development as compared to one or more children from each single family house sold. This information is based on a review we made of the development called "Parkview South" which has 106 units. We have a total of 16 students from that development: 6 in an elementary school , 4 students at the middle school , and 6 at the high school . Therefore, it has been the school system's view that for planning purposes, we do, not expect, large or significant numbers of children to come from condominium developments. We do support the need for a bus shelter at the entrance to the condominium development. It would also be helpful if the condominium project provides sidewalks. While it iS not a requirement of the public schools, sidewalks are certainly helpful to students in walking to and from the shelter(s) where they wait for the school bus.
