The 2:1 slope shown within sewer easement is unacceptable because maintenance vehicles cannot utilize the easement. Resolution of this slope must be agreed upon by the Engineering Department. Black and white transparent mylars, of Sheets #1 and #2 with th above modifications, together with four blueprint copies of th entire set of plans must be submitted to this Commission within 30 days to be stamped and signed. The letters of approval of this Commission, as well as the Inland Wetlands Agency/Conservation Commission, must be reproduced on the mylars. After the mylars have been signed by the Commission, they will be returned to you for filing in the Office of the Town Clerk within 90 days . After filing these plans, a copy of the receipt must be submitted to the Planning Department. Mrs . Montana seconded the motion with the above modifications, and it carried unanimously. 2 . Appl. #90-66P, Ridgefield IV, LaCava Construction Co. , Lots #20, 21, modification to Subdivision, located easterly end of Krawski Drive, AA-30 zone. Mrs . Evans read a letter from the applicant requesting to table this item until December 4, 1990, pending the delivery of revised maps. Mr. Murrin made a motion to table the application until December 4, 1990 . Mrs . Montana seconded the motion and the motion carried 4-0. 3 . Appl . #90-76P, Culbro Land Resources, Inc. , for a 16-lot subdivision of approximately 105.7 acres of property at 199 Rye Street, I Zone. Conditional approval requested; Subdivision previously approved. Rodney Morrison, a civil engineer from Lally Associates, asked that the application be moved to later on the agenda as his client, Dr. Giorgio, had not arrived yet. 4 . Ray Alexander Re: JFI sidewalks. Ms . Lipe, Assistant Planner, referred to a topography map of the 23+ acres of land Mr. Alexander has offered to donate to the Town in li u of building 1200 feet of sidewalk on Commerce Way. Several people from the Town were asked to look at the property. She referenced Mel Stead's, Sup't. of Streets report describing th property (Attachment TOWN OF SORTS WnCOSOR PLANNING AND ZONING CQWISSION Minutes Page 6 November 27, 1990 A) . One incorrect item pointed out by Ms. Lipe was the abandoned vehicles and trash on the property. Mr. Alexander clarified that this trash was not on his property. However, one of the Town's concerns is that this property could be used as a garbage dump or someone could get hurt on the property and the Town would be responsible. Because of these potential liabilities, it was the staff's feeling that the Town should not take this property. However, they felt it would be in the best interest of the Town that it be donated to the State for the Scantic River Park. In addition, in the Town Plan of Development it is stated that the Town should acquire land within the 100 year f loodplain. Mrs . Montana asked if we will be getting open space land from the Shepard/Culbro Subdivision. Ms . Lipe responded that the 22.6 acr s of open space associated with that development was not a requirement of the subdivision and that at the time the applicant had not indicated who would control the open space. Ms. Lipe stated that one of the concerns of donating land to the land trust is that the land trust does not have to provide access to the public. If the land go s to the State, there will be public access provided if hiking trails are ever developed along the river. Mrs . Montana questioned the Town's plan was for open space in the Scantic River area and how will it be managed. Ms. Lipe responded that will be decided for each piece individually. If this piece was more easily accessed off of Rye Street, the Town might feel differently about it as far as developing their own park to get down to the Scantic River. The way the Scantic River Plan is written, the goal is for either the Town or the State to try and acquire open space in this area. Mrs . Montana foresees a problem with industrial dumping in this area. Mr. Murrin stated it would be less likely to get industrial dumping if the Town owns it rather than being privately owned. Mr. Al xand r said that the trash that may be there was done a long time ago wh n it was being utilized and there were farm roads which do not exist anymore that went back into those areas. Mr. Alexander stated that as far as future dumping, it would be foolish for people who have parcels that abut this, to dump stuff over an embankment where it could be identified. There would be very little opportunity for people to dump off of Rye Street. Mrs. Evans referred to penalties for doing so, whereas previously there were none. Mrs . Evans would like to see it preserved. Mrs . Montana feels if nothing else, it provides for a very attractive barrier between th industrial areas . Mrs. Montana would like to have th Town acquir this piece of property and see what happens in the State's acquisition of the area. This is a natural preservation area. It TOWN OF SOUTH NIMSOR PLANNING AM SONIpG comISSION minutes Page 7 November 27, 1990 should b preserved, but by whom, and what are the advantages and disadvantages of each entity owning the land. Mr. Murrin asked if the 1200 feet of sidewalk is required and do they feel they can do without that or is it to be provided in some other way. Mrs. Evans stated the argument presented was that industrial sites don't need that much sidewalk. Mrs. Evans sees this as a positive contribution on the part of South Windsor toward the Scantic River Park. Mrs. Montana asked what the process was for donating the land to the state. Mr. Alexander noted there is a specific procedure set up. Mrs. Montana made a motion to waive the sidewalks requirement until such time as the State accepts the open space land. At that time, sidewalks will no longer be required for this subdivision. Tom March seconded the motion and th motion carried 4-1 . Voting with the motion to approve were Commissioners Evans, Montana, Castro and March. Voting against the motion was Commissioner Murrin. 5. Appl. #90-76P, Culbro Land Resources, Inc. , for a 16-lot subdivision of approximately 105.7 acres of property at 199 Rye Street, I Zone. Conditional approval requested; Subdivision previously approved. Dr. Giorgio, representative of Shepard/Culbro, was present to explain the application. Culbro is applying for a conditional subdivision approval on the Rye Street parcel that the commission awarded final approval on one year ago. Reference was made to the unusual economic times. Because of the economic situation, the business and the tenants that Dr. Giorgio would be working with can't get the money they need to expand. Dr. Giorgio continued on to say that the Rye Street project is a valuable project to the applicant and to the community. The concept that was approved makes sense and the applicant would like very much to do the project. In other communities, the applicant has been abl to file mylars with a note on the plans indicating that no building permits will be issued until the bond its posted or the improvements are concluded. This is not permissible under the South Windsor regulations . It has raised a problem in that after the Town did its appraisal of what the improvements would cost for Phase I, they were required to post a $435,000 bond. Posting this type of a bond is not a prudent business decision at this point. Subsequent to this, new subdivision regulations were adopted which allow for a conditional approval as an alternative to posting the bond before filing the mylars. Under the conditional approval, there is a provision for a three year window to either post a bond or F I Associates Inc. P.O.
