Application of Charles J. Natitus, 586 Foster Stre t, fDr a Special Exception to Section 4. 1. 9 to permit two additional horses on premises located on the east side of Foster Street, south of Beelzebub Road, in an RR zone. Mr. Charles Natitus was present and stated that he would like permission to keep two additional horses. They have a proximately 6 acres to accommodate the two horses and one pony. No one in the audience spoke in favor of, or in opposition to this applica- tion. Mrs. Evans asked if the three additional acres Mr. Nat tus intended to rent were contiguous to the other land, and if any of the site was fenced. Mr. Natitus said they were contiguous and the entire site is fenced. Mr. Mainelli said he understood Mr. Natitus had a petition signed by his neighbors, and Mr. Natitus submitted the petition which was signed by- six adjacent property owners and stated they do not object to the additional horses. 2. Application of William Krawski, et al, for an open space subdivision on approximately 60 acres more or less and approval of Section I, located between Felt Road and Foster Street, north of Bayberry Drive and south of Tallw od Drive, in an AA-30 zone. Mr . William Krawski was present and stated that this is his application requesting approval of an open space subdivision on approximately 60 acres, and approval of Section I, loca ed between Felt Road and Foster Street, Bayberry Drive and Tallwo d Drive. He noted the land in question is owned by his brother, obert, himself and his brother, Joseph. He said he is not representing LaCava and he is here as a landowner presenting an overall concept of an open space subdivision and Section I. The only hing the Commission will look at in detail is the 17 lots ii Section I. The remaining layout is subject to revision. There is a Bond for Deed which was executed last week with LaCava Construc ion Company, but the plan being presented tonight is Krawski ' s plan, and not LaCava' s. He said they are trying to develop a plan w ich is compatible with the neighborhood. Each of the three b others owns a 20 acre parcel, and the area of Section I is ow ed by William Krawski. He and his brothers have an agreeme t to work together to put this land together as a package. Access to Section I will be from Bayberry Drive, and it will be serviced with sewers and water. Planning & Zoning Commission -2- 5/3/83 Mr. Krawski went on to say that he had submitted three schemes to the Commission several months ago. The entire parcel will contain approximately 65 homes. The layout is the same as Green Ridge, which also has 65 homes on 60 acres. Highgate, which is nearby, is also an open space subdivision. This parcel is only wooded on approximately 25% of the site and remainder is open land. The proposed layout is a horseshoe, and the Town Planner and Town Engineer wouldn' t say where the proposed road should go. There will be a village green in the center of the development consisting of a large piece of usable land.. Open space which has been given to the Town in the past has been swamp areas or ravines, but the land they propose to deed to the Town is prime land. He noted that two people in Green Ridge that he spoke with didn' t even know there was open space in their subdivision, and a third person said it was not accessible. Mr. Krawski said the layout of Section I cannot be changed, regardless of how the remainder of the land is laid out. The houses were laid out for use of solar energy, and Mr. Krawski said he feels the open space should be maintained by the people in the subdivision and not the rest of the Town ' s taxpayers. Nothing in this conceptual plan violate the Town' s zoning regulations. The average lot size in this subdivision will be 25, 000 sq. ft. and the average size in Section I is 27 , 000 sq. ft. He emphasized that this application is not for a zone change, and the area is already zoned for one family dwellings. Mr. Krawski said that any questions concerning drainage in Phase I would be answered by Emil Lucek, who was present, and other questions concerning Phase I would be answered by his engineer, Douglas Pryor. Mr. Krawski then referred to two flyers that had been circulated in the neighborhood which stated the lots would be 17 , 500 s. f. , there would be 180 homes on 60 acres, lots would be 100 ' x 1251 , and Mr. Krawski said he didn' t know where this information was obtained but it was totally incorrect. He said he also heard rumors about apartments or condominiums being constructed, and this also was totally untrue. Mr. Emil Lucek then appeared and stated he was a consulting engineer with offices located on Buckland Road in South Windsor. Section I will have sanitary sewers, public water and storm drainage. The storm water will flow downhill to the east and follow the natural contours of the land and go into the existing detention pond in the Green Ridge subdivision, which will be modified to accommodate this water. Mr. Krawski said there is a technical `ormula used for calculating open space, and the plans shows 2. 5 acres of open space in Section I. Mr . Krawski said he is indebted tothe Town of South Windsor for ' $30 , 000 in back taxes and there is a foreclosure suit pending and his land will be taken over on June 13th. The suit was instituted by the Town. He noted that whether he sells the land or it' s sold at auction, it will be sold. LaCava is a reputable developer i Planning & Zoning Commission -3- 5/ /83 and four people bid on the land, but he went with the lowest bid so that he could have control. Director of Planning, Peter DeMallie, gave the following report: This application is for an AA-30 open space subdivision which allows the lot size to be reduced from 30 , 000 s. f. to 17 , 500 s. f. Front yard is 50 ' in both conventional and open space Eubdivision, but rear yard is 50 ' in conventional and 40 ' in open si,ace, and side yards are 10 ' rather than 20 ' . Width is 100 ' rather than 1501 , and depth is 125 ' instead of 1501 . Green Ridge is also an open space subdivision in an AA-30 zone. As indicated when it was received, there are a number Of problems with this application. This application is not for a zone change and the plan shows 67 lots and no variances are required. There will be water, sewers and improved streets. Average to size in Phase I is 27 , 000 s. f. , and they range from 21, 400 s. to 49 , 000 s. f. Detailed plans have not been prepared for other than Phase I, but if you assume a 25, 000 s. f. lot size, or a 16 . 67% lot size reduction, then the required open space to be added to the existing Town-owned open space would be 10 . 00 acres. r. Lucek said the concept plan contains 10 acres. Mr. Douglas ryor stated that there really are only 56 acres because fou lots have already been built upon. Mr. DeMallie went on to say that the house size is the same as in a conventional subdivision, and if LaCava is the developer they' d be likely to build houses similar to Wood Ponds To the south of this proposed subdivision is Green Ridge, whi h has lot sizes between 25 ,000 s. f. and 40 , 000 s. f. This includes the Mohegan Trail, Bayberry Trail, Horizon Circle area, ana as with this application, most of it was not heavily wooded. ro the north is Birch Hill Estates which meets the conventional AA- 0 lot requirements. This includes Deepwood, Palmer , Birch Hill Drive. Highgate Estates is a conventional AA-30 subdivision and includes Rainbow Trail, Autumn Drive, Clover, and Pine Hill Estates is a typical AA-30 lot size and includes the Tallwood Drive area. Valley View Farms Subdivision, west of Felt Road which includes Palmer, Valley View, Norman and Oakwood, is comprised of typical 20 , 000 s. f. Lots with 100 ' frontage and 200 ' lot depth. Mr. DeMallie said he endorses the "open space" concept and it has worked well in areas such as Green Ridge, South Ridge, Wood Ponds, Wentworth Estates, Skyview, Timber Knoll, Country View Estates, Rye Park Homes and Tudor Hill subdivisions. It affords no more lots than would be allowed in a conventional subdivision, however, provides for a substantial tract of open space land f r everyone ' s enjoyment with somewhat smaller lots and frontage. in this case there would be 10 or more acres contiguous to other Town open space. Planning & Zoning Commission -4- 5/3/83 Based on the zoning regulations, 78. 4 lotswould be allowed, and they are proposing 67 in their concept plan. The plans show "future open space" located between existing Town open space and Green Ridge open space and presumably it will be dedicated in subsequent phases . If so, the plans should say "Town Open Space" and the acreage should be indicated. The large open space area in the center of the proposed development should be altered so that it abuts the existing open space rather then remain a strip behind lots in the parcel ' s center. There should be an open space improvement plan showing seeding, loam, plantings and access points. The Town Plan shows a neighborhood park in this area and the open space concept is consistent with this. The Comprehensive Plan shows the desirability of roads connecting Felt with Foster and Green Ridge with Tallwood and Highgate. The plan submitted provides for interconnection with Green Ridge at Bayberry Trail and is consistent with the Town Plan. The Tallwood/ Highgate subdivisions are not consistent with the Town Plan since there is no Felt to Foster connection. This has forced residents of the surrounding neighborhoods to go through Mohegan Trail to Bay- berry and then to Foster, or through Birch Hill Drive to Foster. This places a burden on residents of these streets due to increased traffic flows. To reduce the burden there should be a third choice of an east/west street, and Mr. DeMallie said he recommends a through street in the Krawski subdivision, but not exactly as proposed. He said he would prefer one street coming west from Foster which would "T" into another street which would proceed to Felt. This would reduce the travel speeds and discourage traffic originating from aid destined to other parts of Town. He said he would like to see another north/south road west of the Town open space, and the existing placement of Deerfield at Felt with a new road directly opposite could compound the line of sight problems. A road midpoint between Deerfield Lane and the tract' s northerly property line would be preferable. Engineering investigation should be done regarding an east/west road opposite Orchard Hill Road since it may not be feasible. Mr. DeMallie said he strongly recommends against approving the ' 9 lots off Felt since the lots should have driveways served by interior streets and not be permitted to exit to Felt Road which is a through road and should remain relatively free of driveway curb cuts. The concept plan can be redesigned to correct this, and otherwise the basic lot layout is all right except for the changes necessitated by adjusting the location of the open space. Other recommended changes onthe plans are as follows : Add total lots in all phases; add allowable lots computation for entire subdivision; add open s pace computation for entire subdivision, add total acreage; number the lots beyond Phase I and correct Bayberry Drive to read Bayberry Trail. Planning & Zoning Commission -5- 5/3/8 Mr. DeMallie concluded that obviously the proposed plan required substantial revision, however he feels an AA-30 open space subdivision is very desirable in this area. It fits iii with the existing open space from Green Ridge and Highgate. LaCava will be the developer and once action is taken on this application they will take over from the Krawski brothers. He sa d he hopes to get comments from the Commission and neighbor ood regarding the concept plan and then meet with LaCava to come up with a good concept plan and subdivision proposal. Town Engineer Page said he agrees with Mr. DeMallie' s clomments in that there is more work to be done on the road network, and the only place the road can come out to Foster is across from Orchard Hill Drive. Adcess to Felt Road needs more wo k. He noted the important decision is whether to develop thi land under the open space concept. As far as drainage is cieen ncerned there is practically no difference between a conventioal or open space subdivision. Run off is the same, and sewe and water are available. Approximately 30 acres of this land drins to the south across Green Ridge. In Phase I the concept has to cut most of the flow off by the road and swales and draw it to the two detention basinscurrently in place. Both were designed to handle this subdivision when they were built. The detention basin in Green Ridge will require some modification in terms of the outlet. If Phase I is approved the Engineering De artment will require access to the dentention basin in Highgat . The Town has an easement now from Foster and Lot #4 and it woull be desirable to have a gravel road owned by the Town. Mr. Page noted that Highgate was a conventional subdivision, anJ not an open space subdivision. Open space was given to the T wn and the detention basin deeded to the Town at that time. There was a 15 minute recess, and then the Chairperson read the following letters opposing the application: Mr. Walter Ermanski of 37 Bayberry Trail, who was concerned with drainage from this site which could affect his property, and property devaluation and traffic. Mr. and Mrs. Robert L. George of 50 Horizon Circle who stated they are opposed to smaller lots. Carole H. Burbeck of 241 Foster Street, who stated she is not opposed to the subdivision, but is opposed to the open space concept, and also opposed to a through street opposite Orchard Hill. Mrs. Montana asked if anyone wished to speak in favor of this application and Joseph Krawski and Helen Krawski spoke in favor. Mr. Al Kupchunos said he thinks Mr. Krawski is owed an apology because of the inaccurate flyers which were circulated. He further said he would prefer to see Mr. Krawski develop this land rather than have someone from outside the community come in. Mr. Joseph Misoda of 24 Orchard Hill Drive said he is in favor, but believes Orchard Hill Drive should stop where it is now. Mr. Misoda (who is blind) said he depends upon sound to get around and listens for cars stopping on Orchard Hill Drive. He also said he would like the evergreen trees to remain. Planning & Zoning Commission -6- 5/3/83 Speaking in opposition to this application were the following persons: Edward Kennedy, 52 Tallwood, stated this is one of the nicest areas in Town and smaller lots shouldn' t be permitted. He said he recognizes Mr. Krawski ' s right to build, but they should be regular sized lots. Al Yacavone, 177 Clinton, stated he is not necessarily in opposition, but feels the pond might be an attractive nuisance to children in the neighborhood and a possible hazard. He also noted that consideration should be given for flood control so the Town doesn' t end up with another Avery Brook situation. Rolf Sheidel, 97 Orchard Hill Drive, said he would not like to see Orchard Hill Drive continuing through this subdivision, and even with a stop sign, traffic wouldn' t be properly controlled. Edward Powers, 351 Felt Road, said the plan shows 67 lots, and they are giving average square footage, but he ' d like to know the square footage of the smallest lot, such as the one at the intersection with Felt which looks very small. Charles Cheller of Autumn Drive, stated he movcdd from Massachusetts because the value --of his home was going down because of smaller lots in the area, and further stated he feels they are entitled to see a whole plan of the area. Edward Stevens of 5 Autumn Drive, said he lives next to open space and he has yet to see the Town do any maintenance work on this land. He said he is opposed to open space areas unless the Town assumes responsibility for the open space it already has. Richard Delmonte of 166 Bayberry Trail said he is not opposed to ' this land being sold, but is concerned about the pond almost directly across from his house on Bayberry. Town Enginner Page said that when this land is developed the pond will be made to go dry. When this land was farmed, they wanted it to have water in it. The area will be seeded and planted. Mr. Delmonte said he thought the Strawberry Patch required water from this pond, and Mr. Page said not to his knowledge. Mr. Delmonte said he also believes they should see a complete plan. Mr. Bernard Eisenberg of 347 Felt Road said the sign advertising this hearing could not have been placed in a better place if it was intended the neighbors shouldn' t see it. He suggested the larger lots be around the perimeter of the parcel, with the smaller lots in the interior. George Jahrstorfer, 50 Rainbow Trail, said he is concerned with the size of the building lots and especially the 100 ' width. He further stated that he has open space adjoining his property and agreed the Town does not take care of its property, and he has to do it. Planning & Zoning Commission -7- 5/3/83 He noted the open space proposed in this subdivision will not be utilized by anyone other than ihe people adjacent to it and it will be completely useless for half the people in the development. Bill Carroll, 328 Felt Road, said he has lived here sizice 1975 and would welcome nice homes in that area, but he is concerned with the lot sizes proposed. Smaller lots will change the complexion of this area, and the Town does not do a good job of taking care of the open space it has. He concluded that he is not opposed to homes in that area, but feels they should be on lots similar to the surrounding area. Bob Greenberg of 73 Autumn Drive said he agrees with the previous speakers, and thinks also that an environmental study and traffic study should be done, and added that he feels the Commission should only consider an AA-30 conventional subdivision There being no further comments from the audience, Mrs Montana asked if the Commissioners had any comments. Mr. Mainelli said he has several concerns: The point f crossing on both Felt and Foster must be cleared up; the size o ' the lots is of great concern; he is concerned with the open sp ce where it borders on- back yards, and he feels the plan needs ajor revisions before it can be entertained. - Mr. Mainelli aid he realizes this land will be developed someday and he ha5 walked the area many times, and the Commission will look at i carefully. Mr. Conde noted that the application is supposed to be for a 60 acre subdivision, but looks like it is for a 12. 4 acre subdivision. He said if the entire 60 acres is to be looked at it s ould be laid out so that the Commission has an idea of drainagB on the entire site. Mr. Hallowell said there is a problem with the key map, and there are no zoning violations for the 17 lots in Section I, but the remaining land is just lines on paper. Mr. Krawski replied that the only thing before the Commission this evening was the 17 lots and the road from Bayberry. He said this piece will fit into the overall concept but it is up to his brothers how their land is developed and when. John Jones of Bayberry Trail said that if this application is only for the 17 lots, then all the traffic will go through Bayberry for these 17 lots. Commissioner Evans asked Mr. Krawski if the entire 56 acres was under Bond for Deed to LaCava, and Mr. Krawski said yes. Chairperson Montana noted that the Commission has just gone through a situation with an open space subdivision that devel ped in this piecemeal fashion and in the final phases there was n t sufficient open space to give to the Town. She asked Mr. Krawski who the Planning & Zoning Commission -8- 5/3/83 Commission is supposed to deal with, and how they can deal with anyone when they don' t know the brothers ' plans. Mr. Krawski said his brothers have agreed that the open space they give the Town will be contiguous with his open space. Mrs. Montana asked what will happen if it ends up with one of the brothers losing lots because the Town wants the open space from their parcel, and Mrs. Evans noted that there ' s also a possibility that the Commission could require the entire 10 acres to come from William Krawski ' s parcel rather than just 3 acres. Mrs. Evans asked Mr. Krawski about the "deed restrictions" he previously mentioned regarding the fact that no more 67 lots would be developed and asked if these restrictions concerned his brothers ' properties as well, and if there were any other restrictions. Mr. Krawski said that the restrictions concerned all the property and there was a restriction that any left over open space land would remain for agricultural purposes, and also that the large pond that was given for open space in Highgate had a restriction that Mr. Krawski ' s brother had water rights. Mr. Norman told Mr. Krawski that if his intent was to show his neighbors an overall plan, that was fine, but this Commission has difficulty in looking at a subdivision that was advertised for public hearing as having 60 acres, but only shows final details for 17 lots. Mr. Norman then asked Mr. Lucek to explain the drainage system insofar as the two ponds are concerned. Mr. Lucek explained that the ' pond in back of Joe Krawski ' s house drains the area from the Highgate subdivision and also takes some drainage from areas as far north as Birch Hill Drive. The Tallwood Drive area has a split drainage system. The lower end, or east end, going towards Orchard Hill School has a system that collects near a cul-de-sac and through a yard and drains out of an in-wall and works its way down through a ditch into the upper or wet pond. On the Krawski property, half of the property- to the east now flows to the pond on Bayberry referred to as the dry pond since it is intended to make it dry. Water from the western half of the property flows down and slowly concentrates into a ditch, and then into a pipe that is either 12" or 15" and goes into the system on Bayberry. The applicant is proposing to put drainage along the road which will be called Krawski Drive and cut off the flow that is going to Bayberry. The water that is flowing on a road to be called Harrell Road will be cut off and carried to the east and down to the cul-de-sac to this detention pond. It will be piped into this so called dry pond. The outlet structure will be revised on this pond so that it will drain and be dry after rain- storms. Once the level is lower, it will be cleaned out and top soil will be put in and it will be a regular detention pond. Mr. Norman noted that Mr. Krawski referred to three schemes that were submitted to this Commission sometime ago, and pointed out Planning & Zoning Commission -9- 5/3/83 that those schemes were brought before the Commission informally and never discussed since an application was filed bef re the Commission ever had a chance to discuss them. Mr. Norman said that Mr. Krawski mentioned several tim s this evening that the layout of the first 17 lots can' t charge, and he noted that the road layout could change if the contiguous open space area is changed. He said there is concern whether the overall plan for the 60 acres could be implemented as presented tonight in spite of their good intentions. Mr. Krawski assure Mr. Norman that he would not land lock his brothers land. Mr. Kennedy of Tallwood Drive asked if someone could e plain to him why open space subdivisions are desirable. Mrs. Montana explained that it provides passive recreational areas for the neighborhood children and preserves area in its natural state such as along rivers and brooks. Mrs. Montana said she agreed that some of the open space areas in Town were obscure but the Commission is trying now to resolve this, and doesn' t want to take small narrow pieces that become someone' s back yard. Mr. Hallowell explained that he lives on Valley View Drive and the lower end 'of it was developed under the open space concept under legislation before the Town had such a concept. The land between Valley View and Scott Drive, which is about 6 or 7 acres, is open space and breaks up the sections. He said he personally prefers the open space area remain passive, and nothing be done with it. He noted it breaks up the 300 houses, and at the top of the hill where the lots are 175 ' or 200 ' in width ii, is just constant housing with nothing to break up the 200 or so homes. Another factor is that the Town has to maintain 50 per cent more roads. He said he thinks open space properly designed fits the overall concept in Town. He emphasized that the density is exactly the same and no more homes would be permitted than in a conventional AA-30 subdivision. Mr. Jim King of 5 Bayberry said he is extremely concer ed about the possibility of access to the entire area from Bayb rry. Mrs. Montana assured him it is extremely unlikely the ommission would ever permit this. Mr. Eisenberg of Felt Road raised questions concerning the parcels that do not belong to William Krawski and asked how th Commission could be certain what they will do. Mr. Krawski said the Bond for Deed was signed by all three of them, and is to LaCava and cannot be assigned to anyone else. Mr. Sorenson raised a question about the Lot designate #9 and the future open space land to the east of it. Mr. Kra ski said that lot has been bought back by him and he will live n it. It does not include the area designated "future open s ace" , and there is an easement providing access to the "future open space" land. Planning & Zoning Commission -10- 5/3/83 3. Application of Windshire Abbe Estates, Ltd. for an open space subdivision on 54 acres, and approval of Phase IV and V. located north and south of Bourbon Street, west of Foster Street, in an RR zone. Attorney Harold Cummings was present and said he had offices at 1665 Ellington Road and is a partner in this project with Richard Kelley. He said they are here this evening for approval of Phases IV and V and they presented Phase II to the Commission last month. This is to the east of the power lines. William O'Neill of Fuss & O'Neill pointed out on the map the sections in question. He said they are asking for an RR open space subdivision, with 13 lots to the north of Bourbon Street and 19 lots to the south of Bourbon Street. They will have all gravity sewers entering into the existing sewer line. They will have water from Connecticut Water Company , and storm water will go into a large natural detention area from Phase V, and the upper portion will go across property of Mr. Field from whom they have obtained permission. The rise in the water level from Phases I, II, IV and V from a 100 year storm would only be 1-3/4" which is not significant and hardly measurable. He pointed out the open space areas that have already been deeded to the Town and said that as part of tonight' s application they plan to deed over another 13 acres which will join the previous 4 acres. There would also be another 14 acres from Phase IV. He said there would be an entry point to the open space on Miller Road and another at Bourbon Street. He said there is also an exit point on Abbe Road Extension. Of the 54 acres considered tonight approximately half is being dedicated as open space. ' Mr. DeMallie reported that 13 lots would have been allowed in Phase IV and they are asking for 13, and 22 would have been allowed in Phase V and they are asking for .19 . They did not include the CLP easements intheir computations. They show 13 acres of open space required in Phase IV and 13. 92 acres in Phase V, however, they are actually giving 14 . 1 acres in Phase IV and 12. 7 acres in Phase V. The average lot area of Phase IV is 32, 418 s. f. , and in Phase V is 25, 089 s. f. There is a 50 ' access point to the open space south of Lot #39 and another 50 ' strip for a future street between Lots #64 and #63 . Wetlands do not encroach on any building area. There is a 50 ' strip for access to the Ireland tract. There are 4 different property owners (shown on Sheet #8) who should be deeded the abandoned cul-de-sacs. Lots #39 through #43 in Phase IV have a 50 ' CLP encroachment which should be addressed. Parcels C and D should have a notation that they are not approved building lots and do not have frontage on a Town street. The data block should be corrected regarding the open space computations, an A-2 certification is necessary on the topo maps, references to Lot #40 should be deleted since it has been combined with Lot #39 and open space access and improvements should be added. Mr. Page, Town Engineer, reported that they have had numerous meetings both in the field and in the office with Mr. O'Neill Planning & Zoning Commission -11- /3/83 and all the Engineering Department' s concerns have been addressed and drainage will work. A few notations will be necessary on the plans regarding the right to drain across some of the lots. Mr. Cummings said the plans should be amended to show a 50 ' strip from Bourbon to the south and Parcels C and D as heing deeded to Philip Ireland and not the Town of South Wind or. Mr. Cummings said that perhaps in the approval it could state that the Town will get the 50 ' strip and Mr. Ireland will be deeded Parcels C and D, and will have the right to u e the strip. Mr. Hallowell asked if the water pipe into Phase IV and V would be large enough to handle Phase II, and Mr. Kelley replied that it would. Mrs. Montana said she received a couple of calls regarding the drainage in the area of Phase I, and one was from Segal and another from DiCiancia. Mr. Kelley said this situation has now been corrected. The public hearing was adjourned at 11: 40 P. M. Respectfully submitted, Virginia S. App. #903 - The Balf Company - Savin Woods Subdivision App. #904 - 50 Acres, Ltd. - Wood Ponds, Section III Mr. Hallowell said he questions the validity of the application of Wood Ponds and noted that the application cannot stand o its own and is based on the approval of the Savin Woods applicat on. He said that applications that cannot stand on their own sh uld not be submitted. He raised a question as to what would happen to the Wood Ponds subdivision, if the Commission denies the Savin Woods application. The secretary told the Commissioners the attorney for Wood Ponds told her he would withdraw the application if Savin Woods was denied. Chairperson Montana said the question the Commission should consider is whether this large tract of open space land should be acquired for the Town. She read -the letter of approval dated April 20 for Savin Woods and said IWA approved Lots #1 through 6 and 21 through 30 . Mr. Hallowell said the drainage on Meadowbrook Road inihe Wood Ponds application is dependent upon the Savin Woods approval, ind Mr. Page, Town Engineer, noted that only a very -small portion of M adowbrook drains onto Savin property and that he personally does n t think it is a problem. Mr. Hallowell raised questions about whet er all the lots requested in both applications should be approved and a lengthy discussion ensued. Mr. Page said that he has walked this entire area and the open space areas are probably some of .the most beautiful land in Town, and it is the kind of open space land the Town would like to acquire. Mrs. Montana suggested the Commission should limit its d scussion to the Savin Woods development first. Mr. Hallowell sai he has no problem with the proposed Savin Woods subdivision, but h does have a problem with Savin, Bros. and noted that this Commissio has not re- ceived any cooperation from them regarding the industriaL development. He said if this subdivision is approved the Commission s ould require a substantial amount of bonds to ensure its proper compl tion. Mrs. Evans and Mrs. Montana agreed, and Mrs. Evans noted that Lot #30 has a substantial portion of it in the detention area, and questioned how it could be redesigned. Mr. Hallowell said he didn' think more than 12 lots should be approved, and suggested that #26, 25, 24 and 23 not be. approved. Mr. Norman said he can' t see thB difference between approving the 16 lots or 12 lots, and the applicant would have to come back for. 4 more lots in Phase I, plus the 1 is in Phase II. Mrs. Montana questioned whether it was economically feas 'ble to make them build the cul-de-sac twice. Mrs. Evans said tie Commission Planning & Zoning Commission -2- 5/17/83 should either remove all the lots on the cul-de-sac or leave it alone. She also noted that there is a Meadow Road in ihe surroundin area and the proposed "Meadowbrook" could cause confusion. It g was also noted there is a Savin Road in Town, and"Savin Wood" could cause confusion. Mr. Hallowell said that the Commission should review the amounts of the bonds that will be required, and that it should not accept Letters of Credit or anything other than surety bonds issued by insurance companies, so they can be held indefinitely. Mr. Hallowell then moved approval of App. #903, The Balf Company, for an open space subdivision in an RR zone, located between Nevers and Abbe Roads, as shown on plans prepared by Lucek Engineering Assoc. , Inc. , dated February 6, 1983, entitled Project 83-1, subject to the following modifications: 1. Mr. Norman seconded the motion and it was unanimously voted in favor , and so ordered. App. #904 - Wood Ponds Mr. Conde said he sees no reason why this application can' t be approved as is, but said building permits should not be issued for the lots on Planning & Zoning Commission -5- 5/17/83 Meadowbrook until the open space deed for the land to be acquired from Savin comes in. It was noted that the plans won' t even be filed until the deed has been received and approved by the Town Attorney and Engineering Department. Mr. Hallowell said the ope space area to be acquired from Savin should be shown on these Flans prior to filing. A discussion ensued regarding requesting a report from E T concerning the open space, and Mr. Hallowell made a motion that a report be requested from the Environmental Review Team concerning the open space areas in both Savin Woods and Wood Ponds. Mr. Sorenson seconded the motion and it was unanimously voted in favor and so crdered. It was agreed that the applicant would be permitted to file the final plans prior to receipt of the report since it may take as long as several months. The Commissioners reviewed the plans at length and Mr. C nde then made a motion to approve Phase III of Wood Ponds, consisting cf 20 lots in an Open Space subdivision in an RR zone, as shown on plans prepared by Lucek Engineering Assoc. , Inc. , dated January 30, 1983 , Proj . App. #907 - Windshire Abbe Estates, Ltd. , Phase II Mrs. Montana referred to a letter fromthe applicant' s att rney stating they would be willing to provide public water to his subdivision if required by the Commission. A lengthy discussion ensu d regarding Planning & Zoning Commission -8- 5/17/83 acquiring open space land for the Town now rather than waiting until the last phases of this development. The Commissioners agreed that they didn' t want another situation like Wood Ponds to occur where in the final phases of a sub divison there wasn' t enough desirable open space land .available. They further agreed that in view of the way this area is being developed with Phases I and II being conventional subdivisions in AA-30 zones, and Phase IV and V being open space subdivisions in RR zones, plus the fact that they don' t know how Phase III will look, determining open space areas is difficult. Mr. DeMallie suggested the Commission hold the deed for the area of Phase III in escrow, and Mr. Hallowell pointed out that that land is mortgaged and would be of no value to the Town. He suggested one lot from Phase II be held in escrow and the other Commissioners concurred and agreed Lot #29 should be held in escrow as open space. There was further discussion concerning modifications to the plans and Mrs. Evans moved approval of theabove application as shown on plans prepared by Fuss & O'Neill, dated February 7 , 1983, entitled Proj . No. 82-119A, consisting of 7 pages, subject to the following modifications: 1. This approval is for 14 lots, numbered 15 through and including 28 , as shown on the aforesaid plans. 2. An open space deed to the Town of South Windsor for Lot 429 shall be delivered to this Commission prior to filing the final plans. Said deed is subject to approval of the Engineering Department and Town Attorney, and will be held in escrow by the Town Attorney. The plans shall be modified to indicate the area of Lot #29 is open space. 3. Prior to submission of plans for the next phase, a plan must be submitted in accordance with Section 2 . 3. a of the Subdivision Regulations showing open space. 4. The triangular parcel of land designated "Parcel C" shall be shown on the key map, and the plans must clearly indicate that this is not an approved building lot. 5. All plans including the topographic map shall bear an A-2 certi- fication in accordance withthe Zoning Regulations. 6. Sheet #2 of the plans shall be corrected to show "Abbe Road Extension" near Berle Road. 7 . The key map shall be modified to show the cul-de-sacs at the end of Windshire Drive and Bramblebrae. S. In addition, we do plan on posting Ietters of credl to secure these various bond requirements . Mr. Ralph Alexander has brought to our attention the fact that the garage portion of Building #9 is located within the permanent easement area designated for the site drainage system. If the easement area in question is *redef ined to be 1. 0 feel, off the foundation of the building in question, it will be adequate for maintenance of the drainage facilities , and is acceptable. 6. However, additional buffering should be considered ac. future site plan developments come in for the abutting lots A heavy growth of weeds is present on the bottom of the basin. Considering the wet nature of the facility, this typE of growth is to be expected. It is not anticipated that regular mowing of the basin bottom can be performed by Town Staff w en the detention basin is accepted by the Town. However, t e proper operation of the facility in handling storm water will be maintained through proper maintenance. The overall area appears ready for acceptance, and it is recommended that the $30 ,000 bond be released. Upon field investigation, there are three rows (onll two rows originally required) of 5 foot high pines spaced 15 feet on center to act as site buffering to Edgewood Drive. All thE trees are healthy and thriving, therefore, release of the $5 , 00 bond is recommended. 9 . Diplomat Restaurant: Insufficient Information -- Nc Comment. 10. No Comment. 11. No Comment. 12. In concern of the materials already stockpiled on the subject Clark Street property, the following recommendation are made: A. ) The material is to be adequately covered with topsoil and seeded to stabilize. B. ) A plan should be submitted showing the parcel boundaries and the location of the stockpile. SensitivE intrusions, i. e. , wetlands should be indicated, as well as the volume of material deposited on site. C. ) The toe of slope of the stockpile should be protected with hay bales staked in place. D. ) The intended use of the material as well as the time frame under which the material is to remain on the property should be addressed. 13. A. ) Windshire Abbe -- Open Space: The access improvements proposed for the open space area in Phase IV should be contained within the north side of the right-of-way immediately adjacent to Lot # 9 . This will leave the easement over the sanitary sewer clear for access and line maintenance. B. ) Mavronek Strip: The small parcel of land known as the "Mavro ek Strip" apparently cannot be purchased by the applicant. Although acquisition of the parcel to provide a straight continuous right-of-way line would be preferred, the jog in the line without the strip is acceptable since both the pavement and sidewalk can be constructed adequately. The South Windsor Town Council voted to accept the parcel of land in question at their regular meeting held on eptember 19 , 1983. The intended use of the parcel is to allow radius improvement to be constructed at Buckland and Elli gton Roads by Town Staff. As indicated on the plan, it will he possible to achieve up to 6 feet additional pavement area tc ease movement through the intersection for both east and southbound traffic. Rob rt Ars6nault Director of Public Works and Acting Town Engineer RA:bw PLANNING AND ZONING COMMISSION SEPTEMBER 27 , 1983 REGULAR MEETING SOUTH WINDSOR TOWN HALL MEMBERS PRESENT: Evans , Montana, Hallowell , Sorenson, So osiak, Conde ALTERNATES PRESENT: Mainelli (sitting for Norman) ; Gilligan; Morrison PUBLIC PARTICIPATION - None NEW BUSINESS 1 . Item b - insufficient information for proper review as of this writing . I recommend that the application not be accepted at this time. " Mr. DeMallie said that an inter-town agreement should be in place prior to going to public hearing on item c , the applicani n of Douglas Johnson for a zone change, since it drains into V rnon . He noted that he will follow-up and let the Commission know hen an agreement has been reached. Mr . Conde made a motion to receive the following applications : a . Susan Havens , Special Exception to 4 . 1 . 8c to permit day care/learning center at 118 Oakland Road , RR one ; C . Douglas Johnson, Zone Change , RR to A-20 , 75 acres , northwest corner of Dart Hill and Newmarker Road; d. South Ridge Estates , Section V. 9 lots ; e . Mr. Hallowell seconded the motion and it was unanimously Noted in favor and so ordered . Item b - Application of Joseph Boscarino (Diplomat Restaurant) for a site plan of development for 1017 Sullivan Avenue , CG zone ,, was not officially received. 2 . App. #936 - Cho stix Chinese Foods, John Fitch Boulevard Mr. Sorenson made a motion that the 65 day extension granted by the applicant in which to act in this matter be accepted . Mrs . Sorosiak seconded the motion and it was unanimously voted in favor and so ordered . The extension is from September 29th to December 3 , 1983. Planning & Zoning Commission -2- 9/27/83 3 . App . #889 - Indian Ridge Condominium- Attorney Sbarge was present on behalf of the applicant and stated they are almost ready to file the mylars in this matter . The Town Attorney is reviewing the proposed letter of credit , and all fees and documents have been submitted . Mr . DeMallie said the Town Attorney advised him that the applicant was entitled to a total of 180 days extension . Mr . Hallowell made a motion to expand the second extension granted from 30 days to 90 days , to December 3 , 1983 . Mr . Sorenson seconded the motion and it was unanimously voted in favor and so ordered . 4 . Telecommunications Center , SNETCO, Niederwerfer Road Mrs. Montana said the Siting Council has postponed the public hearing which had been scheduled concerning the site on Niederwerfer Road . Mr . Conde moved this matter be tabled , and Mr. Mainelli seconded the motion. It was unanimously voted in favor and so ordered . 5 . App . #835 - Burr Meadow Condominium Ray Alexander produced a plan showing the development and stated that Building #9 has been moved about 3 feet because of the drainage . Mr. Arsenault ' s memorandum stated: " . . . the garage portion of Building #9 is located within the permanent easement area designated for the site drainage system. If the easement area in question is redefined to be 1 . 0 feet off the foundation of the building in question, it will be adequate for maintenance of the drainage facilities , and is acceptable . " fir . Sorenson made a motion to approve the modified plan as shown on Sheet P1 prepared by Palmberg & Russo , dated 8-4-83 . Mr . Conde seconded the motion and it was unanimously voted in favor and so ordered . 6 . Savin Brothers , Inc . , Parkcentre, Landscape Plan Attorney Edwin Lassman, Mr . Robert Kaye , and Mr . Alan Viets were present . Mr. Viets , the landscape architect , noted that his office is now located in Simbsbury and produced the plan , consisting of four sheets , which will be completed within the next two to three years . The first area at Savin Drive and Governor ' s Highway calls for 10 London Plane trees on Governor ' s Highway , with a Crimson King Maple , Littleleaf Linden and White Birch along Savin Drive , plus some shrubs . Some of these trees may be available from the Town of South Windsor and they are working with the Economic Development Commission and Chamber of Commerce . If the trees are available , they will be planted immediately . Planning & Zoning Commission -3- /27/83 The application pending before the Commission for David Allen Plastics has been coordinated with the landscape plan proposed this evening, and an effort will be made to coordinate future tenants landscape plans with this plan. Mrs . Evans said she likes the idea of Mr. Viets coming in with something more substantial and what they are proposing now should have been proposed 8 or 10 years ago and there would now be a buffer . Mrs. Montana asked when the evergreens were planted in Detention Basin #3 and Mr . Kaye said in April of 1982 . He produced photos of the trees taken last spring , and again this fall . Mr . Viets said it will be 6 to 8 years before they are of significa t size . Mrs. Montana noted that what has been done in the industrial part is . a fantastic improvement and will be nice, but there does ' t appear to be much done as far as the areas abutting residential areas is concerned. Mr . Mainelli asked if it would be possible to get some pl ntings started on the undeveloped lots , and Mr. Kaye said that t ey don ' t know where the buildings will be, or where the driveways oill be . Referring to the buffer planted to the rear of the lots on Edgewood , Mr . Kayesaid the 5 ' trees cost $23 . 50 each and labor was $1300 . Forty-two trees were planted . Mrs . Montana said she would like to consider interspersing larger trees with the seedlings . Mr. Kaye said there is already a tremendous amount of natural growth in much of the area . Several residents who were present stated their dissatification with the proposed plan. Mr . Hallowell suggested the Commission consider getting a bond for plantings in the entire industrial park when the next site plan comes in. Mrs . Montana reminded the residents that there currently is no building behind their lots, and when an application comes in for a site plan the Commission will have the opportunity of requiring landscaping and buffering between the proposed building and their lots . Mr. Viets said that the seedlings which will be planted grow about 8-10" a year for the first five or six years , and than add on at the rate of 10-12" per year . They try to maintain a survival ratio of 80% or better . Mrs . Montana suggested again that larger trees be planted in the area of the berm to the rear of the lots on the westerly side of Edgewood and after a discussion Mr . Lassman said that Savin Brothers would plant 65 five foot white pines . Mrs. Evans then made a motion to approve the landscape plan for Parkcentre , as shown on plans prepared by Alan Viets Associates , dated September 6 , 8 and 9 , 1983, subject to the following modifications: 1 . Sheet L4 shall be modified to show 65 five foot W ) w ite pines in the area of the berm to the .rear of the lots Dn the westerly side of Edgewood . Planning & Zoning commission -4 2 . Said plantings in this area shall be made in the Fall of 1983 , if possible , and in any event no later than the Spring of 1984 . Black and white transparent mylars of the landscape plan, with this letter reproduced thereon, shall be submitted to this Commission to be stamped and signed, and will be filed in the Office of the Town Clerk. Mr . Mainelli seconded the motion and it was unanimously voted in favor and so ordered . 7 . Detention Basin #3, Parkcentre Mrs . Montana referred to Mr. Arsenault ' s memo which stated that the"drainage appurtenances associated with detention basin #3 are complete and appear to be in good working order . . . . . . The overall area appears ready for acceptance , and it is recommended that the $30 , 000 bond be released . " After a brief discussion Mr . Hallowell moved that the $30 , 000 bond be reduced to a $5 , 000, one year maintenance bond , and the Commission recommends acceptance of the detention basin by the Town Council . Mr . Mainelli seconded the motion and it was unanimously voted in favor and so ordered . 8 . Savin Brothers , Inc . , $5, 000 bond, Edgewood Drive The request for release of the $5 , 000 bond to ensure landscaping to the rear of the lots on Edgewood Drive was tabled . 9 . Pleasant Valley Homes , Open Space, Section 1 Recreational Land , Section 8 Attorney LeFoll reported that the open space contained in Section I , as shown on the plans submitted in connection with Section I , has been revised . Mr . DeMallie pointed out that this is a technicality and the maps on file should accurately portray the open space . After a brief review of the revised map , Mr. Sorenson moved that the plan dated 5/16/79., revised to 2/25/82, prepared by Megson & Hyyppaa, entitled Map #220-78-lH be approved . Mr. Conde seconded the motion and it was unanimously voted in favor and so ordered . Mr . Creedon of Reino Hyyppa & Associates was present , and pointed out on a map dated 1/29/80, revised to 5/19/82 , four lots currently being held in escrow pending an agreement to be worked out concerning four acres of active recreational land . The lots are #171 , 172 , 173 and 174 in Section 8 . He point to five areas marked in green which could be used for active recreational purposes . The Commissioners discussed them in detail and agreed that the parcel near the center of the subdivision is already owned by the Town . The long narrow piece to the northwest corner of the site does not have good access and does not connect with any other open space. Mr. LeFoll noted that one of the two parcels along Margaret Drive could be a tot lot , and the area adjacent to the open space could be used for a picnic area . He added that they have tried in good faith to come up with a proposal to give the Town money instead of land , but it doesn ' t appear a method for doing this will be worked out for some time . Mrs . Evans commented that scatter- ing these small parcels throughout the site presents maintenance problems for the Town. Planning & Zoning Commission -5- 9/27/813 Mrs. Evans said that perhaps the Commission should accept the four parcels , but only develop the two on Margaret Drive. They could be leveled and graded , and the debris cleaned out . They sh uld also be buffered from the adjoining homes . Mrs . Montana said that people who are purchasing homes should be aware of which weas are open space and recreational land. She referred to a letter from Mr. & Mr . Jones at 11 Carey Lane, stating an active recreational area is needed. Mr. Sorenson pointed out that originally the Commission was requiring four acres of active recreation land; and now it ' s down to 231 acres divided by a street . Mrs. Evans said that one of the areas on Margaret would make a good tennis court . There was a brief discussion by the Commissioners and it was agreed that a tennis court should be constructed on the northerly side of Margaret Drive . Mrs. Evans made a motion to accept three parcels of open space land as shown on the plans prepared by Reino E. Hyyppa & Associates , dated 1/29/80, revised to 5/19/82 , entitled Map No . 82-79 1B, as follows: 1 . The three parcels which will be deeded to th Town for use as open space are the parcels on the north side of Margaret Drive between Lots #168 and 169 ; on the south side of Margaret Drive between ots #176 and #177; and on the westerly side of the si a to the rear of Lot #73 . 2 . A tennis court will be constructed by the aplilicant on the lot on the northerly side of Margaret Drive , 3. The parcel on the southerly side of Margaret Drive will be graded and seeded. 4 . The 9500 s . f . parcel to the rear of Lot #73 will become part of the open space deeded to the lown . 5 . The lot lines on Lots #168 , 169 , 176 and 177 will be revised. 6 . A buffer of Eastern White Pines shall be planted on both sides of the parcels located on Margaret Drive . 7 . The letter of credit from Connecticut Bank & Trust Company , in the amount of $280 , 000, currently being held by this Commission, will be extended to ensure completion of the tennis court on the parcel on the northerly side of Margaret Drive. 8 . Item l . a in the Commission ' s approval letter dated 7/28/83 stating that Lots #171 , 172 , 173 and 174 shall be held in escrow until such time as an approved recreational policy and/or area has been established, is hereby deleted, and building permits may be issued f r said lots . 9 . A drainage assessment fee in the amount of $2 0 for Lots #171 , 172 , 173 and 174 shall be paid to the Planning & Zoning Commission. Planning & Zoning Commission -b- 9/27/83 A black and white transparent mylar of the above plan , modified as aforesaid , shall be submitted to this Commission to be stamped and signed , and must be filed in the Town Clerk ' s Office within 90 days . Mrs . Sorosiak seconded the motion and it was unanimously voted in favor and so ordered. 10 . J . M. J. Construction Co . , Jean Marc Jacques , Stockpiling , west side of Clark Street Mrs . Montana read a letter from Deputy Town Engineer , Bowen Davies, concerning stockpiling of earth on the west side of Clark Street , without permission from the Planning & Zoning Commission. Mrs . Evans said she drove down to look at it and there ' s quite a large pile of earth at this location . Mr . Arsenault ' s report on this situation reads as follows : "The material is to be adequately covered with topsoil and seeded to stabilize . A plan should be submitted showing the parcel boundaires and the location of the stockpile . Sensitive intrusions , i . e . , wetlands should be indicated , as well as the volume of material deposited on the site . The toe slope of the stockpile should be protected with hay bales staked in place . The intended use of the material as well as the time frame under which the material is to remain on the property should be addressed . " Mrs . Montana asked how this situation occurred in the first place , and Mr . LeFoll said they weren ' t aware it was considered a filling operation and that PZC approval was necessary . Mrs . Evans said she is concerned with the nature of the material since it appears to be very sandy . Mr . Hallowell said he wondered how that much material could be moved in violation of the regulations without the Town ' s staff being aware of what was going on , and Mr . LeFoll said that the Town ' s staff did notice it , and Mr . Davies called him. Mr . Conde asked what they intended to do with this dirt, and Mr . Jacques said that when this site on the west side of Clark Street is developed they intend to use it . In the meantime , they will seed it , and use the fill as needed . He asked that they be given permission to truck in another 3 , 000 cu. yds . Mrs . Montana said stockpiling this earth without permission is inexcuseable and in violation of the regulations and she doesn ' t want to see it happening again. Planning & Zoning Commission -7- 9/27/83 Mr . Mainelli made a motion to permit the filling operation on the site located on the west side of Clark Street , as shown oi the plan prepared by Reino E. Hyyppa & Associates , dated 9/26/83 , Nap No. 43-80-1, subject to the following conditions: ' 1 . This permit is for one year and will expire September 28 , 1984 . 2 . An additional 3 ,00 cu. yds . of fill may be b ought to the site for a total of. 10 , 000 cu. yds . 3 . The entire site must be graded, loamed and seeded by October 15 , 1983 in accordance with the Z ning Regulations, and is subject to the approval cf the Director of Public Works . The site must be graded as low as possible . Mr . Conde seconded the motion and it was unanimously voted in favor and so ordered. Mr. Mainelli made a motion to continue the meeting after 10: 30 P . M. Mr . Conde seconded the motion and it as unanimously voted in favor and so ordered . p 1 . Windshire Abbe Estates , Pha es IV and V Mr. gineering was present on behalf f the applicant . He noted that condition #5 in the approval letter dated 5/23/83 stated that an Open Space improvement plan must be submitted to this Commission before filing the final plans . They wo ld like to defer filing this plan because they are working on an agreement with the adjoining property owner , Philip Ireland , and he nay be filing an application for a subdivision shortly . Mrs . Montana noted that on Bourbon Street they could erect a log and wood type thing so that the open space property is defined Mr. Gilligan agreed that some temporary structure should be er cted to show that there is a right-of-way through this area. The Commissioners concurred that the applicant could defe filing the open space improvement plan for the time-being , but t at some something should be installed to indicate that this is ope space with a right-of-way going through it . Mr . Page then referred to a plan showing how Bourbon Street will continue through Phase IV, and explained that it was necessary to secure a small parcel of land from the owner of the last lot on the right-hand side of Saginaw Street, Samuel and Shirley Marvonek, in order to continue the right-of-way into the new development . However, they have been unable to reach an agreement with the Marvoneks . Planning & Zoning Commission -8- 9/27/83 Mr . Arsenault ' s report indicated that "although acquisition of the parcel to provide a straight continuous right-of-way line would be preferred , the jog in the line without the strip is acceptable _ since both the pavement and sidewalk can he constructed adequately . " Mr . Page noted that there will still be 26 ' of pavement even if Marvoneks ' land is not part of the right-of-way . He said that there is a temporary cul-de-sac there right now. Mr . Mainelli made a motion to approve the modified plan showing the right-of-way without the Marvoneks ' parcel included . Mr . Sorenson seconded the motion and it was unanimously voted in favor and so ordered . Mr . DeMallie noted that at one time the Commission raised the subject r of recommending that the 50 ' right-of-way on the south side of Saginaw Street , west of Foster Street , be abandoned in favor of the two adjoining property owners . He asked if they wished to do so , and the Commission concurred that this 50 ' right-of-way should be abandoned in favor of the two adjoining property owners and instructed the secretary to notify the Town Manager. Mr . Richard Kelley of R. S . K. Contractors was present and stated that the Commission is currently holding a $45, 000 Letter of Credit for Phase 'I , $155 , 000 on Phase II and $95 , 000 on Phases IV and V . The final plans have not been filed on IV and V since they still need another $130 , 000 in bonds . He said he needs some building permits for Phases IV and V. After a brief discussion Mr . Conde suggested the Town Engineer inspect the site and give the Commission his recommendations regarding the bonds . Mrs . Evans made a motion that building permits could be issued for Lots 39 , 40 , 50 , 56 , 57 and 67 , however , no certificates of occupancy will be issued until the approved mylars have been filed in the Town Clerk' s office. Mrs . Sorosiak seconded the motion and it was unanimously voted in favor and so ordered . 12 . Improvements to Ellington & Buckland Roads in front of Society for Savings Mr . Conde moved that the proposed improvements to the intersection of Ellington & Buckland Roads in front of Society for Savings be approved , as shown on plans prepared by the Town of South Windsor , Bureau of Engineering , dated 5/16/83 . Mrs . Sorosiak seconded the motion and it was unanimously voted in favor and so ordered . MINUTES Mrs . Evans moved that the Minutes of June 21 , June 28 , July 12 , July 19 , July 26 , and September 6, 1984 be approved. Mr . Mainelli seconded the motion and it was unanimously voted in favor and so ordered . There being no further business , Mr . Conde moved the meeting be adjourned at 11 : 05 P . M. Mrs . Gilligan, Chairman Planning & Zoning C=nissicn Town of South Windsor 1540 Sullivan Avenue South Windsor, CT 06074 Attention: Mrs. Virginia Grapey Dear Ginny• I checked with Don Page, at the South Windsor Bank, with regards to tie mechanics of amending the Windshire Letter of Credit, to reduce it to $175,000. 0, per the letter of February 2nd. Don Page weld prefer that you send a letter directly to him, indica g, that upon your receipt of a revised Letter of Credit, frcn the South Windsor in the principal sum of $175,000.00, that you would return to him the origin $250,000.00 Letter of Credit, which you are presently holding in your files. Apparently, in the mechanics of reducing, or amending, the Don would prefer to issue a new Letter of Credit, in the amount of $175,000.00, rather than issuing Letters of Amendment. This would probably be the cleanest approach, all the way around, so at there would be no confusion as to the exact principal amount of the Letter of Credit (sane- times, Amendment Letters get lost in the file) . Therefore, I would appreciate your sending such a letter to Don, Upai its receipt, he will immediately issue a $175,000.00 Letter of Credit, to the Town on exactly the same terms and conditions as the prior Letter, except as to amncnuz , and, then, upon your receipt of that new Letter from Don, you could, then, forward, to him the old Letter from your files.
