PLANNING AND ZONING COMMISSION JUNE S , 1984
PUBLIC HEARING & SPECIAL MEETING SOUTH WINDSOR TO N HALL
MEMBERS PRESENT: Sorenson, Montana, Conde , Smith , Soro iak
ALTERNATES PRESENT: Klenke (sitting for Gilligan)
PUBLIC HEARINGS
The secretary read the legal notice, a copy of which is attached
hereto .
1 . Application of Jean Marc Jacques for a zone chap a from RR
to A-20 for approximately 71 . 8 acres 'located on westerly
side of Clark Street , north of Smith Street .
Attorney Raymond G. LeFoll of 2307 Silas Deane Highway , Rocky Hill ,
was present on behalf ofthe applicant Jean Marc Jacques . This
parcel consists of about 71 acres on the west side of Clark Street
and presently abuts an A-20 zone which is part of the La2aava
Subdivision, and also abuts an MF-A zone , Indian Ridge C ndominiums .
It is approximately 2 , 000 feet from the intersection of lark and
Pleasant Valley Road , and is services by water , sewers , alectric
and other utilities . Directly across the street interse ting with
Clark Street is Smith Street , which contains a multi-family zone
presently being developed by Mr . Alexander , and up the s reet is
another multi-family zone which is being developed by th applicant
and will be known as Pleasant Hill Condominiums . Mr . Le oll noted
that during hearings for condominium developments the pu lic
expressed need for single family homes , and that is what they are
proposing here . This is compatible with the Plan of Deve opment .
Ken Smith of Reino Hyyppa & Associates of Glastonbury , t e engineer
for Jean Marc Jacques , pointed out the area on a map and also pointed
out a proposed subdivision layout . They are proposing between
60 and 70 lots which will be approximately one unit per cre . Sewers
would be in an easterly direction to Clark Street , and water is
available on Clark Street . The applicant recently approached the
Commission regarding potential stockpiling on this site, but no
decision was made . There is no problem with flooding . Drainage would
be carried to Podunk pond and the increase in run-off would be minimal .
A portion of this property is in wetlands and they do not. propose
to develop it .
Bruce Hillson of Purcell Associates of Glastonbury was p esent and
reviewed his report -dated May , 1984, which stated in part :
"Access to the subdivision will be via two subdivision roads
intersecting Clark Street . The exact location of t ese sub-
division roads will be determined during preparati n of the
subdivision plans . The Town desires that one of thE streets
connect to the easterly end of Quarry Brook Drive , creating a
street running between Ellington Road and Clark Street . . . . .
For the purpose of this study, we assumed that all existing
traffic on Quarry Brook Drive plus all traffic expected from
the 70 lot subdivision, plus all traffic expected from the
Planning & Zoning Commission -2- 6/5/84
previously approved, but unconstructed 60 single-family
homes in the LaCava subdivision would travel the intersection
of Quarry Brook Drive at Ellington Road . We then assumed
that all existing and expected traffic would travel the
intersection of the new subdivision road at Clark Street . "
"The intersection of Ellington Road with Quarry Brook Drive
is presently operating at a Level of Service E during the
morning and afternoon peak hours and is expected to continue
operating at this Level of Service during the morning and
afternoon peak hours. A Level of Service C or better is
expected during the remainder of he day . The intersections
of Clark Street with the- new subdivision roads are expected
to operate at a Level of Service B or better throughout the
day . . . . . The analyses also indicate a capacity constraint
could occur at the intersection of Quarry Brook Drive and
Ellington Road . This intersection should be monitored by -the ,
Town to determine the need for a traffic signal if Quarry
Brook Drive is continued thru to Clark Street . "
"Summary and Conclusions : The proposed zone change and subse-
quent 70 lot subdivision is expected to genrate a total of
700 vehicle trips per day . During the morning peak hour 39
vehicles will exit the development and 14 will enter ; the number
of exiting and entering vehicles during the afternoon peak hour
are 26 and 44 respectively . The Level of Service at the
intersection of Ellington Road and Quarry Brook Drive is
expected to operate a a Level of Service E during the morning
and afternoon peaks and a Level of Service C or better the
remainder of the day . This intersection is presently operating
at a Level of Service E and should be monitored by the Town for
the need of a traffic signal . The intersection of Clark Street
and the new subdivision roads are expected to operate at a
Level of Service B or better throughout the day . The
capacity analyses were done assuming all existing and expected
traffic would travel each intersection allowing for the
"worse case" condition which is not expected to occur . No
roadway or traffic operation improvements are necessary due to
the traffic generated by the proposed subdivision with access
to Clark Street . "
Mr . LeFoll noted that the homes that would be built would be similar
to the dwellings at Chapel Hill Subdivision or Pleasant Valley Homes .
He concluded that this property lends itself to A-20 development , will
be services by all utilities and meets all engineering requirements .
-= Mr . DeMallie reported as follows : There are some flood plain areas
along Plum Gulley Brook as well as Vinton ' s Pond near the Boxer
parcel and Indian Ridge Condominiums . If this application is
approved the flood plain area must be excluded . There are some
.. wetlands along Plumb Gulley Brook and there is a small seasonal brook.
LaCava ' s Beechwood Farm subdivision is to the northwest , and this
was approved but the plans were never filed and the subdivison never
persued . There are small wetlands scattered througout the site , and
there are some relatively steep banks . The comprehensive plan calls
Planning & Zoning Commission -3- 6/5/8
for medium density , or two families per acre . Mr . Della lie recommended
that the area be developed as an open space subdivision similar to
Tudor Hill and Beechwood Farms . Open space should be required
all around the circumference of Vinton ' s Pond and should be a
substantial amount if the Town can get it . There should also be
open space by Plum Gulley Brook.
Mr . DeMallie continued that Quarry Brook Drive would not be its
current length unless it was intended that it be continued to Clark
Street . The Beechwood subdivision was to have a road c ming out .
The Commission may wish to consider holding money in es row for a
traffic light on- Ellington, as they did in the Indian Ridge
Condominium matter . Consideration should be given to placement of
the houses in view of the CL&P easement , and the througn street
from Quarry Brook Drive should follow an indirect pattern to
discourage through traffic .
Mr . Martel , the Town Engineer , reported: Sewers and water are
available , and the paramount concern is drainage whichshould '-be
in accordance with the Town ' s zero run-off policy . The integrity of
the flood plain should be kept intact .
No one in the audience spoke in favor of , or in opposition to this
application.
Commissioner Sorenson asked if this zone change is not approved
would the applicant still want to stockpile on this site, and
Mr . LeFoll noted that some materials were to be used on this site
and some were to be used elsewhere .
Mrs . Montana asked whether there would be any problem with open
space around the pond, and Mr . LeFoll replied no , that whenthe
subdivision application comes in the Commission could review it .
Mr . Conde asked how much of the land is wetlands, and a d Mr . Ken
Smith that with 60 lots on this site , about one-third w uld remain
undeveloped. Mr . Smith also clarified that most of the fill
that will placed on this site is gravel and would be used in
development whether the site is developed A-20 or RR.
Commissioner Smith asked when the traffic study was done, and Mr .
Hillson replied that it was taken on April 19, 20 , 22 and 23rd with
most of the count taken on April 18 and 19 .
2. Application of R. J . Alexander, Inc . for a resubdiv ' sion of
6 lots located on the south side of Brookfield Street , opposite
Wentworth Drive , in an A-20 zone .
Attorney Ralph Alexander was present on behalf of the a plicant and
pointed to the site on a map . He reported that the first approval
for Wentworth Estates was in 1973 , and they have been developing about
five houses per year over the past 11 years . They are asking for
6 lots , all of which exceed the area required. The Pod nk River
cuts behind this parcel and this will be the end of the development .
Planning & Zoning Commission -4- 6/5/84
They do not intend to install sidewalks on the proposed cul-de-sac
street . They have secured approval from the Conservation Commission,
Water Pollution Control Authority and Fire Marshal .
Mr . Joseph Russo of Palmberg & Russo were present and said the street
is approximately 460 ' long and is opposite Wentworth Drive . Very
little regrading is required and drainage will be brought down
approximately half way and tied into the present drainage system
on Brookfield . The back of the lots drop off towards the Podunk
and there will be grading on two lots , but they tried not to
change the existing contours .
Mr . Raymond Alexander was present and informed the Commission that
this site is serviced by gas , water, sewers and cable television .
Mr . DeMallie , Planning Director , reported that the small open
spqce area should be deeded to the Town , and there will be
future open space area along the Podunk. South Windsor Heights
owns all of the land along the Podunk going to Eli Terry School. .
Town Engineer Martel had no comments .
No one in the audience spoke in favor or in opposition to this
application.
Commissioner Conde asked if there was any reason other than cost
why sidewalks were not planned for the cul-de-sac street , and
Mr . Ray Alexander replied that he thinks they are an unnecessary
luxury and the street will be Alexander Place and they are
trying to achieve an informal appearance .
Mr . Sorenson noted that the Commission may be creating a problem
by not connecting the open space .
SPECIAL MEETING
1 . Deming Hill Associates , General Plan of Development
Mrs . Montana , who was chairing this meeting , disqualified herself
from acting in this matter . Mr . Sorenson chaired this portion
of the meeting . Mr . Conde made a motion granting a 90 day extension
of time in which to file the final plans in this matter . The
extension is from July 9 , 1984 to October 7 , 1984 . Mrs . Klenke
seconded the motion and it was unanimously voted in favor and so
ordered .
2 . Pleasant Hill Condominiums , J & R Realty Co .
Mrs . Montana referred to a letter from the Town Attorney , Richard M.
Rittenband , approving the form of the $830 , 000 letter of credit ,
but reminding the Commission it was only for a one year term. Mr . Sor-
enson made a motion that the Commission accept this letter of credit
in lieu of a surety bond . Mr . Conde seconded the motion and it
was unanimously voted in favor and so ordered.
Planning & Zoning Commission -5- 6/5/84
3 . App. #1003 - Bradford L. Wright , Subdivision , w/s Buckland Road
Attorney Harold Cummings was present on behalf of the applicant ,
who wishes to cut a lot out of his mother ' s property oa Buckland
Road for the purpose of building a house . There is a1 o an
existing house on this parcel . Mrs . Montana told Mr . Wright
that the Commission is not contemplating many more residences
on this side of Buckland Road, and Mr. DeMallie noted that
he should be aware of the fact that eventually it is p anned that
Buckland Road will be widened as soon as funds are available .
Mr . Conde suggested Mr . Wright set the house back as f r as
he can, and Mr . Wright said he intended to do so .
Mrs . Montana said she just wanted Mr . Wright to be aware of the
fact that land along this road will be developed in ye rs to come ,
and traffic will increase , and it is already heavy . Mr . DeMallie
• ggested there be a turn-around driveway .
Mr . Sorenson made a motion to approve this application for a one
lot suhdivision in an RR zone , as shown on a plan prep red by John L.
Thompson, L. S . , dated May 5 , 1984 , subject to the fol owing
modifications :
1 . A turn-around driveway is required on this lot .
2 . No building permit will be issued until the final
plan has been filed in the Town Clerk' s Offic .
A 24" x 36" black and white transparent mylar , t gether with
three paper prints , with the letter of approval of this
Commission reproduced thereon, must be submitted to this
this Commission to be stamped and signed within 9C days
of the date of approval (by 9/3/84) .
Mrs . Klenke seconded the motion and it was unanimously voted in
favor and so ordered.
4 . App . #1004 - Joseph Saczawa , Site Plan , s/s Chapel Road , I zone
Mr . Richard Meehan of Boud and Meehan was present on behalf of the
applicant and noted that the building is located on less than one
acre , near the drive-in theatre , and 3 businesses are operating out
of it . The two machine shops will move into the new building. All
the drainage will be handled on site through dry wells . The new
building will employ 10 people and they have provided six parking
spaces , plus one handicapped space . Mrs . Montana noted that the
Commission would like to see some nice landscaping on the site
to enhance the appearance .
Mr . Sorenson made a motion to approve this application for a site
plan of development for property located on the south side of Chapel
Road, east of Route 5 , in an I zone , as shown on a plan prepared
by Boud & Meehan dated 4-9-84 , revised to 5-2-84 , File io . 84310 ,
subject to the following modifications:
Planning & Zoning Commission -6- 6/5/84

Commission to be stamped and signed within 90 days of the
date of approval (by 9/3/84) .
Mrs . Klenke seconded the motion and it was unanimously voted in
favor and so ordered .
5 . App . #992 , Robert Olivieri (American Graphics) , Site Plan
Mrs . Montana read a letter from Mr . Olivieri requesting that
the Commission modify the approval granted in the above matter .
by not requiring him to plant white pines in view of the fact that
he felt trees would have to be cut down in order to make room for
the white pines . Town Engineer Martel noted that trees would have to
be cleared to make room, and Mr . DeMallied agreed with him.
Philip Braender , Nancy Braender and Rosalie Bartula , who live in
the adjacent residential area, were present . After a brief
discussion , Mr . DeMallie suggested the trees could be planted
closer to the building , and Mrs . Klenke made a motion to amend
the approval in this matter to specify that white pine trees are
to be planted in a staggered row in front of the area designated
"foliage line" on the approved plan , and the remaining trees should
be scattered throughout the wooded area .
Mr . Conde seconded the motion and it was unanimously voted in favor
and so ordered .
Planning & Zoning Commission -7- /5/84
6 . App. #991 - Graushinsk /Ne ron Resubdivision, westerly end of
Berle Road
Attorney James Throwe , who represented the applicants at the public
hearing , was present . The Commissioners reviewed the map , and
Mr . DeMallie noted that the only problem he has is tha the
subdivision regulations state that the street must be Extended.
Mr . Conde replied that the road would have to be built to
Town specifications and he can ' t see making them to th t . He
suggested that the driveway simply be extended . Mr . D Mallie
again reminded the Commission there is a subdivision r gulation ,
and Mrs . Montana noted that the Commission doesn ' t want to set
a precedent , however , this is only one lot . She noted that
before any further lots are approved the Commission c uld
require the road to be built, or that the new lots front on another
road .
There was further discussion and Mrs . Smith made a motion to approve
the above application for a resubdivision on the weste ly end of
Berle Road , A-40 zone, as shown on a plan prepared by A .H . Feinstein,
L. S . , dated March 9 , 1984 , subject to the following m difications :
1 . The side yard should be corrected to indicate it is
20 feet rather than 40 feet .
2 . This is an extension of an existing cul-de-sac for one
lot only , and if further development of this property
is contemplated it will necessitate the road being
extended in accordance with Town specifications .
A 24" x 36" black and white transparent mylar , together with
three paper prints , with the approval letter of this
Commission reproduced thereon , must be submitted to this
Commission to be stamped and signed within 90 days of the date

Robert F . Gilligan , Chairman
David Sorenson , Secretary
6. J. M. J. Construction Co. , Stockpiling
Chairman Gilligan informed Attorney LeFoll and Mr. Ken Smith that his
Commission has already discussed this matter a couple of times, and asked
if this plan was going to be the final plan. Mr. Smith explained that
they can't use the Newmarker Road site for stockpiling since it is being
farmed, and the Clark Street site, which the Commission is considering tonight,
is close to both Pleasant Hill Condominiums and Pleasant Valley Homes.
Mr. Gilligan noted that the applicant should have known a couple of weeks
ago when the Commission discussed the Newmarker site that it was being farmed.
Mr. Smith explained that the Clark Street site is heavily wooded in areas,
and the material will not be visible from the street. They will use
usual erosion control measures , and will move about 35,000 cu. yds to the
site. Most of the material will be used on this site.
Mrs. Montana asked if there was any problem with the stockpile beirg so
close to wetlands , and Mr. Smith said no. Mr. Gilligan asked if they could
assure the Commission that they will clear off the Pleasant Valley Homes site,
and Mr. Jacques said that within a couple of weeks it will be clear .
Mrs. Montana made a motion to approve a two year temporary and conditional
permit from June 26, 1984 to June 26, 1986, for the stockpiling of material
on property located on the west side of Clark Street, as shown on a plan
prepared by Reino E. Hyyppa & Associates, dated 6-5-84, No. 43-80-IA.,
subject to the following conditions:
1. No work shall commence until the above map is modified in

3. A paved stub road must be shown on the west side of Clark
Street.
4. The plan must be modified to remove the proposed subd'vision
lines.
5. During transport to this site, all loads must be covered.
6. Proper sedimentation, erosion and dust control measures must
be taken, subject to the approval of the Town Engineer.
7. Proper staking and flagging to delineate the extent oC the
stockpile must be done.
