Simsel, Jr. 152 Deming Street South Windsor, Ct. 06074 RE: Preconstructi.on Agreement - Town Center 6 497 Buckland Road Dear John: This letter is in reference to the revised construction agreement for shared costs you presented to me on November 8, 1988. Following are my reactions and conclusions: 1 . You have changed the intent of shared costs without consideration of the hours and costs incurred in the original agreement completed back in ,tune 1988. Your answer for refusing to sign that agreement was that you wanted to wait and make sure you received your approval for your ninety-one hundred square foot building. You received that approval; and, again, you have changed your mind. You came to my office one week prior to this November 8 proposal and had absolutely forgotten that you had been given an agreement in June prior to the meeting when the Town Center received approval. You were present at that Planning and Zoning Commission meeting and heard the Commission's discussion regarding the connector road and the bonding of same. 2. My agreement was to share the cost of the connector road between the two properties. Also, I agreed to give land for the relocation of some of your parking spaces as you did not want to put the spaces on your own land because of the walking distance for tenants. Yet, the distance is the same regardless of the location of the spaces. 3. Sincerity in looking for an overall concept of planning, and not it piece-meal approach, is the responsibility of both property owners. I thought we had addressed this problem and had agreed to work together regarding a solution. I was left with no alternative but to develop an expensive, separate drainage system to control drainage that should have gone into the natural drainage and storage system. This became necessary due to your indecision regarding compensation from me to you to drain into a system designed for the %Aim D..il.a n..v 1'f........i:.r. entire watershed. 4. My road system takes your development into consideration at the insistance of the Town Planner and the Planning and Zoning Commission, therefore, I feel that all property owners serviced by this road network should be responsible for all off-site improvements. 5. I don' t see Schedules C, b and E to which you make reference in your revised agreement. In summary, I wish to re-state my desire to work co-operatively with you toward concluding this agreement. The entire property we have under our control should be developed with continuity and with consideration for any remaining property that would affect good development. This would mean an agreement with no more rule changes. It is nearly impossible to finalize planning if prior agreements are not followed. I would expect to hear from you in the near future after you consider all aspects of the agreement in its entirety. S erely, I ,E Richard S. Kelley RSK/ks SAMSEL PROPERTIES 152 DEMING STREET SOUTH WINDSOR, CT 06074 (203) 644-1157 TERRY OFFICE PARK BUCKLAND PROFESSIONAL CENTER November 16, 1988 Mr. Richard S. Kelley 1744 Ellington Road South Windsor, Connecticut 06074 RE: Preconstruction Agreement - Town Center & 479 Buckland Road Dear Dick, In response to your letter, dated November 14 , 1988 . Being the orginal document was prepared by your Attorney Sol Kerensky, and was to be signed by two people, Richard Kelley and John Samsel, Jr. , I believe I have one vote as to what was on the document before I sign. You also hand delivered it to my office at 4 :15 PM or three and one half hours prior to your P & Z Commission meeting that same night and asked my hurried signature on a document of which I did not have the benefit of counsel to review. All this, after I believe you were instructed by the P & Z Commission many days before to have prepared and signed. Your right, I did say that I had forgotten about the agreement, however, being you received your approval without the signed agreement, it seemed a dead issue at the time, especially after I received my approval and the town bonded both of us. You also told me that your Attorney billed you over three thousand dollars to prepare this document. If you will mail me a copy of this bill, I may be willing to pay for one half, provided it is included in the total cost that we are going to share one half each and after said agreement is sighed. I am not an attorney, however, I do not believe the intent of your agreement was changed. Only paragraphs, one, two, and three, that left all responsibilities bonding to Samsel . This was changed to Kelley and Samsel share all responsibilities and cost equally. Bonding is now a dead issue. My tenant, as I told you and the P & Z Commission, was very specific about the location and number of provided parking spaces and nowhere except behind that building is there room to provide 15 acceptable parking spaces. RE: Drainage - Sewers! Dick, in your earliest involvement with the purchase of the Society for Savings land, you were made aware at that time by me, Buck Page and later Fuss and O'Neil, that all SAMSEL PROPERTIES 152 DEMING STREET SOUTH WINDSOR, CT 06074 (203) 644-1157 TERRY OFFICE PARK BUCKLAND PROFESSIONAL CENTER systems should flow South. At NO time did you or any representative ever approach me with any offer or deal. The closest that issue ever came, was a visit by you to my Funeral Home Office prior to the submission of my building plans of 479 Buckland Road to the P & Z Commission. I, indicated to you at that time, that if you had any ideas or plans to get back to me ASAP because we were going ahead with P & Z because of a tenant occupancy deadline. I never did hear from you, and as a result, there were all sorts of misinterpretations of my site plan about a drive. By right, the road, sewer and drainage should have come down in the middle of that building. I had plans first, we both had known the two parks should connect and no proposals from you. To this day the drainage and sewer still exist and is still available! Yes, your road system and traffic probably had to take into con- sideration our site, of course our buildings were there first. Just as our Clark Corners plans are going to take into consideration the approved plans of the Town Shopping Center. I did not include schedules C, D, and E, only because I assumed you kept copies for yourself in you files and when we agreed on the meat of the document, they would just be stapled to the back. Enclosed are all the copies of schedules I received from you prepared by your Attorney. I am assuming, schedule C refers to the plan drawn by Fuss and O' Neil. This agreement was brought to light again only because of a conversation you had with Dick Mahoney. After a visit to your office, I only thought it a good idea for now and in the future we have sore sort of written agreement. I am able and willing to start construction of said connector road next week or as soon as an agreement is signed at your convience. I will not at this time sign the first agreement you left at my office. I have expressed my vote or concerns to you in writing in a second document. I am waiting for a response or revisions to that document or others addressing other connecting roans that would be in the best interest for all , now and in the future. As usual and as in the past conversations, your letter offers nothing more than criticism of water over the dam. You restate your desire for co-operation and agree to stop disagreeing, however, offer no suggestions or ideas or help to sign an agreement and conclude this matter. Please be advised that we are currently preparing an application to the State Traffic Commission as a major traffic generator, pursuant to State Statute 14-311. We will be incorporating the overall development plan into this traffic study, - and addressing the joint impact of the Town Shopping Center and the Terry Office Park. This study incorporates the developments since the overall -development plan shows an interconnection between driveways. This allows traffic to move internally between the sites. As proposed, the expansion will consist of 13, 100 S.F. of office development. The number of vehicles expected to be generated by this facility are shown in Table No. 1, attached. This table indicates the total number of vehicles which will be generated on an average weekday, and also during the morning and afternoon peak highway hours. It is anticipated that we will provide a northbound bypass area on Buckland Road so that vehicles travelling straight can bypass vehicles turning left into the site: We welcome any input from the town regarding traffic operations in the vicinity of this development. Although the State Traffic Commission has a great deal of control over the operations on the state highways in the area, it is our intent to accommodate the 146 HARTFORD ROAD / MANCHESTER, CONN. 06040 / TEL. Samsel, Jr. has proposed the expansion of the Terry Office Park in the Town of South Windsor, Connecticut. The development is located on the west side of Buckland Road, approximately 1000' south of the Wapping Five Corners intersection. Currently located on the site are twelve fully occupied buildings totalling 73,410 S.F. ; the 13,000 S.F. expansion will be general office space. Fuss & O'Neill, Inc. has been retained to study the impacts of the expansion of this development on adjacent street traffic, and this report documents the findings of the study. This report is being submitted, along with the supplemental information listed in the table of contents, to the State Traffic Commission (STC), pursuant to Statute 14-311, as part of an application for certification as a major traffic generator. B. EXISTING CONDITIONS The site, as shown in Figure No. of Appendix B, is located on Buckland Road in South Windsor. Buckland Road is a heavily traveled through route for traffic traveling through the Town of South Windsor. It varies between 34 feet and 36 feet in width in the vicinity of the site and has one lane in each direction. The posted speed limit is 35 miles per hour. In order to determine the impact of the proposed development on adjacent street traffic, traffic count data from Fuss & O'Neill 's files for the intersections in the -1- vicinity of the site was utilized, and traffic counts were conducted in January of 1989. The turning movement counts were projected to the 1991 design year using a 1.5 percent growth factor to account for normal growth in the area. Traffic from the following other developments was also added to the background volumes: 1. Buckland Hills 2. Lakewood Condominiums* 3. Heartland/Rickel 's Home Center* 4. J.C. Penny* 5. Town Shopping Center 6. Victorian Woods 7. Plum Ridge* 8. Firehouse/Office 9. Colonial Corner 10. Wapping Shopping Center 11. Buckland Hills Mixed Use Development 12. Gerber Scientific 13. John Fitch Industrial Park 14. Rye Business Park * These facilities have been completed and are now operating. However, since they were placed in operation after the counts were completed, their generated volumes were added to the projected count data to produce the peak hour external traffic volumes. The addition of traffic generated by these other developments to the projected 1991 turning movement counts produces the peak hour external traffic volumes, which represent design year traffic which does not have the site as its origin or destination. Figure Nos. 2 and 3 of Appendix B show the design year external peak hour traffic volumes. -2- The greatest traffic impact on the roadway network will occur during the A.M. and P.M. peak hours, the periods when commuter trips are at their highest levels. Traffic counts indicate that the A.M. peak hour is 7:00 to 8:00 A.M. and that the P.M. peak hour is 4:30 to 5:30 P.M. Therefore, these hours were subsequently analyzed. C. SITE GENERATED TRAFFIC Estimates of the amount of traffic generated by the development were made using the Institute of Transportation Engineers' 1987 publication "Trip Generation" . This publication is a compilation of trip generation data for similar facilities and gives data for entering and exiting traffic during the A.M. peak hour and P.M. peak hour, relative to the size of development. Using the number of square feet of office development proposed, the calculations yield the number of vehicles which can be expected to enter and exit the site during the peak hours and on a daily basis. These generation volumes are summarized in Table no. 1, of Appendix A. D. DISTRIBUTION OF SITE GENERATED TRAFFIC Terry Office Park is divided into two sections by the Plum Gulley Brook. The southern section is fully developed and consists of 7 buildings totalling 40, 100 S.F. The buildings are all connected by internal roadways with access to both Buckland Road and Deming Street. This section of Terry Office Park will be unaffected by the proposed expansion. The northern section consists of 5 buildings totalling 33,310 S.F. These buildings are connected by internal roadways and have access to Buckland Stre t. This section -3- will be connected to the Town Shopping Center, which is now under construction and is located to the north of Terry Office Park. This connection will provide both developments with access to Buckland Street and Ellington Road (Route 30) . The regional arrival/departure distribution to and from the proposed development is shown in Figure No. 4. This distribution was derived from existing traffic patterns and a demographic estimate of the population centers which would be origin points for the generated traffic. The site generated traffic was assigned to the roadway system in accordance with the arrival/departure distribution to produce the site-generated traffic volumes shown in Figure Nos. 5 and 6 of Appendix B. The site-generated traffic was then added to the 1991 external traffic volumes to produce the 1991 combined traffic volumes, presented in Figure Nos. 7 and 8 of Appendix B. E. ANALYSES 1. Capacity Analyses In discussing intersection capacity analyses, two terms are used to discuss the operating condition of the road or intersection. The volume to capacity ratio (v/c) is a ratio of the volume of traffic using an intersection to the total capacity of the intersection (the maximum number of vehicles that can utilize the intersection during an hour) . The v/c ratio can be used to describe the percentage of capacity utilized by a single intersection movement, a combination of movements, an entire intersection approach, or the intersection as a -4- whole. As the v/c ratio approaches 1, the intersection nears capacity and it may become impossible to accommodate all the vehicles attempting to travel through the intersection. Level of Service is a measure of the delay experienced by stopped vehicles at the intersection. Level of Service is rated on a scale from A to F, with A describing a condition of very low delay, and F describing a condition where average delays will exceed 50 seconds per vehicle. Delay is defined as a measure of driver discomfort, frustration, fuel consumption, and lost travel time. Therefore, intersections with longer delay times are less acceptable to most drivers. Level of Service is generally used to describe the operation (based on delay time) of both signalized and unsignalized intersections, while v/c ratio is applied to signalized capacity analyses only. The definitions for conducting signalized and unsignalized intersection capacity analyses are taken from the 1985 Highway Capacity Manual (Special Report No. 209) , published by the Transportation Research Board in 1985. The results of the analyses are as follows: a. Wapping Five Corners The Wapping Five Corners intersection is currently over capacity during the A.M. peak hour and the P.M. peak hour. The continued growth in the area has increased the overburden on this intersection. -5- There is no realistic possibility of capacity improvements, due to right-of-way constraints and the location of historically significant properties. With the increase in traffic due to the Terry Office Park development, this condition will continue. However, the additional delay will be minimal. b. Ellington Road (Route 30) at the Town Shopping Center Drive This signalized intersection is presently under construction as part of the Town Shopping Center Development. A roadway plan for this drive was submitted by Storch Associates with their application for certification. Under 1991 external traffic conditions, it will operated at Level of Service A (v/c 0.616) during the A.M. Peak Hour and provide a LOS B (v/c 0.894) during the P.M. Peak Hour. The Level of Service provided will remain unchanged with the addition of the site generated traffic. c. Buckland Road at the Terry Office Park, North Drive Under 1991 external and combined volume conditions negligible amounts of traffic will utilize this unsignalized drive. It is proposed that this drive be made "one way in" to facilitate internal traffic flow. The Wapping Five Corners intersection will cause sufficient gaps in the traffic to provid access to any northbound vehicles turning left into this drive. -6- d. Buckland Road at Terry Office Park, Center Drive Under 1991 external and combined traffic conditions northbound vehicles turning left into this unsignalized drive will experience a LOS C/D and vehicles exiting will experience Levels of Service from D to F. It is proposed that a left turn lane into the drive be provided on northbound Buckland Road and that the drive be widened to provide two lanes exiting. This will improve traffic flow on Buckland Road and decrease delay times on the site drive. e. Buckland Road at Terry Office Park, South Drive. Under 1991 external and combined traffic conditions northbound vehicles turning left into this unsignalized drive will experience a LOS B during the A.M. Peak Hour and a LOS C during the P.M. P ak Hour. Exiting vehicles will experience a LOS D during the A.M. Peak Hour and a LOS E during the P.M. Peak Hour. Conditions at this intersection are unaffected by the expansion. f. Buckland Road at Deming Street Under 1991 external and combined traffic conditions the following Levels of Service will exist at this unsignalized intersection: A.M. PEAK P.M. PEAK NB Buckland St. Lefts C C SB Buckland St. Lefts A D EB Deming Street E E WB Deming Street F F -7- The levels of service provided at this intersection will remain unchanged with the addition of the site generated traffic. 2. Sight Line Analysis The existing sight distance at the center drive will be maintained. Sight distance to the north is approximately 1000' to the Wapping Five Corners intersection. Sight distance to the south is approximately 10001 . No changes are proposed for the south drive and existing sight distances will remain over 1000' to the north and 700' to the south. 3. Accident History The South Windsor Police Department was contacted regarding the accident experience on Buckland Road in the vicinity of the site. No significant accident patterns were demonstrated. Therefore, the addition of site generated traffic at this location should cause no appreciable changes in accident frequencies. F. CONCLUSIONS Based on the foregoing analyses, it is the professional opinion of Fuss & O'Neill, Inc. that the proposed expansion will result in minimal change to Level of Service provided on the existing roadway system. The proposed improvem nt to Buckland Road will provide the best possible operation of this driveway. There should be no disruption to the existing continuity of traffic flow as a result of this development. 0119ATIS.9 -8- APPENDIX A TABLE NO. 1 Hourly Trip Generation Volumes Terry Office Park Expansion South Windsor, Connecticut 13,100 S.F. WINDSOR PLANNING DEPT. Mr William W. Stoeckert Executive Director State of Connecticut Traffic Commission 24 Wolcott Hill Road P.O. Drawer A Wethersfield, CT 06109 Re: Terry Office Park South Windsor, CT Dear Mr. Stoeckert: The following information is supplemental to our Application for Certification for the expansion of Terry Office Park. The expansion of Terry Office Park includes interconnection of it' s parking areas with those of the Town Shopping Center. This provides the Town Shopping Center with access to Buckland Road through Terry Office Park. When the interconnection is completed, some vehicles will use the Terry Office Park drive on Buckland Road to access the Town Shopping Center rather than it' s drive on Ellington Road. This redistribution of Town Shopping Center generated traffic was considered and is included in the 1991 External Traffic Volumes that were submitted with the application. The interconnection also provides the Terry Office Park with access to Ellington Road through the Town Shopping Center. We neglected to consider the vehicles from the existing Terry Office Park that will utilize the Ellington Road drive rather than the Buckland Road drive. The attached traffic volumes (revised 1-31-89 ) reflect this redistribution of traffic. The revised 1991 External Traffic Volumes include the existing Terry Office Park traffic and the traffic generated by the completely built and occupied Town Shopping Center with access to both Buckland Road and Ellington Road. The site generated traffic is traffic generated only by the proposed expansion of Terry Office Park. 146 HARTFORD ROAD / MANCHESTER, CONN. 06040 / TEL. (203) 646-2469, FAX. An interior road system was a very strong suggestion by town staff and the Planning and Zoning Commission. Our connector road from the Clark Corners to the Town Shopping Center simply abutted a road I believe the Planning and Zoning Commission approved on plans submitted by Town Shopping Center . The connected road from Terry Office to tine Town t'hopninq Center was the result of at least: Lwo meetings with the land owners and town staff . 's letter to them dated February 15, 1989. 1. Item #3 The interior road connecting Terry Office Park, Town Center and Clark Corners (if approved) is the proposed connector between the properties. Town Center plans, as approved, address this issue. My letter to you dated November 14, 1988, again on December 13, 1988, and a third letter from Storch Associates to the STC indicate I am in agreement with the connecting roadway system if all approvals meet State requirements and result in the Town Center being allowed full occupancy by all agencies. RSK has posted a $100,000 bond with the Town of South Windsor to ensure cooperation. What more cooperation is needed? However, as I have indicated to you, nowhere on Town Center plans is there a roadway around our 65,000 sq. ft. retail building, across private property of others on Deming Street and connecting to the Terry Office Park as you now propose. The issue of any additional roadways must be addressed by several property owners, including the two of us. 2. Item #4 The former Kuehn property at 1665 Ellington Road should be connected to the Town Center - Clark Corners roadway if approved. The elimination of the present driveway on Ellington Road is not at issue following the same reasoning that allowed you to retain the existing cuts to your properties on Buckland Road. I do believe you received our response as evidence above. As the issue of the roadway you are requesting was addressed in my letters, I feel I had no reason to become a part of your application. We Build Our Reputation We both have much more important things to occupy our time than a continuation of this type of correspondence. As I have suggested before, a piece-meal approach is not the answer. I feel I have bent over back- wards to be cooperative with you. At this time I again ask you if in some way you would want to participate in this application with a letter of intent that I sent to you. Also, two other items for discussion for possible letters of intent would be, 1, the drive and drainage easement from the former Kuehn property, 2 . the possibility of a drainage easement from Town Shopping Center to the pro- posed Clark Corners . Terry Office Park/Town Center The approved plan for Town Center by Fuss & O'Neil, last revision date of 4-22-88, pg. SD3, provides for a connector drive running parallel to Buckland Road and connecting at the property line with a drive running between Terry Office Park buildings occupied by First Federal Savings and Prudential Insurance and exiting to Buckland Road. Agreement for this connector was prepared by Attorney Solomen Kerensky but not executed. The connector shown on the plans for Terry Office Park Buckland Road Access by Fuss & O'Neil dated Nov. 88, sheet 1 of 1 and again on landscape and Plot Plan, Terry Office Park by Fuss & O'Neil dated Rev. 12-22-88, Sheet 2 of 3, is acceptable to me with conditions as stated in my letter to you dated December 13, 1988, with regard to the State Traffic Commissions' approval of this plan. (Copy Enclosed) . To date, the State has made no decision regarding our request. (Copy enclosed Storch Assoc. to State Traffic Commission 12-19-88.) At such time as this connection occurs, my position would be for each property owner to bear the cost of that portion of the connection which occurs on his property. II. Town Center/Clark Corners The approved plan for Town Center, by Fuss & O'Neil, last revision date of 7-21-88, pg. SD 2, provides for a "potential future connector road" parallel to Ellington Road and connecting to a "potential future connection from modified detention basin" as shown on plans for Clark Corners, Topographic Map by Fuss & O'Neil latest revision date of 1-9-89, pg. 4 of 9. It is my understanding based on information provided by Fuss & O'Neil that at such time as these roads are connected, modifications would have to be made to the Town Center detent basin. Is this the easement you make reference to in your letter of March 1? If so, my position would be for us to sit with Fuss & O'Neil when Clark Corners receives final approvals to make plans for the necessary modifications to that detent basin and any other improvements that may be required. It has been my position that I would pay to connect the road to Clark Corners property as shown on my approved Town Center plan. Any further We Build Our Reputation costs, if any imposed because of your additional approvals would not be my responsibility. Cross easements can best be accomplished with a legal document, executed upon the receipt of all approvals; i.e. , Town Center receiving STC approval for 100% use and Clark Corners receiving IW/CC, P & Z and STC approvals. My previous letters to you and my bond to the Town of South Windsor will certainly be sufficient to declare that there should be no further question regarding my intent to cooperate, there is no need for me to participate in your Clark Corners application currently before IW and P & Z since the plans address development to be conducted on your property only. Any modifications of requirement to Town Center approvals will be addressed by the Planning and Zoning Commission. Sincerely, 14 Richard S. Terry Office Park 1 . Site plan-application -for a 4,000 sq. ft. building in the northwesterly corner of ,Terry Office Park, westerly side of Buckland----Road, -Re zone. This is the last remaining building to be approved for this site ( the 9,000 sq ft building was approved on _9113/88 ) . The lot coverage is 10 . 25%; 25% allowed. There is no impervious coverage given on the plans- we have been told that it is 47%, there is a max in this zone of 60% . It appears that all other zoning requirements have been met. 2 . The parking formula as shown is a little confusing based upon the figures shown with the last approval. The engineeers for the applicant have indicated that for the total site there is 46 ,410 sq ft of office which requires 372 spaces . The aplicant previously received a waiver of 19 spaces, thus requesting a waiver of the remaining 81 spaces with total spaces on the site being 272 . This is a buidling to parking ratio of approximately 5 : 1 . 3 . There is no 100 year floodplain on the site; there are inland wetlands and this application has been approved by the IWA/CC on 4/17/89 with the following approval conditions: 1 . $5000 bond 2 . no other unusual conditions 4 . There is water and sewer servicing the site. WPCA approval is not required; however the collector of Revenue should be notified as to the increase in `developed acreage' for collector of revenue sewer connection charge. 5 . This site plan show the future extension road to the west of the site as was required with the last approval. However rather than provide a temporary cul de sac the applicant has shown a turn around stub which has adequate room for anyone who needs to turn around to be able to. this plan also shows the connector road to the Town Shopping Center site in a, different configuration than previously. The latest configuration was required to satisfy all parties, including STC. Some of the STC conditions include: (see attached) 6 . The landscaping plan as shown appears to be adequate. The applicnt proposes a variety of juniper; flowering dogwood, rhododendrum and canadian hemlocks . We would like to see some of the hemlocks interspersed with some other evergreen- preferably not white pine, 7 . The architectural submitted show a two story building made out of brick veneer clapboard typical with what is currently on the site. 1- If the plan is approved, the planning department requests the following modifications: dumpster should be shown on a concrete pad impervious coverage shown on the plan parking formula modified to reflect parking for the whole site STANDARD APPROVAL MODIFICATIONS FOR SITE PLAN (rev. 2/7/89) PROJECT 4t APPL. In order to expedite the approval process, we suggest the following: 1 . That the lane widths indicated in our January 24, 1989 report be provided within the existing roadway until such time as the town decides what lane widths it will require. 2. If the town requires that Buckland Road be widened, the developer of Terry Office park will either widen the roadway to provide the necessary widths for the lanes indicated in our report or he will equitably contribute to whatever program the town has for the improvement of Buckland Road as a whole. We feel that this will provide a safe operation on Buckland Road until the town finalizes its plans for improving the roadway. This will also allow the developer to proceed with his plans with the least amount of delay possible. 146 HARTFORD ROAD / MANCHESTER, CONN. 06040 / TEL. (203) 646-2469, FAX. Ford, the developer of Town Shopping Center's representative, concurred with Condition Nos. 1 and 14 when contacted on March 17, 1989. REPORT OF FINDINGS TOWN OF SOUTH WINDSOR TERRY OFFICE PARK BUCKLAND ROAD Site Description: Terry Office Park is located on the west side of Buckland Road approximately 1000 feet south of the Wapping Five Corners Intersection. The total development will consist of 14 buildings totaling 86,510 square feet and 517 parking spaces. The development currently consists of 12 buildings totaling 73,410 square feet and 438 parking spaces. The 13,100 square foot expansion will be two buildings intended for general office use. Terry Office Park is divided in two sections by Plum Gulley Brook. The southern section is fully developed and consists of seven buildings totaling 40,100 square feet. This section has access to both Buckland Road and Deming Street, but does not have access to the northern section of the development. The northern section, presently consisting -of 33,310 square feet, has access to Buckland Road. This section will be connected to the Town Shopping Center (presently under construction) which is located to the north of Terry Office Park. This connection will provide both develop- ments with access to Buckland Street and Ellington Road (Route 30) . Site-Generated Traffic: The entire Terry Office Park will generate approximately 84 vehicles- during the a.m. peak and 350 vehicles during the p.m. peak. The southern section of the development generates approximately 16 vehicles during the a.m. peak (11 in, 5 out) and 126 vehicles during the p.m. peak (35 in, 91 out) . The northern section will generate approximately 68 vehicles during the a.m. peak (52 in, 16 out) and 224 vehicles during the p.m. peak (91 in, 133 out) . The distribution of the entire site-generated traffic will be approximately as follows: 17% to and 9% from the west on Route 30 (Ellington Road) , 38'/o to and 49% from the north on Buckland Road (through the Wapping Five Corners Intersection) , 33% to and 34% from the south on Buckland Road, 5% to and 4% from the west on Deming Street and 7% to and 4% from the east on Deming Street. Department of Transportation Projects: Major widening of Buckland Road from the Manchester Town Line to Route 30 is proposed under Project No. 132-100. Final design plans are scheduled for February 1991 with advertising scheduled for March 1992. However, the project is listed as Priority Group 3,indicating that the project has funding for preliminary engineering only, and the schedule for advertising is tentative depending on the availability of funding. Report of Findings -2- STC No. 132-8901-02 The relocation of Route 74 from the Wapping Five Corners Intersec- tion to Route 194,approximately 1400 feet north of Route 30 is proposed under Project No. 132-102. Final design plans are scheduled for March 1990 with advertising scheduled for January 1991. This project is also listed as a Priority Group 3, indicating that funds are not available for construction at this time. Developer's Recommendations: 1. That the developer provide a northbound left-turn lane on Buckland Road at the center drive and that the drive be widened to provide two egress lanes. 2. That the developer restrict the north drive to Terry Office Park on Buckland Road to one-way in. 3. That the developer construct the portion of the connector road between Terry Office Park and Town Shopping Center from the center drive on Buckland Road to his property limits. Departmental Concerns: The proposed number of left-turning vehicles on Buckland Road at the center site drive to Terry Office Park and the opposing volume on Buckland Road indicate that an exclusive left-turn lane is required at this location. Due to the existance of metal beam rail along both edges of road in this area, it is recommended by both the State and Town of South Windsor that the road be widened four feet on the west side to a total width of 40 feet to provide motorists adequate clearance from the guide rail and the off-road obstacles. The Town Shopping Center site-generated traffic will be using the center site drive to Terry Office Park as access to and from Buckland Road. This volume represents a significant portion of the volumes at this drive. It is recommended that the developer of Terry Office Park widen Buckland Road and install the northbound left-turn lane, and the developer of Town Shopping Center equitably participate in the cost of this widening. Terry Office Park site-generated traffic will be using the Town Shopping Center access drive on Route 30 as access to and from the west on Route 30 (Ellington Road). Due to this volume, it is recommended that the developer of Terry Office Park equitably participate with the developer of Town Shopping Center in all costs of the signal installation at this location. As a condition, we were required to widen Auckland Road. In order to meet that condition, we have to move three telephone poles . At that time and up until now, I have been meeting with Mr. Min Lee , Field Engineer of SNET. He in turn has been meeting with town staff to coordinate the moving of said telephone poles with the proposed widening of Buckland Road. At this date, SNET will not move any poles , ( to eliminate any future duplication of this work) . As a result, it will be impossible for us to widen Buckland Road until that time. Shortly, all other requirements of said approved application will be complete and building occupancy scheduled for the midd'-a or end of October, 1989 . At this time , I am asking for an extension of that one condition. As in the past and with the issue of sidewalks on Buckland Road, I intend to fully cooperate with the Planning and Zoning Commission and work with town staff to improve Buckland Road . Please advise me on this matter as soon as possible. It is at this time an area out of my control , however, this matter has serious bearing on leases and moving schedules for the tenants . I wish to bring up the following four points! 1. 1 want to be cooperative in developing the five tottitts area, Previous applications submitted and approvals granted support this stdtptoent. At this point in time, however, I have no written agreement froul Mrs gamsel for a connector road southerly of Town Center thru Terry Office Park. Ad application for future development of Terry Office Park has been filed with Planning and Zoning Commission. 2. I have on file with the Town of South Windsor a $100#000 bond to ensure connectors with the Terry Office Park and the Waldron Property (Clark Corners) of which Mr. Samsel is now a principal. I have had discussions with Mr. Samael regarding a connector road to Waldron property (Clark Corners) but no written agreement because of the pending application before the commission. 3. At no time have I had an agreement with anyone to develop a road system from Terry Office Park behind the Town Center southerly of- the Bank of South Windsor hitilding to Waldron and Town Center connector roads. I question why the road is there and whether it is a good location? 4. Lastly, the commission approved an application for 1665 Ellington Road (known as the Kuehn Building) . Provisions should be considered for connecting this parcel, when developed, to the Waldron property it developed. This would be another connector road to permit traffic to flow freely throughout the complex. I am not opposed to this application. I want to point out the fact that agreements must be signed in order to make understandings a reality. Thank you for your consideration.
