Kelley_ 49-- Rosemary- Lane South Windsor, CT 06074 . Re: Windshire Abbe Estates, Ltd. Dear Mr. Kelley: At two meetings between the Engineering Department, your engineer, and you, the following information was presented to you on the Engineering Departments position on this subdivision. 1. Because of the configuration of this watershed and subdivision design, the Engineering Department is going to exercise extreme caution on evaluation of this proposal. The watershed area upstream of this subdivision is approximately 350 acres, most of which is undeveloped. 2. The serpentine nature of the brook, as it winds through the proposed Lots #11, 12, 13, 14, 15 and 16, should be viewed as. not desirable, unless the property owners and the Town are protected from future problems; which in the present design, are reminiscent of the problems encountered by the Town in Avery Brook. 3. The detention basin, as proposed, is not designed to Town specifications, with regard to the outlet structure and the control of the potential flooded area. In the past, all detention basin areas have been deeded to the Town and outlet structures have been designed to Soil Conservation Service standards. 4. The Toc-m will work-with- your engineer on drainage solutio-na near the intersection of_ Nevers road and Avers Road_ j. The outlet of the 21 inch drainage pipe dou nstreara of the detention basin will' be acceptable, if solutions to the drainage problems at the brook crossing at Nevers an3 a method of implementation could be obtained. This will also require the detention outlet to be smaller. TO: Richard S. Kelley Page 2. Re: Windshire Abbe Estates, Ltd. 6. There are other problems with regard to sanitary sewer locations, etc., which we will get into, if the above problems can be solved. If you have any questions regarding the above, do not hesitate to call. Very truly yours, T(Y,4N1 OF SOUTH WINDSOR E. Page J Town Engineer JEP:bw cc: Richard A. February 11, 19823: Mr. Jules page, Town Engineer Town of South Windsor } " 1540 Sullivan Avenue ` ' South Windsor, Ct. 06074 RE: Windshire Abbey Estates Dear Buck: I Enclosed please find two Warantee Deeds and a permanent conservation easement that we have prepared as a part of the documentation re- quired in the Windshire Abbey approval. At the same time I am for- warding a copy of these to Wayne Gerlt for his review. I would app- reciate your looking them over and advising if you have any questions or concerns in order that I can make any necessary changes before we submit the originals to you. As you may recall, at the time of the public hearing Nick Lesbines indicated that he was planning on buying Lot 4 from us and that also he intended to buy the land now shown as parcel B on the subdivision raap. At this time, Windshire and Nick have entered into a binding agree- ment that will provide for us to convey to him Lot 4 and all of the land in the back, parcel B at such time that we have completed all of the documentation and posted our bonds, etc. In light of the above, Nick then raised the question about the 50 foot strip of land along the easterly edge of the lot which runs from Wind- shire Drive to the retention basin area. As you may recall, when we were doing the original plan of the sub- division we had left a 50 foot wide strip there in order that in the event that the Planning and Zoning Commission desired, in the future, for a road there would be sufficient room left for a town approved road. However, since the Planning and Zoning Commission has deter- KUEHN, CAVANAUGH AND CUMMINGS, P.C. Mr. Jules Page, Town Engineer Page 2 mined that no road stub need be left for access to the Ireland parcel to the south Nick raised the issue of the necessity of a 50 Foot strip at this point. I did indicate to Nick that I would refer the matter over to you for your consideration. In view of the fact that there apparently is no longer a need for the road in the area and also in view of the fact that Nick will own all of the land to the south of the of the retention area Nick was wondering if we could revise the plan to show that add- itional 50 Feet being added to his Lot 4 , while at the same time a permanent easement to the town for access to the retention basin area being left so that the towns right of access , as you originally des- ired, would be maintained. I know in a couple of other areas the town has simply kept a perman- ent right of way for access to a retention basin area and not required fee simple ownership of itself. As I understand from Nick he is somewhat concerned about potential "trail bikes" , snow mobiles and the like traveling over a town owned parcel of land and his feeling is that if he owned that strip subject to course to all such rights of access as the town might require he would be in a better position to control the activities going on in his neighborhood. It would seem his request might be a reasonable one, and I would appreciate your giving it your consideration. Obviously, if you did agree to this change in the plan it would be necessary for us to file the appropriate amendments for approva of the Commission. lSi ly, H old R. Dear Buck: I have reviewed the February 11, 1982 letter from Harold Cummings, Esquire and its enclosures. Kindly insure that the deed offered to the Town of South Windsor for the roads is a warranty deed from Richard S. Kelley, not from the corporation. Mr. Kelley should get a deed from Windshire Abbey to himself and then he can give the warranty deed to the Town. As I have indicated in previous correspondence dated November 24, 1981, I am requiring this to insure that the Town will not have to conduct a thorough search of the land records to determine whether or not the claim of Mr. Kelley and Windshire Abbey Estates to the ownership of the road is in fact one which can be sustained against all objectors. To avoid the necessity and the delays which would be occasioned by such a search and the possible ramifications of uncertainty, I am requiring warranty deeds from Mr. Kelley. In the event that problems arise in the future we would then be able to request that Mr. Kelley defend the title to the road or clear up any controversies. If we rely on Windshire Abbey Estates to perform the same service to the Town in the future, we have no guarantee that it will exist or have any assets. As to the conservation easement, at the top of page 3 the clause should be reversed so that the grantor covenants and agrees to hold the grantee harmless, etc. , with appropriate wording changes within that sentence. Other than that I saw no problem with the conservation easement document or with the other parts of the proposed warranty deeds. If you have a questions, please do not hesitate to contact me.
