WINDSOR PLANNING DEPL South Windsor CT 06074 Re: Donald W. Fish Dear Marcia: Thank you for sending me the legal opinion dated March 17, 1986. You will note in the legal opinion, the former Town Attorney says that no amendment can be made without a new application. Since he is using the term amendment, and later on he talks about amending an approval, I think his point is that you need a new application asking for the amendment. This does not require an entire new hearing, but merely requires an application to amend the former approval in some specific way. This is consistent with the former Town Attorney's feeling that you should go through the process for the amendment in the same manner that you went through the original approval. Therefore, it seems to me that the approach here is to file an application specifically requesting an amendment, and providing that infor- mation that would be required for the Commission to be able to evaluate the request. I would like you to consider this letter, and call me when you have an opportunity. I understand that you have received the new information from Design Professionals, and I assume that you have passed it on. Would you please let me know if it is acceptable.
