Attorney Raymond G. LeFoll
2307 Silas Deane Highway
Rocky Hill, CT 06067
Dear Attorney LeFoll:
This letter is with respect to my call on Tuesday regarding a
taxpayer' s complaint concerning an illegal filling operation.
Your position that this was being stockpiled, which very well may
be a valid excuse. I still consider this a direct violation of
the zoning regulations of the Town of South Windsor for a number
of reasons:
1. It is my interpretation that the purpose of a stock-
pile is for the future use on the same parcel. It
would appear that taking the dirt from the condo
stockpile on Chapel Road, two miles down the road to
a parcel on Clark Street, certainly will not return
to the condos . If this dirt does not return, it is a
filling operation.
2. An approval in accordance with the Planning and
Zoning regulations has not been obtained.
3. The J.M. J. group is not the current owner of this
parcel.
As I stated on the telephone, I feel that this operation should
be terminated now, and get the appropriate approvals .
If you have any questions , I can be contacted at 644-2511 ,
extension 244 .
Very truly yours,
A. Bowen Davies

RE: FILLING - CLARK STREET SITE
Dear Mr. Jacques:
On September 27, 1983, the Planning and Zoning Cormdssion voted to permit the
filling operation subject to a number of conditions. A copy is enclosed for
your reference. Item 3 requires this work to be completed by October 15, 1983.
Work still to be completed include:
1. Based on the acceptable earthwork standards, the maximum slope permitted
is 2' horizontal to 1' verticle. The banks exceed this minimum have to be
adjusted.
2. Considering the texture of that fill if basically a fine sand and is
greatly susceptable to wind erosion, it was extremely important that this
area be loamed and seeded per the approval.
3. On the other construction sites, you did install stakes through the hay
bales. This site should have then also.
The intent is to get the grass to germinate and grow enough to protect the area.
It would appear that an alternative will have to be proposed, approved and
implemented.
The other day, when I talked with you about the "rock pile" from the detention
basin in the Pleasant Valley Homes Subdivision, Section 8, I suggested that you
also take care of the erosion and sedimentation control in accordance with Sheet 7
of 11, Rev. 8-15-83, of the approved plans.
To avoid complications from relocating this pile to another stockpile, I would also
suggest that the appropriate plans be prepared and an approval be granted prior to
this move.
If you have any questions, I can be contacted at 644-2511, extension 244.
Very truly yours,
A. Bowen Davies,

As recently as this morning , you are still dumping waste

of the Planning and Zoning Commission approval letter of
September 27 , 1983 .
Your effort and willingness to comply has been properly noted
and could be taken into consideration in future approvals.
Very truly yours,
