BRAY SPECIAL EXCEPTION
1 . Application for John Bray for a special exception to
Article 4 . 7 .2 . 8a for the storage of chemicals and other materials
for resale and/or distribution in the industrial zone. The site
is located on the southerly side of Sullivan Ave, westerly of
Schweir Road, I zone. The storage is proposed to be in an
existing building 20X40 feet on the easterly side of the
building.
WV
This application hft previously been denied by the planning and
zoning commission because of concerns they had with the types of
chemicals being stored, the amounts and the potential for
interaction between these chemicals. Mr. Bray has indicated in a
letter contained in Exhibit A that the Nitric Acid has been
removed from the list of chemicals to be stored and that only
Hydrocarbons Solvents with flashpoints lower than gasoline will
be stored in this building.
2 . The fire marshal has visited the site and has indicated he
does not forsee any problems with the storage of chemicals in the
building.
3 . The site plan submitted does not show that there will be
any changes made to the site.
4 . Fred Shaw, Sup't of Water Pollution Control, has reviewed
the plans and has indicated that WPCA approval is not required.
He has also reviewed the proposal for conformance with the
Superfund Amendments and Reauthorizarion Act of 1986 (SARA III)
requirements and has determined that all the information needed
has been provided. He states "In the event of an accidental
4 pill, the zone of vulnerability would not extend beyond the
immediate site, and therefore, does not pose a significant threat
to the public health and safety. "
If this application is approved, the planning and engineering
department has no modifications to request.

Dear Mr. Bray:
Re: Application #90-07P, Cardinal Industries, Inc. /Rose
Company, 486 Sullivan Avenue
Please be advised that the Planning and Zoning Commission voted
to deny, without prejudice, the above-referenced application.
The Commission was not comfortable with the amount of detail
presented regarding the various types of chemicals and their
potential for interaction. We understand that only one chemical,
nitric acid, appears to exceed threshold levels for SARA
reporting, however, with the many other Chemicals contained in
the building, the Commission is concerned about the interaction
of chemicals .
If you reapply, please be prepared to discuss, in more detail,
the interactive nature of the chemicals and your methods of
assuring that such interactions do not occur.
Very truly yours,
THE PLANNING AND ZONING COMMISSION

RE: CARDINAL INDUSTRIES/ROSE COMPANY - 486 SULLIVAN AVENUE
The owner/operator of the above referenced facility has provided
the information requested under the "Superfund Amendments and
Reauthorization Act of 1986 (SARA) relative to the us ,
production, storage or generation of extremely hazardous
substances.
Ros Company has reported the storage of the hazardous
substance--nitric acid in a seven (7) pound bottle (MSDS
attached) ; and the company has shown that it has the capability
to contain and clean up any accidental spill.
In the event of an accidental spill, the zone of vulnerability
would not extend beyond the immediate site, and therefore, does
not pose a significant threat to the public health or safety.

J FIRE AND EXPLOSION HAZARDS
Nitric Acid increases the flammability of, and can ignite many organic materials such
as wood, solvents, etc., and can release toxic oxides of nitrogen. Spillage may cause
f ire.
EXTINGUISHING MEDIA
For fires in area: Water, dry chemical, or soda ash. Use water spray to cool
containers and reduce vapors.
SPECIAL FIREFIGHTING INSTRUCTIONS
Evacuate area and stay upwind. Wear full acid protective clothing with self-
contained breathing apparatus where possibility of contact with ac14 or fumes exists.
Runoff from fire control may cause pollution. (See Disposal Information section.)
HEALTH HAZARD INFORMATION
PRINCIPLE HEALTH HAZARDS (Including Significant Routes, Effects, Symptoms of
Overexposure, and Medical Conditions Aggravated by Exposure)
Liquid and vapor cause severe burns to eyes, skin, nose, and throat. Harmful if
inhaled and may cause delayed lung injury. Spillage may cause fire or liberate
dangerous gas.
Inhalation 1-hour LCsa 2500 ppm in rats
•J Oral LDbo : 50-500 mg/kg (species unspecified)
The concentrated acid is a skin and eye corrosive. Methemoglobin and blood nitrate
levels were raised to greater than 50 mg % when the concentrated acid was spread
over 25% of the skin area in rats. There were no apparent adverse effects when rats
inhaled 63 mg/ms of the vapor for an unspecified period, but concentrations of 88 to
'415 ppm resulted in death due to pulmonary edema.
Subchronic toxicity in dogs from inhalation exposure to nebulized 1% nitric acid, on
alternate days for 4 weeks, resulted in bronchial injury which included increased
pulmonary resistance, decreased compliance, widespread airway inflammation and slight
fibrosis.
In chronic toxicity studies, there was no evidence of gross pathology in rats from
exposure by inhalation to 0.013 to 0.049 mg/L of an aerosol for 375 to 650 days.
Tests in animals demonstrate no carcinogenic or developmental activity.
Human health effects of overexposure by skin contact may initially include skin burns
or ulceration.
Eye contact with the vapor may initially include eye irritation with discomfort,
tearing, or blurring of vision; contact with the liquid will cause eye corrosion with
corneal or conjunctival ulceration.
Inhalation may initially include irritation of the upper•respiratory passages; temporary
lung irritation effects with cough, discomfort, difficulty breathing, or shortness of
breath; or possibly modest initial symptoms, followed in hours by severe shortness of
breath, requiring prompt medical attention.
