SOUT11 WINDSOR PLANNING AND ZONING COMMISSION
PUBLIC HEARING - Jun 20, 1972
MEMBERS PRESENT: Mrs. Fvans, Messrs. Gilligan, Kupchunos
ALTERNATES PRESENT: Messrs. Ryan and Kicholsoq, alternates for
Messrs. Grace and Andrus.
Mr. Gilligan, acting chairr:an, opened the public hearing following the
announcement of alternates and the reading of the legal notice as it
appeared in the Journal-Inquirer June 9th and 16th.
Item 1* was the application of Edward Amenta for amendment to section
4.1.8 of the zoning regulations to allow the construction of two-family
hous s as a special use in residential zones.
Attorney Frank Ahearn of South Windsor -cited a League of Wamen Voters'
study done in 1971 which called for towns to meet their obligation by
achi wing a diversified housing supply for all income groups. The report
considered South Windsor'a zoning regulations to be restrictive and recom-
mend d that action be taken before the State would be forced to step in
with corrective measures. Attorney .Ahearn said two-family houses are only
allowed in buildings having more than 30,000 sq. fte and built prior to
1940, prior to conversion. He said many people cannot afford to live in
the single-family type of dwellinz presently being built in South Windsor.
He felt the Commission could write adequate controls into the regulation
t protect the type of two-family houses for construction, and that it
would fit well under a special use by meeting certain standards. :fir. Ahearn
said that several realtors, specifically Richards and Kehmna, support his
claim that there is a demand for two-fa-Tily homes and that South Windsor
should face up to its responsibility.
Mrs. Barbara Zbell, 104 Greenfield Drivel speaking as President of the
League of Women Voters, cited the extensive housing study completed by the
League in 1971 which revealed that there is virtually no housing available
in South Windsor for families with incomes below S109000o She said the
lderly, young-marrieds, teachers, etc. who fall in this income bracket
could benefit from increased housing made available through two-family house
construction and she urged the adoption of the proposed amendment.
Mrs. Richards of the real-estate firm, said that the Town's young people
cannot afford to remain here once they are married as the available housing
is too expensive. She felt rental of a two-family home could be a partial
solution. She said she has also received specific inquiries from several
teachers who have expressed a desire for two-family ho s sii ce it would
be less expensive (than single-family) for the type o hote they want.
Mrs. Richards also said the two-family home is ideal for those couples who
would like to have their parents live nearby, yet in a separate household.
Jan Tarr, 31 Elizabeth Street, spoke in favor of the proposed amendment. Sh
said she was fortunate to move into South Windsor when she could afford it,
which would not be the case today. She feels that this type of home is
need d in South Windsor and she agrees with the League- of V-omen Voters'
position.
Jill Clinta4, 118 Orchard Hill Drive, said the n d for additional housing
in Town is great and that th type of apartm nts being built will not m et
th ne do of 1 w and m derate inc me p opl . Sh f It two-family hous a
would be a practical and reasonable way to help m et this n d.
Another member of the public stated that he had been looking for a tw -
family dwelling for some time. He said he had lived in South Windsor t n
years and cannot afford to build a new home.
Dorothy Pelikan, broker with Richards and Kehmna Realtors, said then is
also a need for this type of housing for families with teenage childr n
who would learn the responsibility of home care that they would not hav
in an apartment.
•'k
Jun Brady of Strong Road, wife of a teacher, said she was in favor of th
am ndment. She said she attended an Interfaith Housing conference wh r
Gordon Buck of the Governor's Task Force said the Towns will be prodd d if
th y don't help to meet the demand.
Marcia Fox said she was opposed to the amendment and wanted to know what th
rentals would be. Attorney Ahearn said there would probably be som high,
some low rentals, but that before the issue of rentals could be discussed
the Town would have to have a regulation permitting the construction of
two-family homes.
Robert Martin of Miller Road wanted to know where the two-family hom s
would be built. Attorney Ahearn said he is asking the amendment to allow
tw -family houses in any residential zone, as a special use. He did not
think, however, that they should be put opposite AA-30 and AA-40 homes.
R nata Rioux, 41 Foster Street, said she was opposed to the amendment n
such a large scale as outlined in a Hartford Times article which cited
plans for 95-100 two-family dwelling units on an 80 acre parcel on Fost r
Road. She said this would mean 200 families with possibly 400 or mor
children and she was worried about the impact on the school system.
Mr. Gilligan said the Commission was only considering an application for
a zoning amendment and not for a specific parcel. He said that if and
wh n the proposed amendment was approved, a builder would have to submit
another application for specific houses on a specific tract to be heard
at another public hearing.
Mrs. Rioux said she understood the distinction between the two types of
applications. However, she said she "doesn't see how, if these peopl
can' t afford to live here, how the Town can afford to let them in." She
also did not agree with the statement that two-family homes would fit int
a residential area.
Mr. Henry Scheckley of Chapel Road said he doesn't think there is a "dying
n ed" for two-family homes based on the three specific cases cited by th
realtors. He also said he doesn't think the State will force the Town to
build additional housing. Attorney .Ahearn replied that most any realtor
in Town would support the need for two-family homes and that Massachus tto
has forced towns to modify their regulations, though it has not yet be n
don in Connecticut.
Mr. Trotman of !Hain Street said he liv s in a two-family hous . He said he
was a former newsman from Massachu etts and b lieves the responsibility of
the small towns to the citi s is a fallacious argument since the cities
have not met their obligations to the towns. He said th responsibility
li s with the citizens - no one else. He said the need should be estab-
lish d by the people who need it, not the real estate brokers who stand to
gain. He agreed with Mrs. Riotix' concern on the number of- children that
will b brought into Town. He eatd we should wait for more industry in
Town.
In response to questions by the Commission, Mr. Amenta said the proposed
two-family houses he was contemplating would sell between 948-510000 and'
that the two-family homes would be a compromise between apartments and
singl -family homes. No studies had been made on the average number of
children in two-family homes. He and Attorney Ahearn felt that sewers
sh uld be a requirement with minimum 100 foot frontage on an approximate
3/4 acre lot, or possibly less.
Mrs. Clinton said that families with incomes of about S129000 could probably
afford one-half of a two-family home, i.e. $259000. Mrs. Tarr said the
Sheldon Oaks project in Hartford has a ceiling of S229 a month rentals and
that only some of these are subsidized. There was additional discussion on
means of financing two-family mortgages and how the regulations can affect
the price of the homes, depending on the stringency of requirements. There
wer no further comments for or against the application and this portion of
the public hearing was declared closed.
It m 2* was the application of William E. and Carolyn McGill for re-subdiv-
isi n of property at 1448 Ellington Road. Dr. Andrus was present for this
portion of the public hearing and Mr. Nicholson announced that he was dis-
qualifying himself from this item on the agenda. Attorney Edward Kuehn
who represented the applicant, said that the original three-lot subdivision
was approved by the Commission this past fall and that the McGills now want
to subdivide the center parcel (lot #2) into three parcels. Maps- were dis-
played showing the re-subdivision with lots #1 and #3 (east and We►%) of the
original subdivision remaining unchanged. Contour maps and water-table tests
were not available, though Attorney Kuehn said these had been submitted.
There were no further comments for or against the application and this
portion of the public hearing was declared closed.
It m 3* was the application of the Town of South Windsor for a special
exception under section 4.1.8 for construction of a library in an RR zon ,
represented by Mr. William Clayton Massey, Library Director. Mr. Massey
submitted a site plan showing the location of the proposed library• on land
just south of the Town Hell, with additional parking for 100 cars to be pro-
vid d. The building would be on two levels with a total of 149775 sq* ft. ,
and of an architectural style harmonious with the Town Hall. Existing road-
ways Will not be changed with access from both Ellington Road and Sullivan
AY4nue. The building is planned in two phases, based on population growth,
with 4300 sq. fto on the lower level being unfinished. Mr. Massey said the
Public Building Commission has been working on the plans with the architect-
ural firm of Moore and Salsbury and that the proposed plans were the least
d structive to the site. He submitted a copy of the "Building Program for
the South Windsor Public Library", revised March, 1972 for the Commission's
r view.
Th r wer , n oth r comments for or against the application and
Mr. Gilligan d clared the public hearing closed.
WORK SESSION
Attorney Palmer McGee of Day, Berry and Howard presented a site dev 1 p-
ment plan of R.P.I. for the proposed Nassau Furniture operation at
1315 John Fitch Blvd. Mrs. Evans disqualified herself from this applica-
tion and Mr. Nicholson was appointed alternate. Attorney McGee said, that
all the conditions outlined in the letter of approval for R.P.I.'s sp cial
xception granted on May 16th had been listed on the site plan, as follows:
- Parking facilities shall be provided for eighty cars.
- There shall be no outside storage, display or sales.
- The floor space to be used for retail sales shall be limited as
follows:
With respect to existing buildings,, floor area used for retail
sales in the existing buildings shall not exceed 65% except for
warehouse sales involving the entire property and held not more
frequently than an, average of one per month-

area used for retail sales when and if additional buildings shall
be constructed on the premises shall not exceed 50% of the total

be parked to the rear of the main building so as not to be visible
from Route 5.
- There shall be no access from Route 5e
- 199 Strong Road building not included in special exception us .
Attorney McGee said the land and buildings still belonged to R.P.I. con-
tingent upon site approval and that Nassau did not contemplate any major
changes. He said that the conditions on the plan would be binding to
successive owners.
Mr. Ryan made the motion, seconded by Dr. Andrus to approve the site
development plan of Rensselaer Polytechnic Institute, as submitted on
maps dated May, 1972. Motion was unanimously voted and so ordered.
Item 2. The McGill application for re-subdivision was deferred until
next week, pending review of the topographical maps and seepage tests.
Item 3. There was discussion on the application for a special exception
for the Town Library as to whether additional site plans would be required.
. Dr. Andrus. made the motion, seconded by Mr. Ryan, to approve the applica-
tion of the Town of South Windsor for a special exception under section
4.1.8 for construction of a library in an RR zone with the condition that
prior to construction, a more detailed site development plan be submitted
for Commission approval, as outlined in section 4.11 of the regulations.
Motion was unanimously voted and so ordered. The effective date is
Tuesday, June 279 1972.
Item 1. The Amenta application for amendment to the regulations is
deferred until next week. Mr. Nicholson suggested that Attorneys Lassman -
and Ah am b contacted for recommendations on two-family house specifica-

Dear Bill:
The Town Council, at a Special Meeting on June 27, 1977, voted
to approve the following resolution:
BE IT RESOLVED that the South Windsor Town Council
hereby authorizes the Town Manager to resubmit
applications under Round Two of the Local Public
Works Program for the following projects in order
of priority: LIBRARY.
The only change from the original application is that the project
will be reduced in scope from 25,000 sq. ft. to approximately
152000 sq. ft. As the application is a resubmission, Mr. Talbot
intends to resubmit your letter of October 13, 1976 advising
that a Special Exception was approved on June 20, 1972.
I note that five years have elapsed since this approval and would
appreciate your advising me if the Special Exception is still
valid, as this has to be submitted with the application before
July 8th to be eligible for funding.
The Public Building Commission will be working with the architect
under an extremely tight time schedule as EDA requires construction
to begin within 90 days of approval. Other than site plan approval,
would you please let me know if there are any other requirements
or procedures to be followed involving the Planning and Zoning
Commission.

Gentlemen:
We have designed the storm water system for the above project
based upon 10 year storm, Rational Formula.
The runoff at the outflow of the existing 15 inch RCP near the
southeasterly corner of the site will be 7. 91 c. f. s.
We also computed the existing runoff at this point at 4. 40 c. f. s. ,
which indicates an increase in runoff for a ten year storm of 3. 51
c. f. s.
To provide control of siltation during construction, and until paving
is completed and a stand of grass has been established, we propose
the use of hay bales, staked in place. The bales are to be located
at all areas where runoff flows to the existing drives, or to offsite.
In addition, all drainage structures within the construction area are
to be surrounded by hay bales. The Contractor will be required to
maintain the bales, remove build- up of silt, and to replace bales
which become damaged or silted up.
A copy of the drainage computations is enclosed.

Dear Mr. Talbot:
This is to notify you that the Planning and Zoning Commission voted to
approve the application of the Town of South Windsor for a site plan
of development for a library on property located on Sullivan Avenue,
South Windsor in a RR Zone, subject to the following conditions:
1. The diagonal parking shown .on the plans in front of the building shall
be eliminated. Parallel parking shall be indicated at this location.
The width of the parallel parking shall be 10 feet.
2. Adequate lighting shall be installed in the following areas: (a)
the parking area and driveway in front of the building; (b) the
entrance to the site located on Ellington Road; (c) the rear parking
area. This lighting shall be installed in accordance with Section
8.7.3 of the Zoning Regulations.
3. The concept of zero increase in storm water run-off will not be used
on this site because the increase into an existing storm drainage
system is insignificant and not considered serious. The Commission
recommends that a study be made of this site to determine the
feasibility of modifying the site to a zero increase in storm water
run-off in the future. Improvements or development of this site in
the future shall consider the storm water run-off from the library
and town hall, and any drainage system shall be redesigned for a
zero increase in run-off from the basic undeveloped site.
Paul F. Talbot -2- October 19, 1977
4. A 24" x 36" black and transparent map, printed on polyester film,
and one paper print of this site plan shall be submitted to the
Planning and Zoning Commission to be stamped and signed and filed
in the Office of the Town Clerk of the Town of South Windsor.
The following -letters shall be reproduced on the map and made part
of the final plans: (a) this letter of approval from the Planning
and Zoning Commission; (b) the letter of approval from the Inland-
Wetlands Agency; (c) the letter from the Planning and Zoning Commission,
dated June 30, 1977, verifying that a Special Exception was granted
on June 20, 1972, pursuant to Section 4.1.8 of the Zoning Regulations
for construction of a library on the subject property.
